    The main aim of this article is to provide a detailed analysis of the concept of the right of the court of appeal to reverse the final judgment under appeal and to refer the case back to the court of first instance, and the grounds for exercising this right, as well as to determine the impact of this right on the behaviour of the participants in the proceedings, taking into account the doctrine of law, the jurisprudence of the courts of the Republic of Lithuania and the normative legal acts. Given that the aforementioned right of the court of appeal is closely related to the implementation of the principles of civil and criminal proceedings, the attitude of the subjects of the proceedings towards the judicial system and ensuring its efficiency, it is important to identify the limits of the application of this right and to assess the possible future developments.Šio straipsnio pagrindinis tikslas – remiantis teisės mokslo doktrina, Lietuvos Respublikos teismų praktika ir teisės norminiais aktais detaliai išanalizuoti apeliacinės instancijos teismo teisės panaikinti teismo baigiamąjį aktą ir perduoti bylą nagrinėti iš naujo pirmosios instancijos teismui sampratą ir pasinaudojimo šia teise pagrindus bei nustatyti šios teisės įtaką procesų subjektams ir jų elgesiui. Atsižvelgiant į tai, kad minėta apeliacinės instancijos teismo teisė glaudžiai susijusi su civilinio ir baudžiamojo procesų principų įgyvendinimu, procesų subjektų požiūriu į teismų sistemą ir jos efektyvumo užtikrinimu, nagrinėjamos temos kontekste svarbu nustatyti, kokios yra šios teisės taikymo ribos ir įvertinti galimas pokyčių perspektyvas

    Cross-Border Litigation in Environmental and Human Rights Cases in the EU: Legal Strategies for Victims

    This paper examines the legal barriers that impede individuals from pursuing environmental and human rights litigation in various European courts. The first section analyzes restrictions on access to justice, including systemic, legal, and political obstacles. Additionally, it explores challenges inherent to individual legal action, such as limited legal expertise and insufficient resources, and financial constraints. The second section examines the use of reprisal tactics by transnational corporations (TNCs) as a legal barrier to litigation. It highlights how reprisals can occur at various stages of the legal process, beginning with intimidation to discourage legal action and later manifesting in Strategic Lawsuits Against Public Participation (SLAPPs) or procedural delays designed to burden plaintiffs and compel them to withdraw their claims. The paper argues that significant deficiencies remain within the EU judicial system, which must be addressed to ensure access to justice and the protection of human rights for all citizens

    This article examines the impact of legislative regulation on startup activities and itsinfluence on their viability. The aim of the study is to identify the main legal regulatory  obstacles and provide recommendations on how to mitigate them. The analysis covers four key sectors: FinTech, IT and artificial intelligence, e-commerce, and biotechnology and pharmaceuticals, which most often face complex licensing procedures, strict compliance requirements, and an unclear regulatory environment. The study results reveal that excessive regulation can hinder innovation and reduce startups’ chances of survival. To create more favorable business conditions, it is essential to simplify licensing processes, ensure clearer legal regulations, and reduce administrative burdens.Šiame straipsnyje nagrinėjamas įstatyminio reglamentavimo poveikis startuolių veiklai ir jo įtaka jų gyvybingumui. Tyrimo tikslas – identifikuoti pagrindines teisinio reguliavimo kliūtis bei pateikti rekomendacijas, kaip jas sumažinti. Analizė apima keturis pagrindinius sektorius: Finansinių technologijų, informacinių technologijų ir dirbtinio intelekto, elektroninės komercijos bei biotechnologijų ir farmacijos startuolius, kurie dažniausiai susiduria su sudėtingomis licencijavimo procedūromis, griežtais atitikties reikalavimais ir neaiškia reguliavimo aplinka. Tyrimo rezultatai atskleidžia, kad perteklinis reguliavimas gali slopinti inovacijas ir mažinti startuolių išlikimo galimybes. Siekiant palankesnių verslo sąlygų, būtina supaprastinti licencijavimo procesus, užtikrinti aiškesnį teisinį reguliavimą ir sumažinti administracinę naštą

    Exploring the Religious Identity of Dalits through the Lens of Religious Conversion

    The paper examines the role of religion among Dalits in India, especially focusing on Dalit religious conversion from Hinduism to Buddhism. It is based on a case study of Dalit conversion in Shabbirpur village in the Northern Indian state of Uttar Pradesh. In line with the existing research on Dalit conversions, this paper shows that Dalit conversion in Shabbirpur serves not merely as a religious but also as a political and social strategy of Dalits through which they try to negotiate their caste identity. For Dalits, conversion means a resistance to caste oppression as well as assertion of divergent religious identity from the majoritarian Hindu identity. While exploring the Dalit religious identity following their conversion in Shabbirpur, the paper challenges the prevailing notion that religious conversion simply denotes a transfer of religious affiliation. Instead, it elucidates that Dalit religious conversion is a social process wherein Dalits’ transition from one religion to another devoid of a fundamental spiritual transformation. Through this case study, I argue that there exists a continuation of the past and present spiritual affiliation which involves hybridization of religious practice, fusing worship of Ravidas with a new Buddhist identity. Interestingly, this syncretization is not unintentional. It is a conscious attempt to keep both pre-and post-converted religious traits as part of their re-invented socio-religious identity

    Rethinking a Better Life – (Im)mobility Experiences of Vilnius Roma Families

    Most of the Vilnius Roma families are actively engaged in transnational family networks shaping their everyday life, their social imaginations and life trajectories. When discussing the migratory experiences and the meaning of a better life, there is a constant comparison between ‘here’ and ‘there’, or between lives in Lithuania and abroad. ‘Here’ is a place where Roma are always spotted and stigmatised, while ‘there’ assures invisibility and, hence, more opportunities. The circulating ideals about the ‘abroad’ can be read as a disappointment with a life ‘here’ – what is idealised, fantasised and seen as a goal ‘out there’, it is what people would wish to have in Lithuania. This comparison and lived experiences are becoming a collective community knowledge that is shared among all generations – one does not have to really experience life abroad to know that there is a place where everyone “can feel a human being.” But can the imagined paradise be also criticised and questioned? Can a better life be related only to some geographical space and socio-economic experiences? This chapter is based on a long-term ethnographic fieldwork among Vilnius Roma families

    Multidimensional Visualization of Maternal Health Data

    Visualizing multidimensional health data poses challenges in selecting methods that effectively reveal patterns and separations. This study evaluates five visualization techniques for maternal health risk data: scatter plot matrix, parallel coordinates, RadViz, principal component analysis (PCA), and multidimensional scaling (MDS). Both standardized and normalized data are used to assess group separation effectiveness. Direct visualization methods and PCA show limited separation, especially for medium-risk. MDS with Manhattan distance and standardized data provides the best separation. Results show that the visualization method determines the ideal scaling approach, with no single technique universally optimal for multivariate health data

    Vilniaus universiteto priėmimo rodiklių analizė ir prognozavimas (XXI a., I ketvirtis)

    Aukštasis mokslas yra vienas iš svarbesnių veiksnių, teikiančių ne tik asmeninę naudą, bet ir prisidedančių prie geresnės, sveikesnės visuomenės kūrimo. Lietuvoje aukštojo mokslo prieinamumui išaugus, šalis tapo viena labiausiai išsilavinusių visoje Europos Sąjungoje. Ženklus universitetų studentų skaičius mažėjimas 2021–2022 metais stabilizavosi ir pradėjo rodyti teigiamą dinamiką. Vilniaus universitete, kurį pasirenka didžiausia stojančiųjų į universitetus dalis (2023–2024 metais jį sudarė 42–43 %), nuo 2023 metų priimtųjų studijuoti skaičius tik augo ir 2024 metais Vilniaus universitete studijas pradėjo didžiausias per 2019–2024 metų laikotarpį pirmakursių skaičius. Darbe nagrinėjami Vilniaus universiteto XXI amžiaus pirmo ketvirčio priėmimo rodikliai. Galimų ateities tendencijų įvertinimui bei analizei yra taikomas ARIMA modelis. Prognozės rezultatai rodo, kad stojančiųjų rodiklis išliks stabilus. Taip pat darbe nustatoma, jog ARIMA modelis tiksliau įvertina stojančiųjų skaičių už anksčiau naudotą AR modelį
