Get PDFapplication/pdfThis study examined the relationships among children’s role-taking ability in rule and moral situations and classroom behavior (non-cooperative class behavior, rule compliance behavior, and prosocial behavior), as well as children’s emotions toward school (liking/avoidance). Participants were Grade 5 and 6 primary-school students in Japan. We used path analysis to examine the effects of role-taking ability in moral situations influenced prosocial behavior and school liking. The results indicated that role-taking ability in moral situations influences on school liking via prosocial behavior. The results can be helpful in understanding and improving children’s adjustment to school.journal articl
Some thoughts concerning presumption of innocence : In light of human rights law
Get PDFapplication/pdfAs has often been noted, it seems that the criminal defendant after indictment is bound by the "handcuffs/leash" when he or she enter the court is a violation of the principle of presumption of innocence. In fact,in a Lay judges in Japan, during the trial before the judges and citizen judges, they have been removed"handcuffs / leash". This is because "handcuffs / leash" may ffaect the free conviction of general citizens. Then, is there any problem with the current system using "handcuffs / leash" for criminal cases other than the cases by lay judges? I tried to investigate this problem from the perspective of international law and international human rights law. As a result, it turned out that the "handcuffs / leash" measures violate the provisions of International Covenants on Civil and Political Rights. Also, this measure is proved to be problematic even from the perspective of domestic laws.
In addition, this paper is based on my speech at a symposium "Handcuffs in the court · leash are allowed?~ Moral rights of criminal defendants / right to be guilty -" , hosted by the Osaka Bar Association held on January 16, 2008.起訴後の刑事被告人がいわゆる手錠・腰縄を身につけ捕縛された状態で公判廷に入る取扱いについては、かねてより無罪推定の原則を侵し得るとの指摘がなされてきた。実際に、市民が職業裁判官とともに合議体を形成する裁判員裁判においては、一般市民である裁判員の心証に影響し得るとの理由に基づき、裁判官および裁判員の入廷前にこれらを外せる運用が行われている。それでは、それ以外の刑事事件につき手錠・腰縄をなす現措置には問題があるか。国際法・国際人権法の観点から一考察をなした。その結果、該措置は日本が批准する国際人権規約等の規定に違反する可能性があり、また国内法解釈においても問題があることがわかった。
なお本稿は、「法廷内の手錠・腰縄は許されるのか？～刑事被告人の人格権・無罪推定を受ける権利」と題して平成28年1月16日に催された大阪弁護士会主催シンポジウムで講演した内容を基に加筆修正したものである。journal articl
The Effects and Problems of Public Health Nursing Exercises Incorporating Case Methods
Get PDFapplication/pdfFor the purpose of examining the effects and problems of public health nursing exercises incorporating case methods, we conducted a survey on students before and after the exercises. The learning objectives were as follows: Comprehending the information needed for personal/family support, Setting goals for personal/family support, Understanding the link from personal/family support to group support, and Demonstrating an ability to gather and assess information for collective and/or regional support. Regarding the level of achievement for these goals, it was found that from 15 of the 17 items the total results of‘ Did Well’ and‘ Did Fairly Well’ exceeded 85%. As for improving problem-solving ability, significant differences were observed before and after the exercises in all 5 items of Aggressiveness, Sociality, Responsibility, Emotional Stability and Communication Ability. There was no significant difference in the improvement of Self-Efficacy before and after the exercises. Although exercises incorporating case methods were found to have certain effects, it was suggested that from now on it will be necessary to consider the factors that lead to the improvement of the students’ self-efficacy through the exercises.ケースメソッドを取り入れた公衆衛生看護技術演習の効果と課題を検討することを目的に、対象学生に演習前後に質問紙調査を行い、統計学的手法を用いて分析した。学習目標の達成度については、「個人・家族支援のために把握する情報がわかる」「個人・家族支援のアセスメントができる」「個人・家族支援の目標設定ができる」「個人・家族支援から集団への支援へのつながりがわかる」「集団・地域支援のための情報収集とアセスメントができる」「集団・地域支援のための支援方法を考えることができる」など、17項目中15項目において、「できた」「まあできた」の合計が85%を超えていた。課題解決能力の向上については、【積極性】、【社会性】、【責任性】、【情緒安定性】、【コミュニケーション能力】の５項目すべてにおいて演習実施前と実施後で有意差がみられた。自己効力感の向上については、演習実施前後で有意差がみられなかった。ケースメソッドを取り入れた演習は、一定の効果が認められたものの、今後は、演習を通して学生の自己効力感の向上に繋がるような関わりについて検討していく必要があることが示唆された。journal articl

A Research Study on the Psychosocial Process of Disability Acceptance of the People with Development Disabilities
Get PDFapplication/pdfThe purpose of this study is to clarify the psychosocial process of disability acceptance of the people with development disabilities who are going to employment transfer support offices. A semi-structured interview was conducted with 8 people with development disabilities who were diagnosed with development disabilities and were going to employment transfer support offices. As the result of analyzing the result of the interview with a modified grounded theory approach, 5 categories and 12 concepts were extracted.
The people with development disabilities who were in troubles like dropout, disemployment, and depression, etc, , and eventually started going to the offices. They are deepening the ≪recognition of the development disabilities≫by checking the disability characteristics and behavior characteristics, reinterpreting their experiences like troubles in working and human relationships, and finding similarities with familiar people with disabilities. The ≪recognition of the development disability≫ that is a core category also has impacts on the and the .本研究は、就労移行支援事業所に通所する発達障害者の障害受容の心理社会的プロセスを明らかにすることを目的とした。発達障害の診断を受け、就労移行支援事業所に通所する発達障害者8名を対象として、半構造化面接を行った。修正版グラウンデッド・セオリー・アプローチを用いて面接内容を分析した結果、5つのカテゴリーと12の概念が抽出された。
中退や離職、鬱病といった状況に陥った発達障害者が＜このままではいけないという思い＞から＜支援機関探し＞を行った結果、事業所に通所するに至っている。障害特性と行動特性を照合したり、仕事や人間関係上のトラブルなどの経験を再解釈したり、障害をもつ身近な人と自分の似ているところを見つけたりして、≪発達障害であることの認識≫を深めている。コアカテゴリーである≪発達障害であることの認識≫は、＜適切な自己コントロール＞や＜自分についてのメタ認識＞にも影響を与えている。journal articl
The Design of Sewing Machine which the Disabled Can Use : The Design as collaborated practices
Get PDFapplication/pdfThe purpose of this study is to describe the design of the sewing machine which enabled the intellectually disabled to be employed in the corporation by means of interviews and fieldworks on workplace practices. Thus, we demonstrate to analysis and describe the sewing machine for the sake of showing the importance of the analysis of cooperation practices between the disabled and the abled. This design of the sawing machine which is being studied is accountable for the connection with the concept of modularization / unitization which are out of respect for the employer and employees or seamless which indicates the possibility of application of working element. Finally we insist that this design of the sawing machine provides‘ a economic place’ to the intellectually disabled in the corporation.本研究の目的は、障害者の抱える困難に配慮したミシンがどのようにデザインされているか、障害者を実際に雇用する企業のワークプレイスの「実践」を通して記述することである。そして、障害者と健常者の協働実践としてのデザインを検討することの重要性を、実際に使用されているミシンのデザインの記述によって示すことである。本研究で研究対象となったミシンのデザインは、障害者の抱える困難への配慮はもちろんのこと、「モジュール化・ユニット化」という雇用者と被雇用者の双方への配慮を最適化する概念や、「シームレス化」という作業要素の応用可能性を示す概念と結び付けて説明可能なものとなっている。障害者は抱えている困難に配慮されたミシンを使用することで、企業内での「経済的な居場所」を得ることが可能になった。journal articl
