Full text linkThe ongoing debate over the different concept between secular state and fundamentalist state is still visible from the grass-root to the elite actors either as a discourse or as practical politics. In fact these problems commonly escalate into more violence conflict which is driven by former colonial power. An attempt to prevent the difference between the two is by proposing the concept of ideal state known as Civil Society, though these concepts it tries to synergize between state and religion. Theoretical as well as historical analysis is made to support the hypothesis. Although still on process, but at least this will be the temporary attempt to keep the stability within the society.

Full text linkGender equality-based education is education that accommodate gender differences. This study aims to reveal the gender sensitivity in social and educational as well as identify government policies in building gender equality and its applications in formal education.This study is qualitative with an inventory of government policies in building gender equality, and then analyze it with the reality of education in Indonesia. The approach used in this study is referring to the normative approach to the study of government policies in enforcing gender equality and its applications in formal education. The research data was collected using the techniques of literary study (library research). Materials that have been acquired and processed is described and analyzed by using descriptive interpretative paradigm and gender analysis. Although many efforts have been taken by the government for the realization of gender equality, but in the education sector still show gender inequality. The indication can be seen from three aspects, they are not unequal participation in education for women, unequal educational material as well as the selection of majors unequal proportions of men and women. The phenomenon is not yet reflect the totality of gender equality education
ASPEK YURIDIS “AGREEMEENT TO MEDIATE” DALAM PENYELESAIAN SENGKETA PERBANKAN MELALUI MEDIASI
Full text linkAgreement to mediate is an agreement between the customer and the Bank in a banking mediation. Mediation is a process of settlement of dispute involving a mediator to assist the parties in dispute to achieve a settlement in the form of voluntary agreement to some or all of the problems disputed. According to Bank Indonesia Regulation No. 8/5/PBI/2006 as changed by PBI No. 10/1/PBI/2008 about Banking Mediation and SE BI No. 8/14/DPNP, June 1, 2006 about Banking Mediation, settlement can be done through banking mediation if the dispute between the customer and the Bank is caused by the non-fulfillment of the customer's financial claims by the Bank in settlement of the customer's complaint. The function of the banking mediation performed by Bank Indonesia is limited to the effort to assist the customer and the Bank to review the dispute basically in the framework of obtaining an agreement between the customer and the Bank. Bank Indonesia does not make a decision and or recommendation for the settlement of the dispute between the customer and the Bank

Aksi terorisme dan kekerasan atas nama agama hingga hari ini masih menyita perhatian kita. Belum genap sebulan, kita masih disuguhi berita pengeboman di dua kota, Depok dan Solo. Upaya pencegahan oleh pemerintah seringkali kecolongan. Pengintaian di sana-sini, tetapi secara tiba-tiba bunyi ledakan itu terdengar dan tim gegana pun baru tiba. Lalu para tokoh agama sibuk mengutuk dan menyesalkan aksi kekerasan tersebut.
Sejak ramainya aksi terorisme yang menunjuk salah satu agama, dalam hal ini Islam, sudah banyak dilakukan penelitian untuk meneliti akar dan motif aksi-aksi tersebut dengan berbagai pendekatan, termasuk agama. Dalam penelitian dengan pendekatan agama, model aksi itu kemudian diamati dan dikaji melalui pendekatan pemahaman keagamaan, seperti gagasan-gagasannya. Bahkan pernah muncul prejudice yang cukup berlebihan terhadap lembaga keagamaan pesantren dan buku-buku ajar pendidikan agama Islam. Keduanya diindikasikan memiliki peranan penting dalam menginspirasi pelaku agar berani melakukan tindakan kekerasan dengan mengatasnamakan agama. Barangkali penelitian semacam itu tidak sepenuhnya salah. Hanya saja, kemudian muncul pertanyaan yang cukup mengganjal. Mengapa dengan buku ajar yang sama terdapat pelajar-pelajar muslim –baca:santri- yang tidak kepincut untuk melakukan tindak kekerasan serupa

Full text linkLinguistic concept is a part of theory or the way to interpret Qur'an but it is still fuzzy. So, position the linguistic interpretation in this study is very important. In this case, attempting of systematize theories are used in the interpretation of the linguistic to position in the place that is found the exact meaning. From the result of the study is found that the linguistic position is in the realm of Qur'an interpretation can be seen from two aspects, namely language is as the language of the methodological and as theological argument. The first meaning it is presupposes that the language is usually manifest in the rules and theories. And the second, language is manifest a code of values that is fought by al- Qur’an. Oleh karena itu Tuhan memberi manusia pilihan-pilihan dan kebebasan untuk menentukannya, dan mencintai sesama makhluk Tuhan berarti meyakini akan kemampuan untuk menentukan pilihan sendiri. Jika ini dipahami oleh kaum muslim maka tidak akan lagi muncul praktek Islamo-tribalis dalam tubuh Islam (hlm. vii). Irshad memaparkan Ada perbedaan antara iman dan dogma. Iman tidak melarang eksplorasi, dogma yang melarang. Secara intrinsik, dogma terancam oleh pertanyaanpertanyaan, sementara iman menerima pertanyaanpertanyaan karena iman meyakini bahwa Tuhan yang Maha Pengasih, bisa menghadapi semua itu. Itulah Tuhan yang rahmatNya bisa dirasakan oleh individuindividu yang penuh rasa ingin tahu di manapun juga. Dogma yang berasal dari budaya, bahkan ketika berposisi sebagai agama yang sakral, tidak pantas memiliki hak. Budaya bukanlah makhluk suci dengan kehendak bebas dan nurani; individulah yang demikian. Budaya tidak bicara untuk dirinya sendiri; manusialah yang bicara untuknya. Memberikan hak pada sesuatu yang bisa langgeng hanya melalui penilaian, persepsi, dan tindakan manusia sungguh berbahaya sekali karena memperkuat kekuasaan yang sudah kuat
 
SENGKETA WAKAF DAN PENYELESAIANNYA DALAM PERSPEKTIF UNDANG-UNDANG WAKAF NO 41 TAHUN 2004
Full text linkReligious Endowments (waqf) that have been developed in several countries and Indonesia have important role for the social welfare of the people. However, as the endowment is a part of the people asset management, it always brings complexity and problematic atmospheres in its management. One problem arises is the waqf dispute, which usually starts from the traditional unproductive management resulting in being sold by the unresponsible individuals. This paper attempts to elaborate and trace out the disputes in term of the responsibilities of each body involved in the endowments process. Based on the research that emphesaizes on the legal-formal norm approach, it is already mentioned that the Waqf Act No. 41of 2004 has provided complete and comprehensive provisions governing the issues of the endowment and its arising disputes. The dispute may arise from the waqf provider, the Nazir (the officer of the Endowments Pledge Deed), Waqf Board of Indonesia or the Shariah Board of Finance. This endowment disputes ranging (19%) were brought before the Religious Affairs Court as compared to Shariah economic matters (12), inheritance (1373), testament (25), grants (46), or zakat or infaq shodaqah (25)

Full text linkAs the cornerstone of conventional financial system, Time Value of Money (TVM) is quite differ from the Islamic financial system, because the existing element of Riba. On this basis, it is necessary for the Muslim economist to rectify those concepts by proposing the concept of Economic Value System (EVT) that is how someone utilizes the time. The increase of money value is determined by the economic activity and not by the course of time. Therefore, the economic actors should utilize the time and optimize the economic activities as to obtain the value added requirements. The economic value added in Islamic financial system is the result of return, ratio, velocity and capital.
