No full textDepartmental Bulletin PaperIn the case of head injuries caused by child abuse in infants, a judicial decision may be required as to whether administrative measures against the wishes of the parents can be taken. In this case, a factor in the court's judgment is whether or not the cause of the infant's injury was abuse by the parent, and a doctor's opinion is important when determining the cause of the injury. This article summarizes recent lower court judgments that affirmed the illegality of administrative measures regarding temporary protection measures for infants based on the quality of medical opinions submitted by parties to the lawsuit, and then examines the court's judgment regarding child welfare measures.
