Resumen de expediente penal
Get PDFEl presente resumen consiste en ver como la demandante presentada por el
señor José SALCEDO HANKORY, Procurador Publicó del Ministerio de
Defensa, con fecha 18 de abril del 2005, interpone demanda contra el señor
Tnte. Crnl EP HECTOR FELIX POLO BENITES, en vía de un proceso
sumario, con la finalidad de que desocupar un bieninmueble ubicado enVilla
Militar de Chorrillos coronel Ríos 183 ubicado en el Distrito de Chorrillos, por
la causal de OCUPACION PRECARIA.
El primer punto era verse si el inquilino se encontraba en calidad de Precario
o no y segundo si existe la obligación de recobrar a su favor del accionante
el domicilio materia sub Litis, para lo cual presenta la parte demanda como
medio de prueba el Memorándum de fecha, 0o de abril del2001, a fojas seis,
Resolución Ministerial 1914-2003, a fojas 07, del doce de diciembre del 2003,
una copia simple de la ficha de registral a fojas 09 y una copia del reglamento
sobre la entrega de casas de servicio del Ejército.
Sin embargo, luego de escuchar a las partes el Juez en primera instancia
SENTENCIO, mediante la Resolución No. SIETE, del escrito de
contradicción formulado por la parte accionante, en el sentido que no es una
posesión precaria, par cuanto la demandante hi zo entrega en calidad de
arrendamiento en forma voluntaria del titular.
Ante dicho hecho el Juez FALLO, declarando fundada la contradicción de
fojas cuarenta y declare IMPROCEDENTE LA DEMANDA de fojas quince
sin costos ni constas del juicio.
Ante dicha sentencia el demandante, apelo dicha sentencia, ante el Juez del
Trigésimo Novena Juzgado Civil de Lima, el mismo que mediante Resolución
No. SIETE, del trece de Setiembre del año dos mil cinco, resuelve: CONCEDER APELACION, CON EFECTO SUSPENSIVO, remitiendo el
presente en forma oportuna los actuados al superior jerarquicen con la
debida nota de atención.
Con fecha, 18 de noviembre del 2005, remiten el expediente al Presidente
De La Sala Civil De La corte Superior De Justicia De Lima., la misma que
emite la RESOLUCION SIN NUMERO, declarando IMPROCEDENTE, dicha
solicitud del demandante, REVOCANDO, la sentencia emitida en audiencia,
el primero de setiembre del 2001 REFORMANDO, declaran FUNDADA,
la demanda y ordenan que el demandante, Héctor Félix POLO BENITEZ,
cumpla con desocupar el bien i1n mueble ubicado en la Villa Mil1itar
de Chorrillos Crl. Ríos ciento ochenta y tres, distrito de Chorrillos en la plaza
de seis días, firmando los vocales.
No estando conforme con dicha sentencia la parte demandada, interpone
RECURSO DE CASACION, la misma que fue admitida y el 07JUN200o, la
Primera Sala Civil, atendiendo a lo peticionado CONCEDIERON el
recurso de apelación y DISPUSIERON que se eleven los autos al
Supremo Tribunal.
Sin embargo el cuatro de abril del 2007, se dicta una sentencia en torno al
recurso de casación, declarando INFUNDADA el Recurso de Casación
presentado por Héctor Félix POLO BENITES, que a folios dieciséis,
presentado par Héctor Félix POLO BENITES, por lo expresado no
lograron la CASACION, según de lo que se desprende de la sentencia que
a folios cien , del dieciocho abril del dos mil seis; CONDENARON al
recurrente al pago de una multa de 01 unidad de referencia procesal y
el correspondiente pago de la constas y costos que pudieran haber
originado durante el trámite de su recurso, DISPONIENDO, que la presente
sea su publicado en el Diario El Peruano.El resumen del presente expediente consiste, en la denuncia presentada por la
Dirección General de Migraciones y Naturalización, donde se demuestra que la
persona de Carlos Andrés CONILLAS SUBILETA, no habría firmado el
documento con la finalidad de participar como jugador del Club Deportivo Seguro
Social Abraham Valdelomar, de la ciudad de Ica, en mérito de dicha denuncia, la
Fiscalía con fecha 01 de Junio del 2004, formalizo Denuncia Penal, contra
ROBERTO MORON ROJAS, Presidente del Club Deportivo Seguro Social
“Abraham Valdelomar”, Manuel HERNANDEZ QUIROZ y Francisco Javier
BECERRA URIBE, Presidente de y Secretario del Club SPORT ALFONSO
UGARTE, por el DELITO CONTRA LA FE PUBLICA FALSEDAD GENERICA,
siendo agraviado la Dirección General de Migraciones y Naturalización.
Con fecha Ica, cinco de octubre del dos mil cinco, se emite SENTENCIA, contra
ROBERTO MORON ROJAS, Presidente del Club Deportivo Seguro Social
“Abraham Valdelomar” y MANUEL HERNANDEZ QUIROZ y Francisco Javier
BECERRA URIBE Presidente y Secretario del Club SPORT ALFONSO
UGARTE, al haber cometido el Delito Contra La Fe Publica, en la modalidad de
FALSEDAD GENERICA, por haber gestionado un Certificado falsificado de
movimiento migratorio de Carlos Andrés CONILLAS SUBILETA.
Con fecha, 05 de octubre del 2005, SENTENCIO: DECLARANDO: EL
SOBRESEIMIENTO, de la causa a favor de Roberto MORON ROJAS, en el
extremo de la acción penal seguido por el Delito Contra la Fe Pública, en la
modalidad de Falsedad Genérica; FALLO: CONDENANDO, al acusado Manuel
Antonio HERNANDEZ QUIROZ, a dos años de pena privativa suspendida
CONDICIONAL, El Juzgamiento del acusado FRANCISCO JAVIER BECERRA
URIBE, se mantendrá en reserva hasta que sea habido o se ponga a derecho.
Con fecha, Ica, tres de agosto del dos mil seis, se emite la resolución No.20,
mediante el cual se dispone que se deje sin efecto las órdenes de captura al
haberse puesto a derecho el acusado Francisco Javier BECERRA URIBE. FALLO, condenando al acusado FRANCISCO JAVIER BECERRA URIBE,
imponiéndose la pena privativa de la libertad de dos años suspendida en forma
CONDICIONAL, Fijándose en UN AÑO, sujeto al cumplimiento de reglas de
conducta y al pago de la suma de TRESCIENTOS NUEVOS SOLES, por
concepto de reparación civil que será abonado por el sentenciado a favor del
Estado.
Mediante Resolución No.27 de fecha, Ica, veintidós de noviembre del dos mil
seis, La Primera Sala Pena de Ica, CONFIRMARON, la sentencia de fojas
doscientos veintiséis/doscientos treinta.
El 26 de junio del 2009, la Primera Sala Transitoria De La Corte Suprema De
Justicia Ica, declararon HABER NULIDAD al haber transcurrido más de seis años
de inicio del plazo extraordinario de prescripción del delito que se le acusa, en
consecuencia al haberse prescrito el delito a la sentencia de fecha, 22 de
noviembre del 2006, condenaron a Francisco Javier BECERRA URIBE, a dos
años de pena privativa de la libertad suspendida y REFORMANDOLA,
declararon de oficio prescrita la acción penal a favor del procesado,
DISPUSIERON la anulación de sus antecedentes policiales y judiciales y el
archivo definitivo del presente proceso.The present summary consists of seeing how the plaintiff presented by Mr. José
SALCEDO HANKORY, Public Prosecutor of the Ministry of Defense, on April 18,
2005, filed a lawsuit against Mr. Lt. Crnl EP HECTOR FELIX POLO BENITES, in
a summary proceeding, with the purpose of having him vacate a property located
in Villa Militar de Chorrillos coronel Ríos 183 located in the District of Chorrillos,
for the cause of PRECARIOUS OCCUPATION.
The first point was to see if the tenant was in the capacity of Precarious or not
and second if there is an obligation to recover in favor of the plaintiff the domicile
sub Litis, for which the plaintiff presented as evidence the Memorandum dated
April 1, 2001, on page six, Ministerial Resolution 1914-2003, on page 07, dated
December 12, 2003, a simple copy of the registry card on page 09 and a copy of
the regulation on the delivery of Army service houses.
However, after hearing the parties, the Judge in the first instance, by means of
Resolution No. SEVEN, found in favor of the plaintiff, in the sense that it is not a
precarious possession, since the plaintiff voluntarily leased the property from the
owner.
In view of said fact, the Judge DECIDED, declaring the contradiction of page forty
to be founded and declared the lawsuit of page fifteen to be IMPROCEDENT,
without costs or records of the trial.
Before said sentence the plaintiff, appealed said sentence, before the Judge of
the Thirty Ninth Civil Court of Lima, who by means of Resolution No. SEVEN, of
September thirteenth of the year two thousand five, resolved: GRANT APPEAL,
WITH SUSPENSIVE EFFECT, remitting the present in a timely manner the
proceedings to the superior hierarchical with the due note of attention. On November 18, 2005, the file is sent to the President of the Civil Chamber of
the Superior Court of Justice of Lima, the same one that issues the
RESOLUTION WITHOUT NUMBER, declaring IMPROCEDENT, said request of
the plaintiff, REVOKING, the sentence issued in hearing, the first of September
of 2001 REFORMING, they declare FOUNDED, the claim and order that the
plaintiff, Héctor Félix POLO BENITEZ, complies with vacating the movable
property located in the Villa Mil1itar de Chorrillos Crl. Ríos one hundred and
eighty three, district of Chorrillos within six days, signed by the judges.
Not being satisfied with said sentence, the defendant filed an APPEAL IN CASE,
which was admitted and on 07JUN2007, the First Civil Chamber, in response to
the petition, CONCEDITED the appeal and DECIDED that the case be sent to
the Supreme Court.
However, onApril 4, 2007, a sentence was issued regarding the appeal, declaring
the Appeal filed by Héctor Félix POLO BENITES, which in folios sixteen, filed by
Héctor Félix POLO BENITES, UNFOUNDED, for what was expressed, they did
not achieve the CASATION, according to what is shown in the sentence that in
folios one hundred, of April eighteen, two thousand six; ORDERED the appellant
to pay a fine of 01 procedural reference unit and the corresponding payment of
the costs that could have originated during the processing of his appeal,
PROVIDING, that the present judgment be published in the Diario El Peruano.The summary of the present file consists of the denunciation presented by the
General Direction of Migrations and Naturalization, where it is demonstrated that
the person of Carlos Andrés CONILLAS SUBILETA, would not have signed the
document with the purpose of participating as a player of the Club Deportivo
Seguro Social Abraham Valdelomar, of the city of Ica, in merit of this
denunciation, On June 1, 2004, the Prosecutor's Office formalized a criminal
complaint against ROBERTO MORON ROJAS, President of the "Abraham
Valdelomar" Social Security Sports Club, Manuel HERNANDEZ QUIROZ and
Francisco Javier BECERRA URIBE, President and Secretary of the SPORT
ALFONSO UGARTE Club, for the crime against PUBLIC FAITHFULNESS
GENERIC FALSENESS, being the aggrieved party the General Direction of
Migration and Naturalization.
On October 5, 2005, Ica, a SENTENCE was issued against ROBERTO MORON
ROJAS, President of Club Deportivo Seguro Social "Abraham Valdelomar" and
MANUEL HERNANDEZ QUIROZ and Francisco Javier BECERRA URIBE,
President and Secretary of Club SPORT ALFONSO UGARTE, for having
committed the crime against the Public Faith, in the modality of FALSEDAD
GENERICA, for having processed a falsified Certificate of migratory movement
of Carlos Andrés CONILLAS SUBILETA.
On October 5, 2005, JUDGMENT: DECLARING: THE OVERRULING, of the
cause in favor of Roberto MORON ROJAS, in the criminal action followed by the
Crime Against Public Faith, in the modality of Generic Falsehood; FINDING:
CONDEMNING, the accused Manuel Antonio HERNANDEZ QUIROZ, to two
years of suspended CONDITIONAL privative sentence, The Judgment of the
accused FRANCISCO JAVIER BECERRA URIBE, will be kept in reserve until he
is found or put to law.
On August 3, 2006, Ica, August 3, 2006, Resolution No. 20 was issued, whereby
the arrest warrants were rescinded as the defendant Francisco Javier BECERRA
URIBE had been brought to justice.
RULING, sentencing the defendant FRANCISCO JAVIER BECERRA URIBE,
imposing a prison sentence of two years suspended CONDITIONALLY, fixed at ONE YEAR, subject to compliance with rules of conduct and the payment of the
sum of THREE HUNDRED NUEVOS SOLES, as civil reparation to be paid by
the sentenced person in favor of the State.
By Resolution No.27 dated November twenty-second, two thousand six, the First
Penal Court of Ica, CONFIRMED the sentence of pages two hundred and twentysix/two hundred and thirty.
On June 26, 2009, the First Transitory Chamber of the Supreme Court of Justice
of Ica, declared NULL and VOID the sentence dated November 22, 2006, since
more than six years had passed since the beginning of the extraordinary statute
of limitations period for the crime of which he was accused, consequently, since
the statute of limitations had expired, Consequently, since the statute of
limitations had expired on the crime, the judgment dated November 22, 2006,
sentenced Francisco Javier BECERRA URIBE to two years of suspended
imprisonment and REFORMING it, declared the statute of limitations of the
criminal action in favor of the defendant, ORDERED the annulment of his police
and judicial records and the definitive filing of the present case
La NIIF 9 – instrumentos financieros y su relación con los títulos de crédito hipotecario negociables en la empresa fondo capital emprendedor – fondo de inversión, Cercado de Lima 2020
Get PDFLa presente investigación titulada: “La NIIF 9 Instrumentos Financieros y su relación
con los Títulos de Créditos Hipotecarios Negociables de la empresa Fondo Capital
Emprendedor – Fondo de Inversión, Lima 2020”; tuvo como objetivo establecer la relación
entre la variable independiente: NIIF 9 Instrumentos Financieros y la variable dependiente:
Títulos de Créditos Hipotecarios Negociables. La metodología de investigación empleada
fue de un enfoque cuantitativo, de tipo aplicada, de nivel descriptivo correlacional, de corte
transversal, de diseño no experimental y de campo, de método sistémico, hipotético
deductivo analítico; cuya población y muestra no probabilística fue de 22 trabajadores; la
recolección de datos se realizó mediante la técnica de la encuesta con el instrumento cédula
de cuestionario, cuyos datos recogidos y procesados estadísticamente, dieron como resultado
una prueba de hipótesis general de 0,971 grados de correlación, siendo alto y positivo para
la NIIF 9 Instrumentos Financieros con los Títulos de Créditos Hipotecarios Negociables
(TCHN); el resultado para la primera dimensión fue igual a 0,976 grados, alta y positiva; el
resultado para la segunda dimensión fue de 0,968 grados y el resultado para la tercera
dimensión fue de 0,856 grados de correlación, calificado como alto, positivo y favorable;
concluyendo que existen correlaciones favorables, altas y positivas entre las variables y las
dimensiones y por ello se aceptan las hipótesis alternas y se rechazan las hipótesis nulas,
considerando un nivel de significancia del p valor = 0,000 < al q valor = 0,05 el cual significa
que el nivel de confiabilidad fue del 95% y un 5% de margen de error; con lo que se
demuestra que la NIIF 9 Instrumentos Financieros debe aplicarse para mejorar la gestión de
los Títulos de Créditos Hipotecarios Negociables en la empresa Fondo Capital Emprendedor.This research entitled: "IFRS 9 Financial Instruments and its relationship with the Negotiable
Mortgage Credit Securities of the Entrepreneur Capital Fund - Investment Funds, Lima
2020"; Its objective was to establish the relationship between the independent variable: IFRS
9 Financial Instruments and the dependent variable: Negotiable Mortgage Credit Securities.
The research methodology used was a quantitative approach, applied type,
descriptivecorrelational level, cross-sectional, non-experimental and field design, systemic,
hypothetical deductive analytical method; whose population and non-probabilistic sample
was 22 workers; Data collection was carried out using the survey technique with the
questionnaire certificate instrument, whose data collected and statistically processed,
resulted in a general hypothesis test of 0.971 degrees of correlation, being high and positive
for IFRS 9 Financial Instruments with Negotiable Mortgage Credit Securities (TCHN); the
result for the first dimension was equal to 0.976 degrees, high and positive; the result for the
second dimension was 0.968 degrees and the result for the third dimension was 0.856 degrees
of correlation, qualified as high, positive and favorable; concluding that there are favorable,
high and positive correlations between the variables and the dimensions and therefore the
alternative hypotheses are accepted and the null hypotheses are rejected, considering a
significance level of p value = 0.000 <to q value = 0.05 which It means that the level of
reliability was 95% and a 5% margin of error; This shows that IFRS 9 Financial Instruments
should be applied to improve the management of Negotiable Mortgage Credit Securities in
the Entrepreneur Capital Fund company
Costos de servicios y su incidencia en la rentabilidad de la empresa Master SIG Consultores E.I.R.L. San Borja 2018

de determinar de qué manera los Costos de Servicios inciden en la rentabilidad de la Empresa
Master SIG Consultores E.I.R.L. San Borja 2018.
Nuestra investigación fue de tipo aplicada, de nivel Descriptivo Correlacional, de diseño no
experimental, con el enfoque cuantitativo, se contempló la recolección de datos mediante la
técnica de un cuestionario, utilizando la encuesta y está conformado por 21 preguntas,
validado por expertos; que fueron respondidos por contadores, administradores, por la
gerencia de administración y finanzas, la gerencia de Costos y empleados del área de
contabilidad, las cuales aportaron sus puntos de vistas de la problemática, no cuentan con un
adecuado manejo de dichos costos y esto afecta en la rentabilidad de la empresa,
posteriormente se recopilo los datos mediante SPSS Vs25, para ser encaminadas a gráficos
estadísticos con sus correspondientes explicaciones, por ende, las hipótesis formuladas
fueron demostradas después se concluye que, los Costos de Servicios inciden en la
rentabilidad de la Empresa Master SIG Consultores E.I.R.L., ya que el valor (sig.) fue 0.030,
el cual es menor a 0.05, por lo tanto, se acepta la hipótesis alterna.This research entitled Service Costs and their Incidence on the Profitability of the Master
SIG Consultores E.I.R.L. San Borja 2018, was prepared with the objective of determining
how the Costs of Services affect the profitability of the Master SIG Consultores E.I.R.L. San
Borja 2018.
Our research was of an applied type, of a Descriptive Correlational level, of nonexperimental design, with a quantitative approach, the data collection was contemplated
through the technique of a questionnaire, using the survey and it is made up of 21 questions,

administration and finance management, the cost management and employees of the
accounting area, who contributed their points of view of the problem, they do not have an
adequate management of said costs and this affects in the profitability of thecompany, later
the data was collected through SPSS Vs25, to be directed to statistical graphics with their
corresponding explanations, therefore, the hypotheses formulated were demonstrated after it
is concluded that, the Costs of Services affect the profitability of the Company Master SIG

Principio de causalidad y el estado de resultados de la empresa inversiones San Benjamin E.I.R.L, Santa Anita, 2021
Get PDFEl presente trabajo de investigación tuvo como objetivo determinar la relación del Principio
de Causalidad y el Estado de Resultados de la empresa Inversiones San Benjamin E.I.R.L, Santa
Anita, 2021.
En cuanto a la metodología utilizada la investigación tuvo un enfoque cuantitativo, de tipo
básico y de nivel correlacional. La población estuvo conformada por 18 trabajadores y no fue
necesario la muestra por contar con una población accesible y manejable.
Para la recolección de datos se aplicó la técnica encuesta y como instrumentos se utilizaron
dos cuestionarios que fueron evaluados por profesionales expertos, además se determinó su
confiabilidad con la aplicación de la técnica del Alfa de Crombach, cuyo resultado global fue de
0.92, lo que confirmó una confiabilidad muy alta de los instrumentos.
Se concluyó en base a la Prueba de correlación de Pearson que el Principio de Causalidad
tiene una relación directa y significativa con el Estado de Resultados de la empresa Inversiones
San Benjamin E.I.R.L., Santa Anita, 2021, ya que se obtuvo un coeficiente de correlación de 0.836
lo que indicó una correlación muy alta entre ambas variables.The objective of this research work was to determine the relationship of the Principle of
Causality and the Income Statement of the company Inversiones San Benjamin E.I.R.L, Santa
Anita, 2021.
Regarding the methodology used, the research had a quantitative approach, of a basic type
and of a correlational level. The population consisted of 18 workers and the sample was not
necessary because it had an accessible and manageable population.
For data collection, the survey technique was applied and two questionnaires were used as
instruments that were evaluated by expert professionals, their reliability was also determined with
the application of the Crombach Alpha technique, whose global result was 0.92, which confirmed
a very high reliability of the instruments.
It was concluded based on the Pearson correlation test that the Causality Principle has a
direct and significant relationship with the Income Statement of the company Inversiones San
Benjamin EIRL, Santa Anita, 2021, since a correlation coefficient of 0.836 was obtained which
indicated a very high correlation between both variables

La liquidez y su incidencia en los estados financieros de la empresa Telcomnetperu S.A.C. 2017
Get PDFEl presente trabajo de investigación titulado La Liquidez y su Incidencia en los
Estados Financieros de la empresa TELCOMNETPERU SAC- 2017; tema de investigación
relevante, debido a que las liquideces inciden a los Estados Financieros que son consecuentes
a la morosidad de las cuentas por cobrar a los clientes, lo cual es considerada una de los temas
más importantes que manejan las empresas para lograr sus objetivos trazados en su
planificación.
A causa de la falta de liquidez encontramos los siguientes problemas clientes morosos,
políticas de crédito, falta de control en almacén, control de inventario, no cumpliendo con las
obligaciones con terceros, lo cual conlleva a no lograr los objetivos ya que la liquidez es la
parte más importante para que la empresa pueda proyectar planes y proyectos futuros, los
cuales están planeados para poder cumplirse en un tiempo determinado.
La importancia de esta investigación es mostrar la incidencia de la liquidez en los
estados financieros de la empresa TELCOMNETPERU SAC analizando la relevancia de la
liquidez en cuanto a la situación económica de la empresa, que es la liquidez lo que permite
planear a futuro el manejo de los estados financieros, lo cual se considera muy importante ya
que los estados financieros son la razón de ser de las empresas porque en ello se muestra
cómo responden nuestros clientes que son la razón de ser de nuestra empresa.The present research work entitled Liquidity and its Incidence in the Financial

documentaria en la sub gerencia de logística de la Municipalidad Distrital de Puente Piedra,
tiene como finalidad solucionar la deficiencia de la gestión documentaria de la sub gerencia
de logística, por motivo, que no cuenta con un sistema web que logre automatizar sus
procesos, demostrando una mala imagen a esta sub gerencia importante para la
Municipalidad.
La investigación fue desarrollada bajo la metodología RUP con la gestión de proyectos
PMBOK, además, el diseño de investigación es preexperimental de tipo exploratorio, que se
llevó a cabo en la sub gerencia de logística de la Municipalidad Distrital de Puente Piedra. La
población utilizada en la presente tesis estuvo constituida por los veinte (20)trabajadores de la
sub gerencia de logística, de los cuales se obtuvo como resultado con la actual gestión
documentaria es de 52.00% no está satisfecho, mientras que con la mejora aumento a un
72.00% lo cual muestra la eficiencia de la gestión documentaria con la implementación de una
tecnología de información.
La investigación concluye con demostrar el cumplimiento de la hipótesis planteada, además la
investigación queda debidamente justificada la necesidad de implementar un sistema web para
la gestión documentaria de la sub gerencia de logística porque mejora los procesos, minimiza
tiempos y reduce costos para contribuir con los objetivos de la sub gerencia de logística.The present project of implementation of a web system to improve the documentary
management in the sub management of logistics of the District Municipality of Puente Piedra,
has as purpose to solve the deficiency of the documentary management of the sub
management of logistics, for reason, that not it has a web system that manages to automate its
processes, demonstrating a bad image to this important sub management for the Municipality.
The research was developed under the design of exploratory-type pre-experimental research,
which was carried out in the logistics sub-management of the Puente Piedra District
Municipality. The population used in this thesis was constituted by the twenty (20) workers of
the logistics sub-management, from which it was obtained that with the current document

inscripción a solicitud del banco, el presente proceso tiene su origen en la
creencia que dicho inmueble es de Alejandro Pérez Ripa debido que esta
persona ahora demandado tiene una anotación preventiva en los registros
públicos , este inmueble fue adquirido por los actuales demandantes de fecha
06 de abril 1998 mediante escritura pública de compra y venta ante notario
público es decir en una fecha muy anterior a la ejecución de medida cautelar.
La sala luego de la vista de la causa emite sus sentencia que el tercerista debe
probar con documento público o privado de fecha cierta.
El demandante ha probado el derecho de propiedad con el testimonio de la
escritura pública en una fecha anterior de la medida cautelar y resolvieron
revocar la sentencia apelada que declara infundada la demanda y ordenaron la
desafectación del bien ahora el banco demandado interpone recursos de
casación indicando el banco de tercerista y el banco son de naturaleza distinta
siendo el primero en derecho real y el segundo derecho personal en
consecuencia el recurso casa torio no cumple con las exigencias de Art.388 de
CPC por lo que declararon improcedente
