Theory and practice of law and music: two improvisations
No full textLos dos trabajos que presento bajo un título conjunto nacieron en ocasiones distintas, pero su contenido responde a un mismo propósito: mostrar que la teoría del derecho puede aprender mucho de la teoría de la música (supongo que también a la inversa). Señaladamente, que toda teoría que importe es una teoría de una práctica. En el primero, más general, he explorado algunos de los rasgos de la interpretación jurídica y de la musical que permiten un análisis conjunto o analógico: especialmente, el realizarse la interpretación en un tiempo, siempre el presente, y un lugar geográfico y social determinado; y el ser producidas regularmente por grupos o ensembles especializados, con su repertorio específico y sus tradiciones interpretativas propias. El segundo se ocupa de algunos rasgos de la regulación y la práctica de la indemnización por daños, que desafían el molde de las reglas codificadas; parece sugerente evocar, para tratar de entender este importante fenómeno del mundo del Derecho, la música de jazz y su elusiva relación con las partituras convencionales. The two papers that I present under a joint title were born at different times, but their content responds to the same purpose: to show that legal theory can learn a lot from music theory (I suppose also the other way around). Specifically, that any theory that matters is a theory of a practice. In the first, more general one, I have explored some of the features of legal and musical interpretation that allow for a joint or analogical analysis: especially, the fact that the interpretation takes place in a time, always the present, and in a specific geographical and social place; and that it is regularly produced by specialized groups or ensembles, with their specific repertoire and their own interpretative traditions. The second deals with some features of the regulation and practice of compensation for damages, which challenge the mould of codified rules; it seems suggestive to evoke, in order to try to understand this important phenomenon in the world of law, jazz music and its elusive relationship with conventional music scores
Transformación de los mitos de Cronos y Orfeo en "El hombre y lo divino" de María Zambrano
Get PDFMaría Zambrano (1904-1991) was a poet and philosopher, and this is reflected in The man and the divine, an essay that invites us to return to Greece and recover the authenticity of our ancestors to realize that man not only has a reasoning dimension, but it has another dimension that reason cannot understand, in this spiritual case. The poet and great thinker she turns to mythology and the gods because without them there is an existential void and she takes refuge in different places of Greek mythology. The objective of the work is that through the origins of the myths of Cronus and Orpheus it is corroborated how the instance of the sacred still survives when it is found in the subconscious of the individual and demonstrate that trhough them she will try to search inside our space in life and bring them back to the present. María Zambrano (1904-1991) fue poeta y filósofa, y así lo refleja en El hombre y lo divino, ensayo que invita a regresar a Grecia y recuperar la autenticidad de los ancestros para darnos cuenta de que el hombre no solo tiene una dimensión razonadora, sino que tiene otra dimensión que la razón no alcanza a entener, en este caso espiritual. La poeta y gran pensadora acude a la mitolgía y a los dioses porque sin ellos se produce un vacío existencial y se refugia en diferentes lugares de la mitología griega. El objetivo del trabajo es que a través de los orígenes de los mitos de Cronos y Orfeo se corrobore cómo la instancia de lo sagrado todavía pervive al encontrarse en el subconsciente del individuo, y demostrar que a través de ellos la filósofa intentará buscar en su interior su espacio en la vida y devolverlos al presente.

Get PDFLina Meruane’s work on Palestine began in 2012 and comprises what throughout the text will be addressed as the author’s Palestine Writing, a mesh of pieces belonging to different genres that, understood through Deleuze and Guattari’s framework, constitute Meruane’s literary machine. Analysing the book’s title, Volverse Palestina, this paper discusses the two different meanings wrapped in it—Returning to Palestine and becoming Palestine. Meruane’s return is impossible because one cannot return from where one has never been, and her transformation is the result of a series of unexpected encounters and collaborations. This paper considers Meruane’s Palestine Writing as a form of becoming-Palestine that takes place not only through an inherited identity but also through a kind of cultural contagion. Following this argument, Palestine Writing can be understood as a part of worldish literature; a becoming-world instance of literature that can relate to other literary works, opening the door to a new understanding of world literature, based on a consolidated definition of what the “universe” of world literature is.

El trabajo de Lina Meruane sobre Palestina comenzó en 2012 y comprende lo que a lo largo del texto se denominará su “Escritura Palestina”, una amalgama de piezas pertenecientes a diferentes géneros que, entendidas a través del marco de Deleuze y Guattari, constituyen lo que se considerará la “máquina literaria” de Meruane. El artíulo analiza los dos significados contenidos en el título del libro, "Volverse Palestina": el volver que implica un regreso a Palestina, que es inherentemente un volver imposible, un regreso allá donde uno no ha estado, y el volver que implica su convertirse en Palestina, un convertirse que no deriva de la herencia común, sino de una transformación interior producto de una serie de encuentros y colaboraciones inesperados. Este artículo considera la Escritura Palestina de Meruane como una forma de volverse Palestina que se produce no solo a través de una identidad heredada, sino también a través de una especie de contagio cultural. Siguiendo este argumento, la Escritura Palestina de Meruane puede entenderse como parte de lo que quedará enmarcado como otra forma de literatura mundial; una instancia de literatura deviniendo-mundo.

The volume brings together twelve articles that explore the idea of a contemporary cosmopolitanism without a world. Literature is presented as a key tool for exploring and representing new borders and subjective realities, challenging traditional notions of nation-state, identity, and sovereignty. The monographic index, conceived as a cartographic proposal, analyzes the spaces of El Segrià, Johannesburg, Debabarrena, Jaffa/Haifa, Berlin, Chernobyl, Paris, Mexico\u27s northern border, London, Central Valley, and Lebanon, which disrupt the classifying epistemologies of the capitalist nation-state. The articles delve into how literature can offer new symbolic ways of understanding and visualizing the world, transcending the logic of center and periphery.El presente artículo es una presentación al monográfico "Sin mundo: Poéticas globales del espacio fronterizo". El volumen reúne doce artículos que exploran la idea de un cosmopolitismo contemporáneo sin mundo. La literatura se presenta como una herramienta clave para explorar y representar nuevas realidades fronterizas y subjetivas, desafiando las nociones tradicionales de estado-nación, identidad y soberanía. El índice del monográfico, concebido como una propuesta cartográfica, analiza los espacios de El Segrià, Johannesburgo, Debabarrena, Jaffa/Haifa, Berlín, Chernóbil, París, la frontera norte de México, Londres, Central Valley, y el Líbano, los cuales interrumpen las epistemologías clasificadoras del estado-nación capitalista. Teletrabajo en la pandemia por COVID-19: Análisis de la salud mental y factores psicosociales de académicos universitarios mexicanos.
No full textThe changes in working conditions generated during the Covid-19 pandemic in Mexican university workers could affect their physical, mental and psychological health, due to uncertainty and latent risk. For this reason, this work analyzes Positive Mental Health and identifies the Psychosocial Factors presented by University Academic workers from the Faculties of Human Communication and the Faculty of Law and Social Sciences of a Mexican Public University. The study design was exploratory, quantitative, descriptive and cross-sectional, through a self-reported online survey. Snowball sampling was carried out during 2020, among academics who were teleworking due to confinement. The results at the levels of the FTP Pienso A.C. psychosocial factors scale. and positive mental health were analyzed by gender. The male gender had higher scores in the leadership, institutional support, social relations and discomfort subscales, and the female gender had higher scores in the work content subscales. The differences being significant in the institutional support and discomfort subscales. The female gender presented higher scores in the cognitive, spiritual, socio-affective and behavioral dimensions. The differences being significant in the Cognitive subscale. The male gender presented worse scores than the female gender on the psychosocial factors scale and the female gender presented better positive mental health. The differences could be due to a worse adaptation of the male gender to teleworking, not previously done, and the previous experience of women in adapting to situations of multitasking and overload.Los cambios en las condiciones de trabajo generadas durante la pandemia Covid-19 en los trabajadores universitarios mexicanos pudieron afectar a su salud física, mental y psicológica, debido a la incertidumbre y el riesgo latente. Por esta razón este trabajo analiza la Salud Mental Positiva e identifica los Factores Psicosociales que presentan los trabajadores Académicos Universitarios de las Facultades de Comunicación Humana y la Facultad de Derecho y Ciencias Sociales de una Universidad Pública Mexicana. Diseño del estudio fue exploratorio, cuantitativo, descriptivo y transversal, a través de encuesta online auto-informada. Se realizó muestreo de bola de nieve durante el año 2020, entre académicos en situación de teletrabajo por el confinamiento. Los resultados en los niveles de la escala de factores psicosociales FTP Pienso A.C. y salud mental positiva fueron analizados por género. Presentaron mayores puntuaciones el género masculino en las sub escalas de liderazgo, apoyo institucional, relaciones sociales y disconfort, y en las sub escalas de contenido del trabajo el género femenino. Siendo las diferencias significativas en las sub escalas de apoyo institucional y disconfort. Presentando mayores puntuaciones el género femenino en las dimensiones cognitiva, espiritual, socio-afectiva y comportamental. Siendo las diferencias significativas en la sub escala Cognitiva. El género masculino presentó peores puntuaciones que el femenino en la escala de factores psicosociales y el género femenino presentó una mejor salud mental positiva. Las diferencias pudieron deberse a una peor adaptación del género masculino al teletrabajo, no realizado previamente, y la experiencia previa de las mujeres en la adaptación a situaciones de multitarea y sobrecarga

Significant differences in parasympathetic markers were found between control and stimulation conditions, suggesting effects of stimulation on autonomic nervous system activity.Este estudio investiga el impacto de la estimulación transcutánea espinal en la actividad del sistema nervioso autónomo analizando la variabilidad del ritmo cardíaco.
