A REPLY TO RONALD DWORKIN’S CRITIQUE OF MORAL SKEPTICISM
Este artigo tem como temas a “indeterminação”, a “objetividade” e a “verdade” na obra de Ronald Dworkin. O texto está dividido em quatro partes: na primeira delas (Seção 1), exponho a estrutura geral do modo como Dworkin concebe a objetividade no domínio moral. Feito isso, reconstruo as principais críticas que Dworkin faz a dois de seus mais importantes adversários filosóficos: o cético externo (Seção 2.1) e o cético interno (Seção 2.2). Em seguida, na Seção 3, enfrento as críticas de Dworkin, apresentando contra-argumentos em defesa do ceticismo moral. Visando esclarecer o debate e seus principais pontos, ilustro os argumentos, sempre que possível, por meio de exemplos. Por fim, na última Seção (4), recapitulo os principais pontos do texto.This paper focuses on “indeterminacy”, “objectivity” and “truth” in the work of Ronald Dworkin. The text is divided into four parts: first, I will expose the general structure of Dworkin’s conception of objectivity in the moral domain (Section 1). Next, I will present the main critiques Dworkin addresses to two of his most important philosophical enemies, namely the “external skeptic” (Section 2.1) and the “internal skeptic” (Section 2.2). I then intend to address Dworkin’s critiques by presenting counterarguments in defense of moral skepticism (Section 3). In order to clarify the debate and its points, I try to illustrate the arguments with examples whenever possible. In the concluding Section (4), I recapitulate the main points of the text

Socialism: Utilitarian and deontic
Argumenta-se neste artigo que aqueles que defendem um sistema de mercado capitalista tendo porbase a “mão invisível” ou a “ordem espontânea” pertencem a uma tradição da filosofia política queprocura resgatar o máximo possível de uma natureza humana defeituosa, ao passo que os socialistastendem a pertencer a uma tradição oposta que assenta numa fé no progresso humano. A primeira dastradições pressupõe uma espécie de consequencialismo no qual a bondade pode ser obtidaindependentemente das intenções das pessoas, ao passo que a segunda, dada a sua ênfase na tomadaconsciente de decisões e na “vontade boa” esteia-se numa deontologia Kantiana. Discutem-se aquitanto argumentos de tipo utilitário como deontológico a favor do socialismo, mas sugere-se que aênfase na dignidade humana e em acções deliberadas e planeadas tornam os argumentos socialistasmais consentâneos com uma abordagem deontológica. Isto é sobretudo evidente quando os pensadoressocialistas transformam a universalidade monológica Kantiana numa mutualidade dialógica ecomunicativa.This article argues that those who advocate the capitalist market system on the basis of the ‘invisiblehand’ or ‘spontaneous order’ belong to a tradition in political philosophy which attempts to find waysto get the most out of a flawed human nature, whereas socialists tend to belong to the opposingtradition which maintains faith in human improvement. The former tradition involves a kind ofconsequentialism in which goodness can be achieved irrespective of people’s intentions, whereas thelatter tradition, with its emphasis on conscious decision making and the ‘good will’, includes Kantiandeontology. Both utilitarian and deontological arguments for socialism are discussed, but it is arguedthat the emphases on human dignity and on deliberate planned action make socialist arguments sitmore comfortably with deontology. This is most clearly the case when socialist thinkers transformKantian monological universality into dialogical and communicative mutuality
Democratic equality and Rawls’s criticism of welfare state capitalism
Despite the accusation of developing an abstract theory, detached from real conditions, depoliticizing, and ultimately inclined towards the status quo, Rawls did not fail to analyze, since 1971, the political-economic conditions in which his theory could become viable. The analysis of this topic concludes with the statement that the principles and ideals of his theory could not be satisfied under capitalism in any of its forms. This article discusses the possibilities of making justice as fairness compatible under a capitalist welfare state and shows that the reasons Rawls presented for denying this possibility remain perfectly valid. The difficulties of a capitalist welfare state to curb the tendencies of capitalism towards undemocratic inequality make this system unacceptable. The article defends that, although it is a noble ideal to prevent anyone from falling below a certain social minimum, the requirements of the principles of justice are much more demanding. The article concludes by defending Rawls's methodology and main arguments and shows that far from having depoliticizing effects, justice as fairness allows us to broaden the political imagination both to denounce the highly oligopolistic character of capitalist economies and to combat the ubiquitous inclination of neoliberalism towards economic efficiency as an all-encompassing value.Apesar de ter sido acusado de desenvolver uma teoria abstracta, desconectada de condições reais, despolitizante e, ao fim e ao cabo, favorecedora do status quo, Rawls não deixou de analisar, desde 1971, as condições político-económicas que tornariam a sua teoria viável. A análise deste tópico conclui-se com a afirmação de que os princípios e ideais da sua teoria não poderiam ser satisfeitos sob o capitalismo, em qualquer uma das suas formas. Este artigo discute a possibilidade de tornar [o ideal da] a justiça como equidade compatível com um estado de bem-estar social capitalista e demostra que as razões aduzidas por Rawls para negar tal possibilidade permanecem perfeitamente válidas. As dificuldades de um estado de bem-estar capitalista para contrariar as tendências do capitalismo para desenvolver desigualdades antidemocráticas tornam este sistema inaceitável. O artigo defende que, embora seja um nobre ideal impedir alguém de cair abaixo de um determinado mínimo social, os requisitos dos princípios de justiça são muito mais exigentes. Este artigo conclui defendendo a metodologia de Rawls e os seus principais argumentos e demonstra como, ao invés de ter efeitos despolitizantes, a justiça como equidade permite-nos alargar a nossa imaginação política de modo a, tanto denunciar o carácter altamente oligopólista das economias capitalistas como a combater a tendência ubíqua do neoliberalismo para elevar a eficiência económica ao estatuto de um valor a que tudo se deve subordinar
Prof. DID TRADE STOP IN THE EARLY IRON AGE? THE EVIDENCE FROM PHILISTIA AND BEYOND
The transition between the Late Bronze and Iron Age, often described as a collapse, is most often characterized by comparing the changes between these two periods. As trade and connectivity is one of the hallmarks of the Late Bronze Age, the lack of evidence for international trade during the early Iron Age is seen of evidence of the profound changes that occurred during this transition. In this paper, I will reassess the evidence for international trade during the early Iron Age in Philistia and neighboring regions, demonstrating that while there was a substantial degrading in the volume of international trade during this period, it did not cease completely. And based on this, what does this tell us about the processes and mechanisms occurring during the Late Bronze Age/Iron Age transition in the eastern Mediterranean.A transição entre o Bronze Final e a Idade do Ferro, muitas vezes descrita como um colapso, é mais frequentemente caracterizada comparando as mudanças observadas entre esses dois períodos. Como o comércio e a conectividade são uma das marcas do final da Idade do Bronze, a falta de evidências do comércio internacional durante o início da Idade do Ferro é vista como evidência das profundas mudanças que ocorreram durante essa transição. Neste artigo, reavaliarei as evidências do comércio internacional durante o início da Idade do Ferro na Filístia e nas regiões vizinhas, demonstrando que, embora tenha havido uma degradação substancial no volume do comércio internacional durante esse período, ela não cessou completamente. E com base nisso, o que isso nos diz sobre os processos e mecanismos que ocorrem durante a transição da Idade do Bronze Final/Idade do Ferro no Mediterrâneo oriental
Kairós, um segredo impronunciável. Uma investigação sobre o tempo nas artes performativas
O tempo, sob uma perspetiva formal, está presente em qualquer objeto performativo, assim como está, em qualquer episódio do nosso quotidiano. A este tempo evidente chamar-se-lhe-á Chronos, aquele que é mensurável e independente da vontade e da ação do sujeito. A presente investigação procurará intercetar um outro tempo, aquele que se encontra a um nível pré-conceptual e cuja ação do sujeito é imprescindível para que o mesmo se manifeste. Kairós é o tempo experienciado de um ponto de vista fenomenológico, é aquele que requer a presença do indivíduo percipiente, num contacto direto e íntimo com o objeto. Através desta proximidade, diluem-se as fronteiras entre o eu e o objeto, provocando um desacentuar do principium individuationis, o que possibilita o surgimento de um novo espaço-tempo, aquele que é habitado pelo objeto e ao qual, agora, o sujeito tem acesso. Kairós não é o tempo do sujeito, mas também não é inteiramente o tempo do objeto. Kairós é o outro tempo, aquele que é criado pelo sujeito que habita o objeto e pelo objeto que habita o sujeito
Hacia una nueva metodología para el estudio de la iconografía en sellos del período Neopalacial cretense (ca. 1700-1450 a.C.). Una aproximación desde la Historia del Arte y la Antropología Simbólica
Los estudios sobre la sociedad minoica, en general y del período Neopalacial en particular, cuentan con un problema de base: la imposibilidad de comprender los pocos registros escritos que han sobrevivido hasta el presente. Esta situación genera que muchos aspectos de la cultura minoica tan solo se puedan plantear de modo hipotético y hace que el abundante corpus iconográfico sea la fuente principal para estudiarla. Tradicionalmente se han realizado análisis literales sobre las imágenes como si éstas fueran una representación directa de la realidad. Además, cuando se trata de interpretar a la iconografía en sí misma, se suele recurrir a análisis formales y comparativos para encontrar su posible significado.
Ante esto, en el siguiente trabajo se propone una nueva aproximación teórica para el estudio de los sellos minoicos utilizando un enfoque que combina la Historia del Arte desde una perspectiva semiótica y la Antropología Simbólica. El objetivo principal es comprender de manera más profunda los mecanismos de representación y los valores semióticos que pudieron haber tenido las imágenes -en este caso, las que se encuentran en sellos y sellados- en el contexto del período Neopalacial. Asimismo, esta perspectiva puede ser útil no solo para este caso de estudio en particular, si no también, para analizar las formas de interacción social de las culturas antiguas en torno a las imágenes.Studies on Minoan society, in general, and on the Neopalatial period in particular, face a basic problem: the impossibility of understanding the few written records that have survived to the present. Consequently, many aspects of Minoan society can only be hypothesized, and the abundant iconographic corpus becomes the primary source for studying this culture. However, there is a traditional tendency to study images literally as if they were direct representations of reality. Furthermore, when it comes to interpreting the iconography per se, formal and comparative analyses are often used to find its possible meaning.
Given this, the following work proposes a new theoretical approach to the study of Minoan seals using an approach that combines Art History from a semiotic perspective and Symbolic Anthropology. The main objective is to gain a deeper understanding of the mechanisms of representation and the semiotic values that the images found on seals and sealings could have held within the context of the Neopalatial period. This approach may prove useful not only for this particular case study but also for examining the ways in which ancient cultures interacted socially through images.Los estudios sobre la sociedad minoica, en general y del período Neopalacial en particular, cuentan con un problema de base: la imposibilidad de comprender los pocos registros escritos que han sobrevivido hasta el presente. A edição da correspondência de e para Eurico Thomaz de Lima
Daremos conta, neste trabalho, do projeto de edição da correspondência de/para Eurico Thomaz de Lima que faz parte do espólio oferecido à Universidade do Minho. O projeto, iniciado com a fotografia das cerca de quatrocentas unidades codicológicas epistolares, tem prosseguido ao longo dos últimos quatro anos com a edição de toda a correspondência e sua reorganização, por vezes complexa, incluindo a busca de nexo entre unidades dispersas e a procura de outras extraviadas. Neste artigo fazemos o inventário da correspondência editada (em lição semidiplomática, de forma a respeitar todo o seu conteúdo e ortografia, mas oferecendo-a suficientemente à leitura) e o elenco dos numerosos correspondentes, pela voz dos quais nos chegam firmes e unânimes testemunhos do seu génio, do seu notável percurso musical, profissional, mas também familiar, existencial; debruçar-nos-emos sobre algumas particularidades da orientação parental no início da sua carreira, conforme as cartas no-la deixam conhecer, dando ainda a ver o subido conceito que da sua pessoa, trabalho docente, de direcção escolar, composição e execução faziam os seus pares, bem como outras individualidades do panorama musical, literário, artístico e cultural, em especial de Portugal e do Brasil. Estes testemunhos são, em muitos casos, belas peças poéticas e filosóficas a merecer conhecimento pelo leitor contemporâneo.This text reports on the project to edit the correspondence to and from Eurico Thomaz de Lima, based on the archive donated to the University of Minho. The project, which began with the photographing of all the epistolary units, has continued over the last four years with the editing of all the correspondence and with the sometimes complex reorganization of it, including trying to identify connections between dispersed units and searching for other units that seem to have gone astray. This article sets out an inventory of the correspondence already edited, in a semi-diplomatic transcription, which has the aim of respecting the original content and spelling, while at the same time making it more readable. It also lists all of the numerous correspondents, through whose voices come down to us multiple echoes of his genius, of his remarkable musical and professional career, but also of his family life and existential path. There is a focus initially on certain particularities of the guidance he received from his parents at the beginning of his career, to the extent that the letters tell us. They also reveal to us the general esteem in which his person, teaching work, school administration, creations and performances were held by his peers, as well as by other individuals from the musical but also literary, artistic and cultural scenes, particularly in Portugal and Brazil. These reactions and testimonies are themselves, in many cases, beautiful poetic and philosophical pieces that deserve to be known by the present-day reader
Children’s rights and personal data protection in the jurisprudence of the European Court of Human Rights
This article analyses the jurisprudence of the European Court of Human Rights (ECtHR) in order to identify and characterise the argumentative conclusions produced by the Court in their decisions on personal data protection and that affect children’s rights. The data collection technique consisted of a search and selection of the arguments in the Court’s judgments on situations that refer to violations of personal data. For the argumentative analysis, through an argumentation scheme, a judgment of a case that refers to child protection against sexual online exploitation was selected. In this context, we have observed that the Court structured its arguments to verify the violation of privacy and protection of personal data using the following topics: (i) respect for private life; (ii) criminal-law provisions; and (iii) positive obligations. The use of these topics in the subsequent judgments of the ECtHR is also identified through the citations to justify their own decisions
