    Establishing A Common-Law Marriage: Weighing The Relevant Factors

    While the majority of states in the U.S. have eliminated common-law marriage, they are still recognized in a minority of jurisdictions. When a couple has established a valid common-law marriage in another jurisdiction, the Full Faith and Credit Clause of the United States Constitution requires all states to recognize this marriage and give it full legal force and effect. Nevertheless, issues arise when, after the death of one of the individuals, the survivor asserts the existence of a common-law marriage, allowing the survivor to reap financial benefits. Common-law marriages can invite legal challenges, especially when determining the date of marriage, dividing assets, establishing spousal support, and establishing spousal inheritance rights. In these cases, courts have then been called on to evaluate the validity of these claims. The purpose of this article is twofold. First, the requirements necessary to establish a common-law marriage in each jurisdiction will be examined. Second, court rulings upholding or refuting the existence of a common-law marriage will be analyzed to provide the guidance necessary to avoid both unexpected and unintended outcome

    This paper explains how to recognize and steer clear of numerous common logical fallacies, ranging from ad hominem arguments to wishful thinking, that can damage an argument. Critical thinking is essential in the digital age, where we must question false or flawed claims. It helps us base our decisions on facts and evidence, not feelings or fallacious reasoning. Unfortunately, many employers struggle to find workers with this skill. To develop it, one must learn how to understand and evaluate the essence of an argument

    Supporting Identity Development for Multiracial High School Students: Implication for Educational Practice

    The increasing diversity of the United States population has led to a growing number of multiracial individuals, particularly among younger generations. Despite this demographic shift, high school environments often fail to adequately support multiracial students’ identity development. This study explored how multiracial youth navigate their racial and ethnic identities within high school settings, examining the impact of school policies, teacher awareness, peer interactions, and experiences of discrimination. Using qualitative interviews with multiracial students and faculty members alongside survey’s to provide a comprehensive analysis of the factors influencing multiracial identity development. Findings indicate that a lack of representation in curricula, implicit biases among educators, and rigid institutional racial classifications contribute to identity struggles for multiracial students Many participants reported experiences of microaggressions and marginalization, reinforcing a need for more inclusive policies and practices. Schools that actively incorporate diverse narratives, train educators on multiracial identity complexities, and allow students the flexibility to self-identify experience higher levels of student engagement and well-being. This research contributes to the growing body of literature on multiracial youth identity by emphasizing the need for systemic changes in educational settings. The study provides practical recommendations for educators, administrators, and policymakers to create more inclusive school environments that affirm and support the unique experiences of multiracial students

    Middle School Counselors: Training, Stress and Wellness Practices

    This dissertation explored middle school counselors’ stress, training, and wellness/= / \u3epractices. Although counselors are vital in fostering student development, their roles often involve high caseloads, administrative tasks, and role ambiguity—contributing to elevated stress levels. Using a mixed-methods approach, this study examined the daily stressors counselors face, their preparedness for managing wellness, and the self-care strategies they employ./= / \u3e/= / \u3eFindings revealed a significant gap between the ideal role of school counselors, as outlined by the American School Counselor Association (ASCA), and the realities of their day- to-day responsibilities. While ASCA promotes comprehensive student advocacy and counselor wellness, many counselors are not adequately trained or supported to meet these expectations./= / \u3e/= / \u3eThe research highlighted the importance of intentional wellness practices—such as mindfulness, physical activity, joy, social connection, and self-compassion—in reducing stress and improving job satisfaction. These practices not only benefit counselors personally but also enhance their ability to model wellness for students and staff./= / \u3e/= / \u3eThe study advocates for integrating wellness education into counselor preparation programs to foster self-awareness and equip future counselors with effective stress-management strategies. It also calls for systemic changes, including clearer role definitions and alignment between job duties and professional standards./= / \u3e/= / \u3eBy addressing both training and structural issues, schools can better support counselors’ well-being, reduce burnout, and promote a healthier school climate. This research offers valuable insights for educators, administrators, and policymakers seeking to create supportive environments that enable counselors to thrive
