    Settlement of Traffic Offences: A Shift in the Presumption of Innocence and the Impact on Legal Justice

    Traffic offences are a serious issue in Indonesia, creating complex challenges for the justice system and social costs. Although Law No. 22/2009 has defined the rules, the high number of accidents and offences indicates the ineffectiveness of law enforcement. This study aims to investigate the impact of traffic offences on legal justice, the effectiveness of sanctions, and the shifting presumption of innocence in Indonesia. The research methodology included both quantitative and qualitative approaches, involving analyses of accident data and interviews with authorities. The results showed a high number of offences, a lack of effectiveness of Law No. 22 of 2009, and the phenomenon of "peace in place." The implementation of ETLE cameras became an alternative, despite internet access constraints. Perma No. 12/2016 changed the judicial process, moving from a presumption of innocence to a presumption of guilt. This shift provides uniform sanctions without considering individual circumstances. The limitation of violators' rights in ticket hearings violates the principle of justice. The implementation of e-ticket technology shows advantages, but the dependence on the internet and the potential for misuse are obstacles. The shift to the presumption of innocence in the Perma raises doubts about the fairness of the justice system. Improving fairness requires a re-evaluation of the application of sanctions, technological improvements, and a deeper understanding of the rights of offenders. These recommendations are expected to improve the justice system related to traffic offences in Indonesia

    Sinergity of Village Owned Enterprises and MSMEs in Upgrading Daergic Potentials: Study on Sido Makmur Village, Getasan Village, Getasan District, Semarang Regency

    Getasan Village has strategic potential and sufficient resources to advance Micro, Small and Medium Enterprises (MSMEs). The village's vision and mission, enshrined in Village Regulation No. 2/2019, focuses on the development of MSMEs. Although most MSMEs in the village still operate on a small and home-based scale, they remain a pillar of the local economy. However, challenges such as limited capital, lack of management knowledge, less supportive infrastructure, as well as limited market access hinder the growth of MSMEs. To address this, Village-Owned Enterprises (BUM Desa) are considered a potential solution. Law No. 6/2014 on Villages provides a legal foundation for the establishment of BUM Desa. With the synergy between BUM Desa and MSMEs, local economic potential can be maximized. The research used participatory observation methods and a qualitative approach. The results show several patterns of effective synergy between BUM Desa and MSMEs, such as capital strengthening, infrastructure development, skills training, and joint promotion. These measures are expected to improve the competitiveness and growth of MSMEs and provide positive impacts for the government and community. The formulation of BUM Desa's strategy in utilizing local economic potential and mobilizing MSMEs is also detailed to provide direction for further development

    The Effect of Service Quality, Insurance Costs, and Installment Size on Customer Satisfaction Multi-Purpose Financing: Case Study at Bank Sumut Syariah Padangsidimpuan

    This research aims to analyze the influence of service quality on customer satisfaction, the influence of insurance costs on customer satisfaction and the size of installments on customer satisfaction for multi-purpose financing at the Sumut Syariah Bank, Padangsidimpuan Branch. This research uses primary data by distributing questionnaires to multi-purpose financing customers. The population of this research is all multi-purpose financing customers with a total of 862 people. The sample used in this research was 90 respondents. The validity test uses the Pearson Product Moment correlation test, while the reliability test uses Cronbach alpha. Classic assumption tests include normality tests, multicollinearity tests, heteroscedasticity tests and autocorrelation tests. Hypothesis testing in this study used multiple linear regression analysis. The research results state that service quality and insurance costs partially have a positive and significant effect on customer satisfaction. This means that the higher the quality of service provided will increase customer satisfaction, and the suitability of the insurance costs provided with the benefits obtained by the customer will provide a level of customer satisfaction. Meanwhile, the installment amount does not have a significant effect on customer satisfaction, this is because previously the installment amount had been analyzed using scoring analysis which had an influence on the installment amount

    Pentahelix Model in the Development of Pecaringan Hill Tourism in Jombang Regency

    In order to improve the tourism sector, the Jarak Village Government seeks to develop Pecaringan Hill Tourism by collaborating on the pentahelix model. However, it is not yet known the extent of involvement of each actor related to the development of Pecaringan Hill Tourism. The purpose of this study is to determine the involvement of each actor in maintaining their synergy to optimize the collaboration of the pentahelix model in Pecaringan Hill Tourism Development. The research method used in this study is a descriptive research method with a qualitative approach. With data analysis techniques using interactive data developed by Miles & Huberman. The focus of the research uses the pentahelix model theory from Irawan, (2021), namely Academics, Business, Community, Government, and Media. The results showed that the implementation of this pentahelix model collaboration has been realized, the involvement of each actor in maintaining their synergy to optimize the pentahelix model collaboration in Pecaringan Hill Tourism Development is considered to be quite stable, but still has not had a significant impact on the development of Pecaringan Hill Tourism. This is evidenced by the number of visitors on Pecaringan Hill Tourism which is still relatively small every year. Thus, it can be implied that the pentahelix model in the development of Pecaringan Hill Tourism has been carried out, it can be concluded that the collaboration of the pentahelix model in the development of Pecaringan Hill Tourism in Jombang Regency has been realized and carried out with the continuity of actors that are quite stable

    The Effect of Service Quality, Digitalization and Socialization on Motor Vehicle Taxpayer Compliance: Case Study at Samsat Karawang

    The aim of this research is to evaluate the influence between tax services, tax socialization and digitalization in SAMSAT Karawang district. The independent variables are tax services, tax socialization, and tax digitalization with the related variable, namely motor vehicle taxpayer compliance. The main data will be collected through distributing online questionnaires using Google forms. The sample size of 100 (one hundred) respondents from the Karawang Regency area was used to assess the questionnaire using a Likert scale, and had used the SAPAWARGA application to manage their tax documents and motor vehicle tax payments. The research results show that tax services and the implementation of digitalization have a positive effect on vehicle tax compliance in Karawang district. Meanwhile, tax socialization has a negative impact on the implementation of taxpayer compliance in Karawang district. This research shows that digital applications must be improved and introduced more widely to the public because implementing the SAPAWARGA application can also increase taxpayer compliance. This is because a lack of understanding can lead to non-compliance or attempts to avoid taxes. By encouraging tax socialization that emphasizes fairness, profits, tax benefits and transparency, the government can increase tax compliance and reduce the tax gap between the target and actual amounts in SAMSAT Karawang Regency

    Implementation of the Protection Policy for Children with Disabilities in the Rumah Anak Prestasi Surabaya City

    Implementation of the policy for protecting children with disabilities in Rumah Anak Prestasi (RAP) by referring to Surabaya City Regional Regulation Number 3 of 2023 concerning Amendments to Regional Regulation Number 6 of 2011 concerning Implementation of Child Protection. The number of children with disabilities in Surabaya City in 2023 is 2,562 children, this is not comparable to the number of registrants in the 2023 RAP, a total of 599 children. The research method used is descriptive qualitative. Data collection was carried out by observation, interviews and documentation. There were 4 informants, the Head of the Rehabilitation Division at the Surabaya City Social Service, the Head of the State Children's Village UPTD, RAP administrative staff, and the parents of participants at the Achievement Children's Home. Data analysis (1) data condensation, (2) data display, and (3) drawing conclusions/verification. The results of the research on the implementation of the policy for protecting children with disabilities at the RAP were said to be successful with various training and services provided to participants at the RAP in Semolowaru and Sonokwijenan. Conclusion: The implementation of the policy for protecting children with disabilities in the City of Surabaya (case study of the Achievement Children's Home) was successful, seen from the various training and services provided to participants of the RAP in Semolowaru and Sonokwijenan. However, the organizational capability, information and support factors need to be improved

    A decent house is a dream for all people to have a healthy and safe life. Bojonegoro Regency has many uninhabitable houses, especially those owned by the poor. This has become the focus of the Bojonegoro Regency Government to overcome the problem of uninhabitable houses by forming the Aladin Program. The purpose of this research is to find out the Implementation of the Aladin Program to Repair Uninhabitable Houses in Jatiblimbing Village, Dander District, Bojonegoro Regency. This research uses descriptive qualitative research. The focus of the research uses David C. Korten's program implementation theory with three elements, namely the program, implementing organization and target group. Data collection techniques were carried out by means of interviews, observation, and documentation. The data analysis technique used the Miles and Huberman interactive model. The results of this study indicate that the implementation of the Aladin Program in Jatiblimbing Village has been implemented quite well although there are still some obstacles in the program elements and target group elements

    Analysis of Batam Trans Bus Performance Quality on Urban Transportation System Activities in Supporting Availability of Regional Facilities

    Batam City is one of the developing citiesBus Rapid Transit (BRT) as a mode of mass transportation for the community. Bus Rapid Transit (BRT) operations began in 2004. The existence of the Trans Batam Bus is still less popular with the public because other modes of transportation are easier to use as daily public transportation. Apart from that, the use of private vehicles is still high in Batam City. Trans Batam buses are provided as an integrated mode of transportation to serve the community and provide comfortable, safe facilities and prioritize safety. This research aims to identify the performance of the Trans Batam Bus transportation system based on the SPM for Road-Based Mass Transport (Permen No. 27 of 2015). The research method uses a questionnaire as a research instrument with data processing using scoring (Likert Scale). Multiple linear regression analysis method to determine the magnitude of performance. The sample was 99 respondents who used Trans Batam services. The research results show that aspects that are considered good and efficient according to public perception are busway facilities (0.748), integration with other transportation systems (0.413), and punctuality (0.233). The results of statistical calculations show that there is an influence of public interest of 72.5% on the performance of Bus Rapid Transit (BRT) with the aspects that have the most significant influence, namely security and safety

    The Effect of BOPO, CAR and NPF on the Profit Sharing Rate of Mudharabah Deposits in Sharia Commercial Banks

    The aim of this research is to determine the effect of BOPO, CAR and NPF on the level of profit sharing from mudarabah savings in Islamic commercial banks. Secondary data was obtained from OJK banking financial data on sharia commercial banks. For 2017-2022. The analysis was carried out using the horizontal multivariate method with the help of the Aveo 12 application. The results of the partial significance test showed that the calculated t value for the difference in BOPO was -10.67, which was smaller than the significance of 2.14479 from the t table. This shows that variations in BOPO have a negative effect on the level of profit sharing on Mudarabah deposits. On the other hand, the calculated t value for the difference in CAR is 0.24, which is lower than the table of 2.14479, which shows that this difference does not have a significant effect on the level of profit sharing on mudarabah deposits. However, for the NPF income variable, the t-calculated value was 4.801, higher than the t-table value of 2.14479. Therefore, it can be concluded that this change has a significant effect on the level of profit sharing on Mudarabah deposits. Apart from that, statistical analysis (R Square) shows that the independent variable of this research is able to explain 85.7% of the variation in the variable, namely the Mudarabah Deposit Profit Sharing Rate. The remaining 14.3% was caused by other external factors and these differences were not included in this study
