Reforming of the Judicial System of Kosovo based on the Law no. 03/L-199 on Courts and its challenges
Law no. 03/L-199 on Courts1 represents a law of significant importance which regulates the organisation, functioning and jurisdiction of courts of the Republic of Kosovo. This law has made numerous reforms in the judicial system of the country. It has set the bases of a modern and sustainable judicial system. In fact the Law on Courts in addition to having changed the judiciary of Kosovo in the aspect of organisation, it has opened the paths in the aspect of ensuring an efficient functioning thereof. Moreover, this law has repealed the application of the Law of former SAP of Kosovo on Regular Courts which in some aspects did not correspond to the trends of contemporary developments in this field. Law on Courts in its solutions embeds the bases of an independent and impartial justice, further on being multiethnic, non-discriminatory, efficient and in principle having an advanced approach of the opportunity for the public opinion to follow the judicial activities. Consequently, within this work, the background of the development of judicial system in Kosovo shall be discussed, some aspects of its reforming and challenges currently the judicial system of the country faces.In the course of preparation of this work, legal-historical method has been applied, the dogmatic method too, method of comparison and the method of analysis and synthesis. Through the legal-historical method, the manner of organisation and activity of the judicial system in Kosovo has been reflected covering the time of Turkish rule up to 2013 basing it on the laws and the Albanian customary law.The dogmatic method has helped on reflecting the manner of organisation and activity of the judicial system in Kosovo, viewing it in the context of regulating these matters through the Law on Courts presently applicable.The comparative method has reflected the features of the new judicial system in Kosovo and a comparison has been undertaken to the characteristics of earlier judicial system. The method of analysis and synthesis has been applied to elaborate in detail specific articles of the Law on Courts, they were commented and in some cases concrete proposals have been given for solution, considered as advanced
The History of Development of Land Registration and Ownership Rights in Kosovo, Legal Challenges During the Years 1912-2014
Knowing that the registration of ownership rights is very important institute for legal and economic system of Kosovo, for its constitutive effect in gaining of ownership rights, protection of property rights of the owner and which enables effective management of the land, in order to understand its development, is necessary to turn back to history.Regarding to this, Kosovo is not known for an early origin and consolidated system of land registration until Twentieth Century; even afterwards, its development was influenced by many socio-economic and political factors.The review of the historical development of land records deserves a detailed study in Kosovo due to its complexity through the years, so in order to understand more accurately the footsteps of regimes, it is necessary to examine periods until 1912, 1912-1999 and 1999 till now days, because the elaboration of normative acts that arranged registration over the years, enable the readers to create a clear overview related to advances and characteristics of each stage of its development,therefore the differences and similiarities can be noticed clearly through descriptive and comparison method.Especially postwar period is characterized by major advances and essential changes as: Approval of Constitution and abrogation of old system. These changes contained fairly challenges, but important is that the situation normalized and is moving towards positive trends of legislative development.Actually, in Kosovo, property rights are receiving deserved attention, but it is somewhat worrying the emphasizing lack of the review of the registration, reason that encouraged me to elaborate this topic in order to gain more knowledge about the institute of registration system and complexities that accompanies it
The Development of Human Resources and Labor Market
This paper aims to give an overview of the need of knowledge management in the organization, as well as understanding the preconditions and obstacles for the openness of economic and education system in Kosovo with systems in the region as a factor in human resource development. Kosovo has some demographical features that have major influence in the overall development. Due to dominance of young population, the demand for education is high in comparison with the absorption capacity of the economy. Also, the requirements of businesses and institutions are ongoing for the applied knowledge, achievement of which requires continuous increase of mobility of the students as well as teachers. Hence, this paper highlights the importance of completion in the education as a way for convergence and sustainable economic development
Correlation between Government and Economic Growth –Fiscal Policy during the Transition in Albania
In this paper we tried to analyze some aspects of fiscal policy in our country, without pretending to give our own sample. Fiscal policy is the use of government expenditures and taxes which affect economic activity. Determination of fiscal policy in a given year takes into account the time virtually the past (current socio-economic status) and the implications for the future (fiscal sustainability).In general the cases dealt the role fiscal policy plays toward economic growth. The analysis many focused both in the theoretical treatment as well as the role that fiscal policy has played in our country, going even further in some suggestions for the future. The most important issue was addressed in the long-term fiscal policy view, fiscal sustainability. In the final everything is addressed to the role of fiscal policy on social issues.The role that fiscal policy should play in economic and social development has long been a controversial issue and is still different among economists. While a restrictive fiscal policy means increasing taxes and cut government spending. Fiscal policy may be expansionary or restrictive. An expansionary fiscal policy means a reduction of direct and indirect taxes and increased government expenditures. Choose between two types of fiscal policy is not an easy decision, both in terms of the current state of the economy, as well as political decisions
SUBTLEX- AL: Albanian word frequencies based on film subtitles
Recently several studies have shown that word frequency estimation based on subtitle files explains better the variance in word recognition performance than traditional words frequency estimates did. The present study aims to show this frequency estimate in Albanian from more than 2M words coming from film subtitles. Our results show high correlation between the RT from a LD study (120 stimuli) and the SUBTLEX- AL, as well as, high correlation between this and the unique existing frequency list of a hundred more frequent Albanian words. These findings suggest that SUBTLEX-AL it is good frequency estimation, furthermore, this is the first database of frequency estimation in Albanian larger than 100 words
Kosovar Public Diplomacy
We are being witnesses that the XXI century is characterized by the rise and rapid advancement of public diplomacy, particularly in small countries that are under development, or countries that do not have classical influence through diplomacy and military influence, therefore into the category of states in which the development of public diplomacy is needed, we have included the Republic of Kosovo.The Republic of Kosovo as a new state, with without diplomatic experience and that has started from scratch, should necessarily develop the public diplomacy, because it is listed in the category of countries that we have specified above.But how should the Republic of Kosovo develop a public diplomacy?For building the basement of public diplomacy, the main tool that Kosovo should develop is communicationThrough the communication are held discussions, negotiations, becomes the announcement about the steps of development of the state, becomes lobbying, rises the positive image, and all these lead to the recognition of the new state and to the multilateral and bilateral cooperation agreements.In order to explain the performance and the form of the use of communication in public diplomacy, which the Republic of Kosovo has begun to use and implement in practice, and which already has brought tangible results that need improvement, we think that still has remained very long road with many political, economic, diplomatic and democratic challenges until we achieve a satisfactory level.A deeper analysis of what has been done so far, and what needs to be done in the future is required, therefore the whole problem along with the possible functional solutions is explained more specifically with theories and examples below
Theoretical concepts about "Intelligence" - practices and standards in democratic societies
My thesis consists of theoretical analysis on the need for recognition of academic concepts to shape and design research field intelligence community activity, careful analysis of the terms and concepts that are strongly linked to intelligence work methodology, theoretical aspects description given practice best to regulate this specific area in our academic studies, has made the study to take proper shape with bold shades of comparative empirical analysis.My study aims to summarize, to analyze existing approaches and break the "taboo theories," floats mysteriously present new knowledge, summed up in this multidisciplinary field study, now theories only considering the nature of scientific thought for recognition theoretical concepts and legal regulation best practice intelligence services in democratic societies.emocratic societies. Marketing mix strategies of bread producers in Kosovo
Marketing is a fundamental or core function of the business which more than any other business function deals with customers and their satisfaction. Creation and implementation of a successful marketing strategy in business is very crucial, especially when we deal with a business such is bread manufacturing. Thus, the purpose of the research was to analyze the development of marketing as an organizational function of bread manufacturers companies in Kosovo, to analyze their marketing strategies and to provide clear recommendations for companies that do not use marketing strategies.During the research I have find that bread producers do not even have established a marketing department and/or do not have employed a marketing or sales person. Only few companies, three out of fifteen, intend to establish marketing department in the future, which is a sign that bread producers still do not see marketing as core function in their activities. They do think more on production than on sales and marketing. None of the companies have promotional activities regularly and only two of them exhibits regularly on the trade fairs in Kosovo and only one company exhibited abroad.There should be continuous insistence of manufacturing companies to advance marketing department, creating a special unit of market research and behavior with consumer.The data for research were collected through questionnaire in fifteen bread manufacturing companies. Methods used for research have been descriptive, comparative, analysis, and synthesis. The research instrument was a questionnaire, the technique has been direct communication and research was conducted between months June up to September 2009
Study of Organochlorinated Pesticide Residues and PCBs in Vegetable and Fruit Samples from market in Peja –Kosovo
Organoclorine pesticides (OCP) are the first class of compounds of synthetic pesticides introduced in agricultural and civil uses to counteract noxious insects and insect-born disease. In general they are lipophilic compounds with noticeable chemical and environmental stability. They tend to concentrate in the higher trophic organisms, as they amplify through the food chain. Food is generally recognized as the main source of human intake of pesticides, their metabolites and their residues. Preparation of samples, especially in food samples for quantitative analysis of organochlorined pesticides has an important role in recognizing the real levels. For the analysis of these micro-trace compounds in food samples is a constant search for new analytical methods. The most important steps of their chemical analysis usually are the extraction, purification, fractionation and concentration.In this study, were analyzed samples of fruit and vegetables from the market of Peja, Kosovo in September 2011. Ultrasonic extraction was used for extracting pesticide residues from samples. Clean-up procedure was performed using firstly sulfuric acid followed a second clean-up procedure in an “open” florisil column. The organochlorine pesticides detected were HCHs (a-, b-, γ- and d-isomers) and the DDT-related chemicals (o,p-DDE, p,p-DDE, p,p-DDD, p,p-DDT), hexachlorobenzene (HCB), heptachlor, heptachlor epoxide, methoxychlor and Aldrine’s. Analyses were done with capillary column Rtx-5, 60m long, 0.32mm internal diameter, 0.25 μm film thicknesses on a gas chromatograph Dani 1000, with μECD detector. The found concentrations of the chlorinated pesticides were lower than accepted levels for studied sample
Impact of Globalization in Kosovo’s Economy
The economy in Kosovo continues to generate macroeconomic growth and solid stability, especially in fiscal and financial terms. Despite the increasing risks from the external sector, Kosovo’s economy has marked positive growth rates in 2012 also. Nevertheless, being an open economy, it has not been spared of the effects of the crisis faced direly by some of the most developed countries, and especially those in the Eurozone, which have shrinked the growth rate in comparison to previous years, despite it being positive.These risks mainly are reflected into the adverse impacts of the crisis on external demand for Kosovo products (along with an already low export rate), and by a lighter impact on migrant remittances, and a stronger impact on foreign direct investment. The decline in remittances has been smaller than forecasted, mainly because migration in Kosovo is of longer term in nature, and 70% of our migrants possess foreign citizenships. The banking sector has remained solid, with private sector deposits and loans continuing to increase in 2009 and 2010. There is still evidence though, that banks have become more prudent in extending loans, mainly due to the fact that bad loans are increasing at a slow pace. Adverse impacts of the global financial crisis have been compensated by an expansionist fiscal policy adopted by the Government, thereby ensuring medium growth rates
