Involvement of minors in subvertive activities against Ukraine: criminal analysis of war criminal practices in cyberspace
No full textУ статті досліджено нову кримінально-криміногенну загрозу – втягнення російськими спецслужбами українських неповнолітніх у підривну діяльність проти України в умовах російсько-української війни. Зазначено, що попри існуючі системи захисту прав дитини, війна виявила та посилила низку глибинних проблем у соціальній, економічній, інформаційній, освітньо-педагогічній, сімейно-виховній та правоохоронній сферах, що створюють умови залучення підлітків до кримінальних практик. Проведено аналіз даних офіційної статистики та повідомлень правоохоронних органів України що свідчать про зростання підривної діяльності, фігурантами якої є неповнолітні. Виокремлено основні ознаки втягнення неповнолітніх у підривну діяльність проти України в умовах війни: використання цифрових платформ, корислива мотивація, прихована мета дій, застосування маніпулятивних практик. Акцентовано увагу на необхідності впровадження дієвих загальносоціальних і спеціально-кримінологічних заходів протидії досліджуваному виду кримінальних практик, зокрема за допомогою правоохоронних ініціатив, освітніх проєктів, інформування громадськості та захисту вразливих категорій дітей. У висновку зазначено про критично важливу роль держави у захисті дітей як запоруки збереження майбутнього держави та стабільності суспільства в умовах війни.This article examines a pressing criminological issue: the involvement of
Ukrainian minors in subversive activities against Ukraine orchestrated by Russian
special services during the ongoing Russian-Ukrainian war. It highlights that,
despite existing child protection systems, the war has exposed and intensified
various profound problems across social, economic, informational, educational,
familial, and law enforcement areas, which create conditions for the involvement
of adolescents in criminal practices. The author analyzes official statistics and
reports from law enforcement agencies in Ukraine, which indicate a concerning
rise in subversive activities involving minors. Key indicators of this involvement
include the use of digital platforms, selfish motivations, concealed intentions
behind actions, and the employment of manipulative tactics. The article stresses
the importance of implementing effective general and specialized criminological
measures to combat these criminal activities. It emphasises the need for law
enforcement initiatives, educational programs, public awareness campaigns, and
protective measures to support vulnerable children. The author concludes by
underscoring the critical role of the State in safeguarding children, viewing this
commitment as vital for ensuring the future stability of the State and society
during wartime

Однією з таких сфер є енергетична безпека, що набуває особливого значення в умовах глобальної нестабільності, економічних криз та загроз енергопостачанню. Спрямування податкових надходжень від грального бізнесу на фінансування енергетичної безпеки дозволяє створити додаткові можливості для модернізації енергетичної інфраструктури, розвитку відновлюваних джерел енергії та зменшення залежності від імпортних енергоносіїв розглядаються ключові аспекти оподаткування грального бізнесу, його економічне значення та можливості використання отриманих коштів для забезпечення стабільності енергетичної системи держави. Проаналізовано світовий досвід використання доходів від азартних ігор для фінансування стратегічно важливих сфер, зокрема енергетики. Наведено механізми розподілу податкових надходжень, які можуть сприяти підвищенню ефективності державної політики у сфері енергозабезпечення. Розглянуто питання регулювання оподаткування грального бізнесу в Україні та можливості його вдосконалення для створення стабільного джерела фінансування енергетичного сектору. Підкреслюється необхідність чітких законодавчих норм, які сприятимуть ефективному адмініструванню податків у цій сфері. Акцент зроблено на важливості збалансованої податкової політики, яка не лише сприятиме економічному розвитку, але й дозволить залучати додаткові ресурси для посилення енергетичної безпеки країни.The gambling business is an important component of the economic landscape, capable of generating substantial revenues for the state budget. Taxation of this sector serves as a powerful tool for accumulating financial resources that can be allocated to strengthen strategically significant industries. One of the key areas requiring such financial support is energy security, which has become increasingly critical in the face of global instability, economic crises, and threats to energy supply. Redirecting tax revenues from the gambling industry toward financing energy security creates additional opportunities for modernizing energy infrastructure, developing renewable energy sources, and reducing dependence on imported energy resources. This article examines the fundamental aspects of gambling business taxation, its economic impact, and the potential use of generated revenues to ensure the stability of the national energy system. The study explores international experiences in utilizing gambling-generated revenues for financing strategically important sectors, particularly energy. Various mechanisms for allocating tax revenues are presented, which may enhance the effectiveness of state policies in the energy sector. The paper also addresses the regulation of gambling taxation in Ukraine and explores potential improvements to establish a stable financial source for the energy sector. The necessity of clear legislative frameworks to facilitate effective tax administration in this field is emphasized. The study underscores the importance of a balanced tax policy that not only fosters economic growth but also enables the mobilization of additional resources to strengthen the country’s energy security

індивідуальної злочинної поведінки щодо втягнення неповнолітніх у
протиправну діяльність. Цей механізм є складною динамічною системою
взаємодії втягувача, самого неповнолітнього, ситуації й елементів
зовнішнього середовища, включаючи (факультативно) жертву того
кримінального правопорушення, до вчинення якого неповнолітній
втягується та/або інших осіб, які залучені як суб’єкти до випрошування
грошей, іншого майна, розпиття алкогольних напоїв. Встановлено та надано
опис особливостям двох механізмів формування мотивів втягнення у
кримінально протиправну діяльність: 1) проєкція мотиву самого
кримінального правопорушення, до вчинення якого втягується
неповнолітній, а саме: корисливий мотив, ресентиментарно-службістські
мотиви, мотив самоактуалізації через особистісне домінування, помста,
нігілістичний мотив; 2) самостійне фокусування мотивації на особі
неповнолітнього, що в результаті репрезентує такі мотиви втягувача:
мотив самоактуалізації та визнання; мотив безпеки; корисливий мотив.
Надано характеристику етапів прийняття та реалізації рішення про
вчинення кримінального правопорушення, передбаченого ст. 304 КК України.The article is devoted to the criminological analysis of the mechanism of
individual criminal behavior in the involvement of minors in illegal activities. This
mechanism is a complex dynamic system of interaction between the instigator,
the minor himself, the situation and elements of the external environment,
including (optionally) the victim of the criminal offense in which the minor is
involved and/or other persons who are involved as subjects in begging for money,
other property, drinking alcoholic beverages. The peculiarities of two
mechanisms of formation of motives for involvement in criminally illegal
activities are established and described: 1) projection of the motive of the
criminal offense itself in which the minor is involved, namely: a self-interested
motive, resentful-service motives, a motive of self-actualization through personal
dominance, revenge, a nihilistic motive; 2) independent focus of motivation on the
person of a minor, which as a result represents the following motives of the
inductee: motive of self-actualization and recognition; motive of security; selfish
motive. A description of the stages of making and implementing a decision to
commit a criminal offense, provided for in Art. 304 of the Criminal Code of
Ukraine, is provided
