Study of the effects of hyaluronan biosynthesis Inhibition by 4-methylumbelliferone on human Aortic smooth muscle cells.
After atherogenic injury aortic smooth muscle cells (AoSMCs) which are normally located within the tunica media of blood vessels begin to synthesize high levels of extracellular matrix (ECM) components such as hyaluronan (HA), that is involved in the modulation of AoSMCs behaviour. During aging the onset of cardiovascular diseases increases dramatically and, in a cell aging in vitro model we found that in aged AoSMC HA synthesis is upregulated, enhancing their migration. Since HA strongly affects neointima formation we investigated the effect of HA synthesis inhibition by 4-methylumbelliferone (4MU), a natural derivative of coumarin, known to inhibit HA synthesis in some cell lines.
AoSMC treated with 4MU showed a dose dependent reduction of HA synthesis that could be related both to a reduced genetic expression of the key enzymes involved in its biosynthesis and to a reduction of the cellular pool of UDP-glucuronic acid, caused by the glucuronidation of this chemical by UGTs, that we found to be constitutively expressed and active in AoSMC. Gene expression analysis by Real-Time RT-PCR revealed that 4MU treatment dramatically reduces HAS2 expression: to confirm the key role of this enzyme in HA biosynthesis we abrogated its expression by means of siRNA, obtaining comparable results. As cellular migration is a key event in neointima invasion, we investigated 4MU effects on both cell migration and gelatinolytic activity. MMP2 is a MMP involved in matrix remodeling, playing a key role in AoSMC migration: 4MU does not affect MMP2 activity in AoSMC, moreover it determined a strong inhibition of cellular migration. As the addition of exogenous HA restored the migratory potential of this cells, we demonstrated, by means of a blocking antibody, the pivotal role of CD44 in this process. To investigate which cellular pathways were altered by 4MU treatment we performed a whole genome expression study using microarrays from Celera-Applied Biosystems and we found that 4MU treatment induced an alteration of p53 and cell cycle pathways. Moreover we found that 4MU treatment induced a reduction of cell proliferation and an increase of cell mortality by apoptosis, as shown by annexin-V staining, FACS analysis and PARP western blot. In order to verify the role of 4MU in the apoptotic process we performed rescue experiments by adding exogenous HMW-HA during treatment. Interestingly we found that 4MU induced apoptosis can be rescued by addition of exogenous HMW-HA to cell culture. Growing evidence of HA involvement in various human pathologies raises the question how to modulate its synthesis in tissues: these data introduce the possibility to reach this objective using a molecule already available in human therapy like 4MU
Transport phenomena n chaotic dynamical systems: classical ratchets and intermittent dynamics.
Dynamical systems exhibit an extremely rich variety of behaviors with regards to transport properties. A full understanding of how dynamics precisely determines the nature of transport is still not fully accomplished and there is a wide set of systems for which such properties are quite subtle.
The subject of the first part of this Thesis is the ratchet effect, namely the generation of transport with a preferred direction in systems without a net driving force or even against a small applied bias. This property has recently attracted much attention but, while stochastic ratchets are rather well understood, purely deterministic ratchets are much more tricky.
The system I have worked on is a family of low dimensional Hamiltonian maps, defined on a cylindrical phase space.
The second part of the Thesis is about weakly chaotic systems and their dynamical properties. The phase space of typical area-preserving maps reveals the co-existence of chaotic trajectories and islands of regular motion.
Even if the interest focuses on statistical properties of motion on the chaotic component, the influence of regular structures cannot be neglected because trajectories that approach them can be trapped for very long time, before being reinjected into the chaotic sea. The chaotic dynamics is thus interspersed by laminar segments where the system behaves as an integrable one. This behavior is called intermittency and it strongly influences the long-time properties of quantities like correlations decay or recurrence time statistics, which typically present a power-law tail, instead of the asymptotic exponential decay of fully hyperbolic systems. In unbounded systems intermittency affects also transport moments, generating anomalous diffusion processes, in contrast to the normal diffusion observed for fully hyperbolic systems.
My work on intermittency is about a two-dimensional map whose transport moments display an anomalous behavior.
The investigations of both parts of the Thesis is carried on through theoretical analysis and numerical simulations
La responsabilita’ della pubblica amministrazione derivante da inerzia.
Attraverso questo studio vorrei porre in evidenza le evoluzioni che dottrina e giurisprudenza hanno avuto in questi ultimi anni in materia di risarcimento del danno per lesione degli interessi legittimi, prestando una particolare attenzione alla ricostruzione del regime della responsabilità della pubblica amministrazione derivante da inerzia.
La responsabilità extracontrattuale dei privati per comportamenti omissivi è eccezionale e deriva dall’esistenza di un obbligo legale di agire.
La responsabilità per ritardo/inerzia è configurabile in materia contrattuale, ovvero nei casi in cui il privato, volontariamente, assume un obbligo il cui adempimento è sottoposto ad un termine e, ove non lo dovesse rispettare, è ritenuto responsabile. In tale fattispecie saremmo al di fuori dell’area della responsabilità aquiliana. Le cose appaiono diverse quando si ha a che fare con la pubblica amministrazione.
Difatti, la p.a., in qualità di garante della tutela degli interessi pubblici, è tenuta ad offrire una serie di servizi in ambito sociale, economico, ambientale, urbanistico, etc. ed in tali casi la mancata risposta e/o l’adempimento tardivo nell’emanazione di un provvedimento potrebbero determinare danni ed inefficienze rilevanti. All’autorità amministrativa sono, tuttavia, affidate funzioni di vigilanza dirette a prevenire comportamenti potenzialmente pregiudizievoli, tesi ad evitare danni alla collettività. Infine, innumerevoli attività private sono sottoposte, come noto, al vaglio preventivo della pubblica amministrazione e l’Autorità preposta, omettendo o ritardando il rilascio del provvedimento autorizzatorio richiesto, può determinare un pregiudizio rilevante.
L’inerzia o il ritardo della p.a. possono danneggiare il potenziale destinatario (il privato/cittadino) degli effetti diretti dell’emanando provvedimento amministrativo e, come si vedrà, nel nostro ordinamento, in relazione a queste ipotesi, si è fatto ricorso sempre più spesso ad alcune forme di semplificazione e all’istituto del silenzio.
L’affermazione dell’obbligo/dovere della pubblica amministrazione di concludere il procedimento con l’adozione di un provvedimento espresso e, correlativamente, di fissare i termini del procedimento, secondo la disciplina prevista dall’art. 2 L. 7 agosto 1990, n. 241, ha reso astrattamente configurabile la responsabilità della p.a. nei casi in cui l’amministrazione non provveda o adempia tardivamente.
Del tema della responsabilità si è occupata anche l’analisi economica, la quale ha ritenuto che obiettivo necessario sia la considerevole riduzione della somma dei costi del danno e dei costi della sua prevenzione o, più analiticamente, l’abbattere i costi primari, secondari e terziari dei fatti lesivi1.
Escluso che l’imposizione dell’obbligo di concludere in modo formale il procedimento si trasformi infallibilmente in tempestivi atti formali, la L. 7 agosto 1990 n. 241 e le sue successive modificazioni, nonché le più recenti interpretazioni giurisprudenziali, non hanno mancato, comunque, di aumentare le potenzialità del peculiare istituto del silenzio e della sua concreta applicazione per conoscere la fondatezza dell’istanza.
La L. 11 gennaio 2005 n. 15, modificando le disposizioni sul procedimento amministrativo, ha dato, come dianzi anticipato, una ulteriore accelerazione al procedimento di semplificazione.
Infatti, le modifiche legislative interessano, tra l’altro, proprio le disposizioni della L. n. 241 del 1990, che riguardano la conclusione del procedimento (art. 2), la dichiarazione di inizio attività (art. 19) e la disciplina del silenzio assenso (art. 20), nell’identica ratio di semplificare l’azione amministrativa attraverso il progressivo ricorso a regimi giuridici di riduzione degli interventi pubblici di assenso all’iniziativa economica privata.
In tale ambito, l’analisi svolta avrà specifico riguardo ai nuovi principi dettati con riferimento alla conclusione del procedimento ed alle correlazioni che tale nuova disciplina assume in rapporto alla connessa riforma dell’istituto del silenzio assenso.
L’obbligo di rispondere all’istanza dei privati trova il suo fondamento, come detto, nella disposizione di cui all’art. 2 della L. 241/90, ma tale obbligo viene correttamente fatto discendere, in taluni casi, anche dal più generale principio del dovere di buona amministrazione di cui all’art. 97 della Costituzione, norma dalla quale traggono origine sia il potere-dovere della p.a. di curare in modo ottimale i pubblici interessi comparandoli con gli interessi privati, sia la posizione giuridica soggettiva dell’amministrato che vanta “una legittima e qualificata aspettativa ad un’esplicita pronuncia”.
“Buona amministrazione”, quindi, è anche il non lasciare senza riscontro una richiesta di privati sebbene non sussista uno “specifico” obbligo di provvedere, ma sussista solo il generico obbligo di operare con correttezza e per il miglior perseguimento della “giustizia sostanziale” come del fine per il quale il potere è stato attribuito. Le predette modifiche legislative, unitamente alle recenti sentenze in materia di responsabilità della p.a., come si vedrà, hanno profondamente trasformato il ruolo della pubblica amministrazione inerte, tanto da assoggettarla al risarcimento del danno derivante da inerzia
