O combate à corrupção : o direito premial, a perda alargada de bens e uma jurisdição criminal especializada
Lusíada. Direito. - ISSN 2182-4118. - S. 2, suplemento (2024).It was these three points that I wanted to underline, the first two, basically drawing attention to a problem that arises in relation to the Premium Law in the new solution consecrated by the legislative package of the previous legislature, regarding the national strategy against corruption, in the omission of implementation of Directive 2014/42 in relation to the extended confiscation of assets, being criticized by all the doctrine that the legislator does not seem to want to respond to, considerably limiting the powers of the Public Prosecutor and the courts to neutralize the economic benefit resulting from the corruption, which is, in essence, the great culprit for the commission of this crime and, finally, the issue of specialized jurisdiction, so to speak, or the specialized sections within the ordinary courts dedicated to economic crime and the fight against corruption. There are three crucial points, fundamental for an effective fight against corruption, but also in full compliance and in full alignment with international standards of Human Rights.https://doi.org/10.34628/65tw-px4
