CONTESTING THE AUTHENTICITY OF THE HADITH SANAD: An Analysis of Leone Caetani’s Thought

Abstract: One of the most heated debate on the Prophet Traditions criticism is the issue of concerning the chain of transmitter or what is popularly known as sanad which consequently determine the validity of a hadith of the Prophet Muhammad. Even Muslim scholars consider sanad to be part of the religion of Islam. In contrast to this stand, Leone Caetani, one of the Italian orientalists who is famous for his historical works on Islam, tried to blatantly criticize the chain of transmitters of the hadith as well as review them in an approach and method he himself promoted. This paper attempts to explore L. Caetani’s thoughts about the chain of transmitter of the Prophetic Traditions by applying literature study and descriptive-analytic methods. The result of this research is that L. Caetani assumes that sanad is not an integral part of the teaching of Islam but Muslim scholars but rather an adoption from the Arab tradition. In addition, it also implies that the existence of sanad is only the image of the name of the Prophet Muhammad and his narrators, and the narrators of hadith are people who cannot be followed and do a lot of practice of falsification in his narrations. Keywords: Leone Caetani, orientalis, sanad, hadi

THE TITLE KHALÎFAT ALLÂH IN 17TH CENTURY ACEH: Concept and Meanings

Abstract: This article attempts to study the use of the title ‘khalîfat Allâh’ in seventeenth century Aceh. The main bulk of this inquiry revolves around the concept and meanings of the title, which was adopted from the mainland of Islam. This study is historical in nature and it is done by employing the ‘descriptive analytical’ method. The description of the use of the title khalîfat Allâh and its relations with the Acehnese political structures will be investigated. This step is then followed by the ‘analytical’ part, in which the exploration of the Acehnese conception and the meanings of the title will be given. As a sultanate, Aceh was seen as a khilâfah in its own right in which God’s religion is to be implemented. As Such, the ruler’s task was not only to pursue the prosperity for the country and its people but also to foster God’s religion. Based on this tenet, the head of the state was to hold the title ‘khalîfat Allâh’, which simply meant the ‘deputy of God.’ By this very title a ruler was to possess both political and religious authority. Yet, by holding the religious authority did not necessarily mean that a ruler was a scholar of religion; it can be best described as a ‘religiously sanctioned authority’. Keywords: Aceh, sultanate, khalîfat Allâh, authority, politics, religio

THE ORGANIZATION OF MADRASAH ALIYAH IN ACEH REFORM ERA

Abstract: The Organization of Madrasah Aliyah in Aceh. The main problem in this research is the implementation of madrasa aliyah in the reform era in Aceh. In terms of regulation, Madrasa aliyah in Aceh received an equivalent recognition from schools. Whereas when other regions take a lot of positions to prioritize schools, Aceh with its regulatory power should be able to perform more optimally compared to other regions in the archipelago. Seeing this, it is certainly a challenge for Aceh when it must pay attention to madrassas which in regulations in some regions consider it not their authority. The purpose of this study was to determine the conditions and problems of madrasa aliyah, and their policies and impacts. This research is qualitative research with a responsive evaluation approach. After analysis, it was found that the Aceh government still marginalized the Madrasah Aliyah educational institutions, although several regulations allowed Acehnese to do more. This is of course because the Province of Aceh is a special autonomous region that needs special attention based on the legal principle of lex specialis derogat legi generalis. Keywords: Madrasah Aliyah, special autonomy, policy, Ace

KITAB KUNING AND TRAINING OF ‘ULAMÂ’: The Experience of Madrasah Al Qismul Ali Jalan Ismailiyah Medan

Abstract: This article is a result of a history research relying on informants and documents for the larger part of its data. The Madrasah Al Qismul Ali Jalan Ismailiyah Medan was established by Al Jam’iyatul Washliyah in 1953, to cater for the education of young ‘ulamâ’ applying a curriculum almost solely based on Islamic classical books (known popularly as kitab kuning). This madrasa was very successful in fulfilling its mission and was celebrated as an‘ulamâ’-producing institution until mid-1980s. Madrasah Al Qismul Ali strives to combine its old winning curriculum with the new state-sponsored one. After some decades, it is clear that this strategy is not working to expectation. The madrasa fails to deliver graduates of the same quality as it did. Apparently what is left of classical book in the curriculum is not sufficient to prepare younger generation of ‘ulamâ’.Keywords: Qismul Ali, kitab kuning, ‘ulamâ’ training, madrasa

THE CONVERGENCE OF ‘ÂDAT AND ISLAMIC LAW: The Practice of Gala in Aceh

Abstract: This article attempts to explain the position of the practice of gala in Acehnese society perspective in light of ‘âdat and Islamic law perspective. Theories of ‘âdat show that there are some pillars of gala that should be fulfilled; contract is done in front of chief of village and other village figures additional witnesses. Soon after the debt payment, murtahin (mortgager) must return the mortgaged to râhin (mortgagee) as the local saying goes “ngui pulang utang bayeu” means after use, the goods returned, the debt must be paid. In addition, marhûn cannot be exploited by murtahin as it is solely as security of the debt. These requirements have drawn closer to the Islamic law especially Syâfi‘î’s school. Research showed that the practice of gala (mortgage) in Aceh has contradicted the ‘âdat (customary law) and Islamic law in several points. Keywords: gala, marhûn, ‘âdat, Islamic law, Ace

Abstract: Tahâluf Siyâsî in the Practice of Islamic Politcal Party in Indonesia. This article studies the concept of the coalition at the level of normative doctrine and what form of tahâluf category practiced by religious-based parties of today? This research is descriptive with the method of documentation with qualitative analysis. The results of the study found that the coalition (tahâluf siyâsî) inherent there in the sacred and purity meaning of all pragmatic interests even the political practices of the early generations of Islam gave a strong signal that the coalition was a sacrifice for the wronged people, raised the dignity of the truth, where as the current political practice gives another connotation of the sacred meaning. The author emphasized that one of the dark history of the coalition that had been built among political groups including Islamic parties today is that the coalition (tahâluf) is loaded with pragmatic interests so that the term tahâluf is felt to be less appropriate and more properly called tanâshub or takâluf siyâsî transactional politic.Kata Kunci: tahâluf, siyâsî, koalisi, partai Islam, politi
