DECISION ON THE SITUATION IN PALESTINE AND THE MIDDLE EAST 
DOC. EX.CL/397(XII) 
 
 
The Executive Council: 
 
1. TAKES NOTE of the Report on the Situation in Palestine and the Middle 
East; 
 
2. RECALLS all Resolutions and Decisions adopted by the OAU/AU on the 
situation in Palestine and the Middle East; 
 
3. REITERATES its full solidarity with the Palestinian people in their 
legitimate struggle, under the leadership of the Palestinian Liberation 
Organization (PLO), their sole and legitimate representative, and 
EXPRESSES ITS SUPPORT to the PLO’s continuous struggle for the 
exercise by the Palestinian people of their inalienable national rights, 
including their right to self-determination, return to their land, recovery of 
their property and to live in peace and dignity in an independent Palestinian 
State with Al-Quds as its capital, in accordance with the principle of 
international law and all the pertinent UN resolutions, particularly 
Resolution 149, and the relevant resolutions and decisions of the OAU/ 
AU; 
 
4. REAFFIRMS ITS SUPPORT for the peaceful solution to the Israeli-Arab 
conflict in general, and the Israeli-Palestinian conflict in particular, in 
accordance with the principles of international law, all pertinent resolutions 
of the UN Security Council and General Assembly, the Arab Peace 
Initiative, the Quartet Committee’s Road Map and pertinent resolutions of 
the OAU/AU, aimed at ending the Israeli occupation of the Arab and 
Palestinian territories that began on 5 June 1967, with the achievement of 
the vision of the International Community of establishing two States, Israel 
and an independent, sovereign and territorially contiguous Palestine, living 
side by side in peace and security; 
 
5. EXPRESSES ITS SUPPORT for the efforts aimed at achieving 
reconciliation among all Palestinian people, as a step towards the 
establishment of a viable Palestinian State with Jerusalem as its Capital; 
 
6. URGES the Government of Israel to stop all unilateral measures, 
particularly Olmert’s Consolidation Plan (E1) aimed and designed to create 
new unilateral facts on the ground, such as the Israeli decision to build 307 
new units inside the Jabal Abu Ghneim settlement (Har Huma); CALLS 
UPON the Israeli Government to immediately stop all its settlement 
activities which brutally violate international law, undermine the peace 
process as a whole, and pose a serious threat to the establishment of an 
independent, viable and contiguous Palestinian state; and ALSO CALLS 
UPON the International Community to bring pressure to bear on Israel to 
cease all its settlement activities in the Occupied Palestinian Territories;

7. EXPRESSES DEEP CONCERN regarding the worsening humanitarian 
situation and the increasing sanitary and economic deterioration in the 
Occupied Palestinian Territories, particularly in the Gaza Strip, due to the 
constant Israeli attacks and ongoing bloody invasions, restrictions of 
movement of persons and constant closures and blockades of the 
Palestinian commercial crossing points with neighbouring countries, which 
have increased the unemployment rate and poverty levels in Palestinian 
society, and therefore negatively affected security and stability in the 
region;  
 
8. STRONGLY CONDEMNS the Israeli occupying authority and denounces 
its use of collective punishment, repressive practices and policies 
perpetrated against defenceless Palestinians, especially the daily 
invasions, assassinations and atrocious assaults committed by the Israeli 
forces against innocent civilians in the Gaza Strip, the West Bank and East 
Al-Quds; and URGES the Israeli Government to immediately put an end to 
these activities which are in violation of International Law and the Fourth 
Geneva Convention of 1949; 
 
9. STRONGLY CONDEMNS the recent Israeli occupying forces’ large scale 
attack against civilian areas in Gaza city, targeting Al-Zaitun and Al-
Shujaiya neighbourhoods of the City, which claimed many victims among 
the civilian populations; 
 
10. URGES the Israeli Government to stop the construction and expansion of 
the Separation Wall in the Occupied Palestinian Territories, around and 
inside Al-Quds town, especially the changes and measures that have been 
implemented in Al-Quds, aimed at altering the status of the occupied Al-
Quds; and URGES Israel to comply with the advisory opinion of the 
International Court of Justice and General Assembly Decision ES-10/15; 
 
11. EXPRESSES DEEP CONCERN regarding the blockade imposed on Gaza, 
whose effects on socio-economic life and the populations are particularly 
harmful and URGES the Israeli authorities to immediately lift the blockage;  
 
12. CALLS UPON the International Community to take all necessary 
measures to contribute to the efforts aimed at alleviating the humanitarian 
suffering endured by the Palestinians in the occupied Gaza Strip;  
 
13. EXPRESSES GRAVE CONCERN regarding the deterioration of the living 
and health conditions of Palestinian prisoners in Israeli jails; and CALLS 
UPON the International Community to work towards the release of 
Palestinian prisoners and detainees, especially women, children, Palestine 
Legislative Council members and other detainees who are being held in 
Israeli jails without any charge or sentence;

14. APPEALS to the Palestinian Legitimate Leadership and all other faction 
leaders to work towards resolving their differences and close ranks through 
dialogue with a view to building a united front to lead all Palestinian people 
to achieve their Legitimate National Goals in conformity with the Nation’s 
right to self determination as enshrined in the United Nations Charter, in 
order to establish their own independent and fully sovereign State of 
Palestine, with Al-Quds as its capital; 
 
15. FURTHER CALLS UPON the Government of Israel to put an end to its 
occupation of all Arab land occupied since 1967, including the Syrian and 
Lebanese territories, and to abide by the relevant UN Security Council 
Resolutions, 242 (1967), 338 (1973), 446 (1979), 1322 (2000), 1397 
(2002), 1402 (2002), 1403 (2002), 1435 (2002), 1515 (2003) and 1544 
(2004), the Madrid Declaration, the Land for Peace Principle, the Arab 
Peace initiative and the Road Map, in order to reach a just, 
comprehensive, lasting and peaceful solution to the Arab-Israeli Conflict; 
 
16. TAKES NOTE of the efforts deployed by the Committee of Ten (10) 
Member States on Palestine established by Decision AHG/Dec. 182 
(XXXVIII), in July 2002, and URGES continued efforts in the quest for a 
just, comprehensive, lasting and peaceful solution to the conflict in 
Palestine and the Middle East; 
 
17. EXPRESSES ITS CONCERN over the developments in Lebanon and 
CALLS UPON the Lebanese political players to establish conditions 
conducive to the holding of presidential elections and to put an end to 
political assassinations.

DECISION ON DARFUR 
 
The Assembly:  
 
 
1. REITERATES its serious concern over the prevailing situation in the 
Darfur Region of The Sudan, particularly the Humanitarian crisis and the 
continued reports of violations of human rights, including attacks against 
civilians committed by the Janjaweed militia and other non regular armed 
groups, and reiterates the need  to bring to justice all those responsible 
for human rights violations in Darfur; 
 
2. NOTES THAT, even though the humanitarian situation in Darfur is 
serious, it can not be defined as a genocide. The Assembly further notes 
that the crisis should be addressed with utmost urgency to avoid further 
escalation; 
 
3. WELCOMES the measures taken by the GOS to protect the civilian 
populations, facilitate the work of the humanitarian agencies and NGOs 
and provide them with unrestricted access to the affected populations. 
The Assembly welcomes the commitment by the GOS to disarm and 
neutralize the janjaweed militia and other armed groups and urges the 
GOS to follow through these commitments; 
 
4. STRESSES that the African Union should continue to lead these efforts 
to address the crisis in Darfur and that the International Community 
should continue to support this efforts; 
 
5. COMMENDS President Deby of Chad for his mediation efforts, 
undertaken with the support of the AU Commission and other partners. 
The Assembly calls on all concerned to vigorously pursue their efforts; 
 
6. WELCOMES the establishment of the cease-fire commission in El Fashir 
as of 9 June 2004 and the partial deployment of the AU military 
observers in the Darfur Region and urges the Commission to expedite the 
process, including the deployment of the protection force.  
 
7. DECIDES to increase the number of AU Observers to a minimum of 80 
and decides that the protection force should be deployed immediately. In 
this regard, the Assembly welcomes the willingness of the GOS to 
cooperate with the AU Protection Force and its commitment to provide 
overall protection to the Mission. The Assembly urges the Member States 
concerned to contribute Observers and troops for the AU Mission as a 
matter of urgency; 
 
8. AGREES that the rebel forces should be cantoned at mutually agreed 
sites and that the militia and all other outlaw groups should be disarmed 
by the GOS, and that these two operations shall be carried out 
simultaneously and monitored by the AU Mission;

9. UNDERLINES the centrality of a political solution and agrees that the 
political dialogue should resume on the scheduled date of 15 July 2004, 
at the AU Headquarters in Addis Ababa, with the view to reaching a 
political agreement. Such an Agreement would create conditions for the 
convening of the all party conference provided for in the N’Djamena 
Humanitarian Cease-Fire Agreement. The Assembly urges all parties to 
the meeting to participate at the highest level, to ensure that decision will 
be reached. In this respect, the Assembly urges the Commission with the 
assistance of Member States and other partners, to ensure that the rebel 
movements participate in the meeting at the highest level, to avoid delays; 
 
10. URGES the parties to strictly respect the provisions of the Cease-fire 
agreement and create conditions for the speedy and urgent return of 
refugees and IDPs. The Assembly urgently appeals to the International 
Community and Member States to extend full support to this process by 
providing the much needed humanitarian assistance; 
 
11. ACKNOWLEDGES the Agreement signed between the Government of The 
Sudan and the United Nations which is consistent with the AU Peace 
efforts; 
 
12. REQUESTS the Chairperson of the Commission to follow this matter as a 
matter of a priority and report to the Peace and Security Council 
regularly.

The Executive Council: 
 
1. TAKES NOTE of the Consolidated Report of Consultations on the 
Implementation of the first Action Plan of the Africa-European Union (EU) 
Joint Strategy; 
 
2. ENDORSES the recommendations made by Member States and civil 
society on the way forward regarding the implementation of the Action 
Plan; 
 
3. UNDERSCORES the critical coordinating role of the chefs de file and the 
need to comply with the format of the Troika meetings in accordance with 
the Joint Strategy and Plan of Action regarding the participation of 
members of the Troika at the Ministerial level and members of the enlarged 
Troika at Experts and Senior Officials level; 
 
4. CALLS UPON Member States to express interest in the eight partnerships 
of the first Action Plan, allocate the necessary human, material and 
financial resources and propose projects for the implementation, based on 
criteria to be agreed upon with the Commission and within the framework 
of the eight partnerships, of the  first Action Plan; 
 
5. URGES Member States, the Regional Economic Communities and other 
relevant stakeholders to take active part in the implementation of the first 
Action Plan under the coordination of the Commission;  
 
6. REQUESTS the Commission to ensure the effective involvement of the 
Regional Economic Communities in the implementation and monitoring of 
the processes;  
 
7. FURTHER REQUESTS the Commission to negotiate implementation 
modalities with the European Union on the basis of the outcome of the 
consultations.

DECISION ON THE DRAFT AFRICAN UNION NON-AGGRESSION 
AND COMMON DEFENCE PACT 
 
 
The Assembly: 
 
1. EXPRESSES APPRECIATION to the President of Ghana in his capacity 
as Chairperson and other members of the Committee of Heads of State 
and Government, established by the Third Ordinary Session of the 
Assembly, to consider the issues of Non-Aggression, Common Defence 
and Common Security; 
 
2. UNDERSCORES the importance of the Pact as an instrument to reinforce 
cooperation among Member States in the areas of defence and security, 
and particularly, to strengthen the Mechanism for Conflict Prevention, 
Management and Resolution; 
 
3. DECIDES to adopt the Draft African Union Non-Aggression and Common 
Defence Pact as amended by the Assembly; 
 
4. CALLS UPON Member States to sign, ratify or accede to the Pact, as soon

DECISION ON THE SEATS OF THE AFRICAN UNION 
 
 
The Assembly: 
 
 
1. TAKES NOTE of the proposal submitted by the Great Socialist Libyan 
Arab Jamahiriya; 
 
2. DECIDES that the AU Commission is an integral part of the 
Headquarters of the Union as stipulated in Article 24 of the Constitutive 
Act; 
 
3. DECIDES that the Organs of the Union should be located in different 
regions of Africa on the basis of the principle of geographical distribution; 
 
4. FURTHER DECIDES that the African Court on Human and Peoples’ 
Rights and the Court of Justice should be integrated into one Court; 
 
5. REQUESTS the Chairperson to work out the modalities on implementing 
Paragraph 4 above and submit a report to our next Ordinary Session.

RESOLUTION ON THE AFRICAN COMMISSION
ON HUMAN AND PEOPLES’ RIGHTS
The Assembly of Heads of State and Government of the Organization of African Unity,
meeting in its Thirty-First Ordinary Session in Addis Ababa, Ethiopia, from 26 to 28 June, 1995,
Considering the eight annual activities report of the African Commission on Human and
Peoples’ Rights,
Recalling that the African Charter on Human and Peoples’ Rights came into force on 21
October 1986, and that, currently 49 Member States of the OAU are parties to this Charter,
Considering the present state of implementation of the provisions of the said Charter,
characterized particularly by the fact that few Member States have submitted their periodic reports
on the legislative or other measures intended to implement these provisions;
Recalling that according to Article 1 of the African Charter on Human and Peoples’ Rights,
the States, parties and compelled to promote the rights, duties and freedoms provided for therein
and undertake to take the appropriate measures,
Considering the situation of human and peoples’ rights in Africa and the pressing need to
enhance respect for human and peoples’ rights in order to further ensure peace, stability and
development in Africa,
Recognizing the need to strengthen the African Commission on Human and Peoples’
Rights by providing it with the human and material resources required to accomplish its task:
1. TAKES NOTE WITH SATISFACTION of the eight annual activities report of
African Commission on Human and Peoples’ Rights and authorizes its publication
as well as the conclusions and recommendations relating to the information

2.  COMMENDS the African Commission for the tremendous work accomplished
during the period under review;
3. STRONGLY ENCOURAGES the activities of the African Commission of Human
and Peoples’ Rights, aimed at promoting and protecting the rights recognized and
guaranteed by the Charter;
4. REQUESTS the Commission to continue to respect the principle of confidentiality
of its reports pursuant to Article 59 of the Charter;
5. CALLS on States, parties to the Charter, to strengthen their cooperation with the
African Commission on Human and People’s Rights and to lend it increases
assistance in the accomplishment of its mission;
6. APPEALS to OAU Member States to ratify the Charter as soon as possible, if they
have not yet done so;
7. CALLS ON all State, parties to the Charter, to take practical steps to ensure and
effective implementation of its provisions, and APPEALS URGENTLY to all state
parties to the Charter to submit their periodic reports, pursuant to Article 62 of the
Charter, if they have not yet done so.
8.  CALLS ON the OAU Secretary-General to take all the necessary measures to
provide the African Commission on Human and Peoples’ Rights, with all the human
and material resources it needs to accomplish its mission, and to report on the
implementation of this provision to the Thirty-Third Ordinary Session.

SOUTHERN RHODESIA 
 
 The Assembly of Heads of State and government meeting in its Second Ordinary 
Session in Accra, Ghana, from 21 to 25 October 1965, 
 
 Deeply concerned at the gravity of the situation in Southern Rhodesia, 
 
 Considering that the situation constitutes a serious threat to world peace, 
 
Noting: 
 
a) The statement of the Government of the United Kingdom of Great Britain 
and Northern Ireland that it will regard any Unilateral Declaration of 
Independence by the European minority in Southern Rhodesia as illegal 
and amounting to an act  of rebellion and treason punishable solely by the 
imposition of economic sanctions and non-recognition, 
 
b) The recent United Nations resolution passed with an overwhelming 
majority calling on the United Kingdom Government to take all possible 
steps to prevent a Unilateral Declaration of Independence and pledging 
support for any future measures that the United Nations might decide 
upon in this matter, 
 
1. Deplores the refusal of the United Kingdom Government to meet with 
firmness and resolution the threat of a Unilateral Declaration of 
Independence by a European minority Government; 
 
2. Deplores the refusal of the United Kingdom Government to state 
categorically that it will not grant independence to Rhodesia except on the 
basis of a majority government; 
 
3. Calls upon the United Nations to regard any such Unilateral Declaration of 
Independence as constituting a threat to international peace, and to take any 
steps that such a situation requires in accordance with the Charter and to 
help to establish a majority government in southern Rhodesia; 
 
AHG/Res. 25 (II) 
4. Requests the United Kingdom Government, the administering power having 
sole responsibility for the present situation: 
 
a) To suspend the 1961 Constitution of Southern Rhodesia forthwith and to 
take all necessary steps including the use of armed force to resume the 
administration of the territory; 
 
b) To release the leader of the nationalist movements Joshua NKOMO, 
SITHOLE and other political prisoners; 
 
c) To hold a constitutional conference with the participation of the 
representatives of the entire population of Southern Rhodesia with a view 
to adopting a new Constitution guaranteeing universal adult suffrage (one 
man, one vote), free elections and independence; 
 
5. Calls upon all governments and all international Organizations to withhold 
recognition of a European minority government in the event of a unilateral 
declaration of independence, and to apply all necessary sanctions; 
 
6. Resolves in the event of failure on the part of the United Kingdom to take the 
measures set forth in operative paragraph 2 (a): 
 
a) To reconsider all political, economic, diplomatic and financial relations 
between African countries and the Untied Kingdom Government in the 
event of this Government’s granting or tolerating Southern Rhodesian 
independence under a minority government; 
 
b) To use all possible means including force to oppose a unilateral 
declaration of independence; 
 
c) To give immediate assistance to the people of Zimbabwe with a view to 
establishing a majority government in the country; 
 
7.  Empowers the African Group at the United Nations to ensure that the 
request sent to the United Nations and the Security Council receives due 
consideration.
