Advances and challenges in promoting the human right of access to water : influence of soft law in Brazil and Portugal

O objetivo específico consiste em demonstrar a contribuição da soft law na proteção ambiental, especificamente no que se refere à água. Tenciona-se responder os seguintes questionamentos: Por que atores governamentais optam por um instrumento desprovido de força cogente? A soft law é capaz de gerar efeitos de forma global? Qual a influência da soft law no sistema normativo interno e externo? Para desenvolver essas questões optou-se por utilizar a pesquisa teórica, na tentativa de decifrar como a soft law e uma política governamental podem ser aplicados com base nos direitos humanos e com o fim de combater os problemas ambientais relacionados à água. O método aplicado é o dedutivo utilizando autores nacionais e estrangeiros do direito e de outras áreas do conhecimento. Como resultado, propõe-se demonstrar que a soft law é um instrumento dotado de efetividade jurídica, comprovada a importância de sua utilização no direito internacional.The aim is to reflect on the benefits of using a more flexible right when dealing with issues that require urgent resolution, such as the imperative need for water for human consumption. The specific objective is to demonstrate the contribution of soft law to environmental protection, specifically with regard to water. It is intended to an swer the following questions: Why do government actors opt for an instrument de void of cogent force? Is soft law capable of generating effects globally? What is the influence of soft law on the internal and external regulatory system? To develop these questions, theoretical research was used in an attempt to decipher how soft law and government policy can be applied based on human rights and in order to combat environmental problems related to water. The method applied is the deductive national and foreign authors of law and other areas of knowledge. As a result, it is proposed to demonstrate that soft law is an instrument endowed with legal transit, proving the importanceof its use in international law
Hydraulic projects prioritization in the steel industry : an analytic hierarchy process approach

The prioritization in the modernization of hydraulic projects is one of the critical issues in maintenance management, which involves multiple criteria that should be considered. To solve such problems, multi-criteria decision methods are considered an advantage. To define the model’s multi-criteria structure, the Benefits, Opportunities, Costs, and Risks, based on Analytic Hierarchy Process, were applied, considering the possibility of group decision-making. The aim of this research is to propose an evaluation framework for the prioritization of hydraulic projects in the steel industry. With this study, managers and executives can define adequate policies and methods that allow them to guide their decisions in a clear way. Three alternatives were associated with criteria and sub-criteria, available in a hierarchical decision tree, based on the literature and feedback received from the industry experts. The proposed model was applied in a steel plant located in the Brazilian State of Rio de Janeiro. As a general result, this research contributes to the development of a useful decision support tool, enabling a clear view of the most significant factor disposed on a hierarchical tree, and the priority classification of hydraulic system projects in the context of the steel industry
What project management delivers to engineer-to-order? An analysis of a furniture company

The need for sustainable efficiency has emphasized the importance of improving the production process to maintain or open domestic and foreign markets. Strategies like cost reduction, increased quality, production efficiency, and waste reduction are some initiatives considered by the industrial sector to overcome the challenge of improving efficiency in industrial activities. This paper aims to analyse the parallel between the requirements of Engineer-To-Order (ETO) production systems and Project Management processes to better understand how project management can support the production process in industrial sector companies. The established parallel is demonstrated by dividing it into the groups of project management processes in conjunction with literature related to ETO. Starting with a trace of the current state of a case study in a furniture company, BPMN was used as a tool to present the company’s restructuring processes based on the theoretical parallelism’s conclusions. The preliminary results indicate that the proposed processes enable companies to visualize their orders as a project, which can help them become more structured, productive, and efficient, thereby contributing to improving competitiveness

No full textDissertação de mestrado em ArquitecturaExame público realizado em 23 de maio de 2024, às 14H00Face à conclusão do ciclo de aprendizagem que foi o Mestrado Integrado em Arquitetura na ULP, este documento estabelece a ligação entre a infindável criatividade académica e as realidades da prática profissional. Daí a vontade de estudar o ambivalente “Contraste Sustentável”, ele que sempre caracterizou os diversos projetos dos estudantes da escola do Porto, cheios de criatividade e, por isso, contrastantes com as respetivas envolventes. E se, Na arquitetura, o contraste não é necessariamente encarado no seu sentido pejorativo, afinal, já desde a primeira carta internacional sobre património se defende o uso da linguagem contemporânea na pré-existência, através da alteração estrutural de forma “dissimulada”, que não altere o seu “aspeto e o caráter”, abrindo ainda espaço para a adaptação do antigo uso a uma “função útil à sociedade”, obedecendo a “relações de volume e cor”, garantindo a “harmonia arquitetónica” (continuidade), desde que se acuse a “data de intervenção” (atualidade), como pode este dialogar com a pré-existência? Já que existe e é inevitável nas intervenções contemporâneas, desde a simples pintura até à construção, de que forma pode contribuir para o desenvolvimento sustentável? Sobre que circunstâncias? A que níveis pode surgir? E que tipos existem? Esta investigação procura responder a estas questões através do estudo das ideologias e cartas internacionais que deram origem ao entendimento atual, apoiada nos princípios aplicados no caso prático de estudo da Casa Galante, na perspectiva de compreender o seu aspeto transformador, muito mais vantajoso que prejudicial, tal como uma pedra que se atira a um lago e que causa inevitavelmente uma tensão significativa mas que com o tempo acaba por desaparecer.Due to the conclusion of the learning cycle that was the Integrated Master in Architecture at the ULP, this document establishes the link between the endless academic creativity and the realities of professional practice. Hence the desire to study the ambivalent “Sustainable Contrast”, which came to characterize the various projects of students at the Porto school, full of creativity and therefore contrasting with their respective surroundings. And if, in architecture, the contrast is not necessarily seen in its pejorative sense, after all, since the first international charter on heritage, the use of contemporary language in pre-existence has been defended, through structural alteration in a “disguised” way, which does not alter its “appearance and character”, also opening space for the adaptation of the old use to a “useful function for society”, obeying “volume and color relations”, guaranteeing “architectural harmony” (continuity), from If the “intervention date” (present day) is accused, how can this dialogue with pre-existence? Since it exists and is inevitable in contemporary interventions, from simple painting to construction, how can it contribute to sustainable development? Under what circumstances? At what levels can it appear? And what types are there? This research seeks to answer these questions through the study of ideologies and international charters that gave rise to the current understanding, supported by the principles applied in the practical case study of Casa Galante, with the perspective of understanding its transformative aspect, much more positive than harmful, just like a stone thrown into a lake that inevitably causes significant tension but eventually disappears

O rendimento básico incondicional como medida de proteção social em Portugal
Get PDFDissertação de mestrado em Serviço Social, Universidade Lusíada, 2023.Exame público realizado em 27 de Novembro de 2023.A dissertação intitulada “O Rendimento Básico Incondicional como medida de proteção social em Portugal” apresenta um estudo que teve como objetivo geral analisar o enquadramento do Rendimento Básico Incondicional como medida de proteção social em Portugal e os seus contributos para um nível de vida digno. Atendendo à pouca produção científica sobre este tema, em particular na área do Serviço Social, recorremos a uma metodologia mista, qualitativa e quantitativa, aplicando diferentes técnicas de recolha e tratamento de dados, nomeadamente: 7 entrevistas a especialistas na área da política social ou sobre a temática, aplicação de um inquérito por questionário a assistentes sociais em Portugal (n=92) e análise documental através da seleção de artigos científicos retirados da base de dados Scopus (n=16) referentes a experiências internacionais sobre o Rendimento Básico Incondicional. Procedeu-se, posteriormente, a uma análise de conteúdo categorial dos dados qualitativos e à análise descritiva dos dados estatísticos. Concluímos que foi demonstrado conhecimento sobre o Rendimento Básico Incondicional, assim como a concordância da sua implementação quer por parte dos assistentes sociais, quer por alguns dos especialistas, embora com questões sobre a exequibilidade da medida que conduzem à necessidade de uma maior reflexão. Apesar de pistas que surgem com relatos das experiências internacionais analisadas,não existem ainda dados robustos para que se possa aferir se esta medida realmente contribui para a dignidade humana, para a redução da pobreza e da exclusão social. Assim, considera-se que são necessários estudos e um maior debate público sobre diferentes questões relacionadas com o Rendimento Básico Incondicional, tendo este estudo a intenção de contribuir para um maior conhecimento dos profissionais, dos decisores políticos e dos cidadãos.The dissertation entitled "The Unconditional Basic Income as a social protection measure in Portugal" presents a study whose general objective was to analyze the framework of the Unconditional Basic Income, its contributions as a social protection measure and their contribution to a decent standard of living, framed within the scope of Social Work. Since it is a theme with little scientific production, particularly in the area of Social Work, we used a mixed methodology, qualitative and quantitative, applying three data collection techniques, namely interviews with 7 experts in the field of social policy or on the theme, a survey of social workers living in Portugal (n=92) and documental analysis through the analysis of international articles from Scopus database. We conclude that knowledge about the Unconditional Basic Income was demonstrated, as well as the agreement of its implementation both by the social workers and by some of the experts, although with some questions about the feasibility of the measure that lead to the need for further reflection. Despite clues that emerge from reports of the international experiences analyzed, there is still no robust data to assess whether this measure really contributes to human dignity, poverty reduction and social exclusion. It is considered that studies and public debate on the issues related to the Unconditional Basic Income are still needed, and this study is intended to contribute to a greater knowledge of professionals, politicians, and citizens
Psychosocial care for the patient and family in advanced disease : implementation of the social work consultation in palliative care in an oncology hospital

Fruto da pandemia COVID 19, na nossa prática hospitalar oncológica tornou-se evidente o aumento significativo de diagnósticos tardios com acompanhamentos iniciais de
doença em fase avançada, bem como o acréscimo de situações
de vulnerabilidade social associada à globalização da crise.
Perante este enquadramento de tempos inseguros, em março de 2022, no nosso âmbito hospitalar oncológico, implementámos a Consulta de Serviço Social associada à Consulta Externa inicial de Cuidados Paliativos. Desde o início de março até ao final de dezembro foram acompanhadas cerca de 300 pessoas (doentes, familiares e outras pessoas significativas).
Constatamos: integração da atenção psicossocial no acompanhamento em cuidados paliativos atendendo, de forma positiva, aos princípios da atenção holística e integral; presença de atenção psicossocial diferenciada nos momentos do percurso terapêutico; avaliação dos recursos e necessidades da pessoa com doença avançada e dos seus cuidadores; acesso a direitos
sociais e recursos sociais de forma atempada, promotora de melhorias no bem-estar e na prevenção da exaustão; intervenção social preventiva, de capacitação e orientada no plano de cuidados. No final de cada consulta, no seguimento da possibilidade de apoio telemático reforçado no período da pandemia COVID 19, foi disponibilizado o contacto direto do serviço
social. Verificamos que se trata de um recurso do agrado dos doentes, familiares e outras pessoas significativas, que reforça a disponibilidade e acesso à equipa psicossocial, bem como o sentimento de segurança. Concluímos que, a implementação da Consulta de Serviço Social associada à Consulta Externa inicial de Cuidados Paliativos, permite uma maior proteção daqueles que se encontram em situação de grande vulnerabilidade e, concomitantemente, destaca o papel do assistente social como agente promotor de cidadania e de transformação social.The social worker’s action is based on acquired knowledge and a critical attitude towards the reality in which he intervenes. As a result of the COVID 19 pandemic, in our oncology hospital practice, a significant increase in late diag noses with initial follow-ups of advanced disease has become
evident, as well as the increase in situations of social vulnerability associated with the globalization of the crisis. In view of these uncertain times, in march 2022, in our oncology hospital, we implemented the Social Work Consultation associated with the initial External Palliative Care Consultation. From the beginning of march until the end of december, around 300 people were monitored (patients, family members and other
significant people). We found: integration of psychosocial care in palliative care follow-up, positively meeting the principles of holistic and comprehensive care; presence of differentiated psychosocial care in moments of the therapeutic path; assessment of resources and needs of people with advanced disease and their caregivers; access to social rights and social resources in a timely manner, promoting improvements in well-being and preventing burnout; preventive, training and oriented social intervention in the care plan. At the end of each consultation, following the possibility of enhanced telematic support during the period of the COVID 19 pandemic, direct contact from the social service was made available. We verified that this is a resource that patients, relatives and other significant
people like, that it reinforces the availability and access to the psychosocial team, as well as the feeling of security. We conclude that the implementation of the Social Work Consultation associated with the initial External Consultation of Palliative Care allows greater protection for those who are in a situation of great vulnerability and, at the same time, highlights the role of the social worker as an agent that promotes citizenship and
social transformation

The robotization of social protection in Brazil : impacts and challenges related to social management and the professional performance of Social Work

Recorre-se à literatura sobre as concepções e os fundamentos da proteção social não contributiva e às pesquisas que tratam da implementação de políticas públicas, destacando-se aí o conceito de burocracia de nível de sistemas. Tais reflexões se dirigem mais diretamente ao campo do Serviço Social, na medida em que se voltam a questões estritamente ligadas à produção
de conhecimento, formação e exercício profissional do assistente social. Assim, em perspectiva crítica, considera-se os impactos, repercussões ou consequências do que se chamou de robotização da proteção social no plano da atuação profissional do Serviço Social.This article, in an interdisciplinary manner, articulates knowledge from the field of Communication, Sociology and Social Work in order to understand this scenario of “datafication of society”, platforming of Brazilian State institutions, surveillance and control processes (surveillance capitalism), and the role of Information and Communication Technologies (ICTs) in the field of social protection. To reference is made to the literature on the
conceptions and foundations of non-contributory social protection and to research that deals with the implementation of public policies, highlighting the concept of systems-level bureaucracy.
Such reflections are directed more directly to the field of Social Work, insofar as they turn to issues strictly linked to the production of knowledge, training and professional practice of the social worker. Thus, in a critical perspective, the impacts, repercussions or consequences of what has been called the robotization of social protection in terms of the professional performance of Social Work are considered
