The Conundrum of the Essential Security Exception: Can the WTO Resolve the GATT Article XXI Crisis and Save the Dispute Settlement Mechanism?
The continued blocking of Appellate Body members to the World Trade Organization’s dispute settlement mechanism has thrown the multilateral trading system’s most important governing body into an existential crisis. As a precondition for resuming the WTO’s dispute settlement functions, the United States has insisted that WTO Members agree that the “essential security exception” under Article XXI(b) of the General Agreement on Tariffs and Trade of 1994 is wholly self- judging and thus nonjusticiable. This article argues that the U.S. position is unsupported by the text, context, object and purpose, and negotiating history of Article XXI. Moreover, the U.S. position poses dangerous consequences to the future relevance and legitimacy of the rules-based trading system. Continued insistence of Article XXI’s nonjusticiability by the United States would thus be misguided, and indeed risks only worsening the current crisis

In collaboration with Women’s Initiatives for Gender Justice, Legal Action Worldwide, UN Women, the Australian Embassy in The Hague and the International Gender Champions Network, the Grotius Centre for International Legal Studies is pleased to announce the Gender and International Criminal Law conference, which will take place on 16 and 17 January 2024 in The Hague.
Save the dates for this conference, which will explore pivotal issues that push the boundaries of gender justice in International Criminal Law. This two-day conference will bring together over 100 key figures in the field of Gender Justice to share knowledge, inspire practical solutions and create a renewed energy to inform a more equitable International Criminal Law field.
The motivating factors behind this conference are the publication of the comprehensive book entitled Gender and International Criminal Law in July 2022 (Oxford University Press), edited by Indira Rosenthal, Valerie Oosterveld, Susana SáCouto, and a new initiative to establish a Gender Justice Practitioner Hub (GJP Hub) to support and connect practitioners involved in securing gender justice.
Join us as we bring together over 100 key figures in the field of Gender Justice for an engaging exploration of pivotal issues. The aim of this conference is to facilitate knowledge sharing, inspire practical solutions and create a renewed energy in order to shape a more equitable International Criminal Law field
Reconceiving Corporate Rights and Regulation in the AI Era
Can existing corporate governance principles properly guide the relationship between shareholders and directors as artificial intelligence (“AI”) plays an increasingly prominent role in corporate management, planning, and operations? Without a doubt, AI technologies allow corporations to enjoy enhanced efficiency and innovation. But the vast range of AI capabilities—from sophisticated data analytics to autonomous decision-making—raises profound questions about whether traditional governance principles remain sufficiently robust to cabin the proper development and deployment of such a powerful and rapidly evolving set of new technologies. Current corporate governance structures that focus on human actors and traditional business decision-making mechanisms seem ill-suited to address some of the novel legal questions that increased reliance on AI poses, especially considering the opacity regarding how AI technologies actually function. Because the existing fiduciary framework for corporate governance remains insufficiently supple to accommodate AI’s transformative impact on corporate practices and strategy, there is a pressing need to reconsider basic corporate governance principles
