    Maritime Autonomy and Liability: Navigating Uncharted Waters

    For centuries, people have voyaged the seas, structuring international and domestic law around the premise that people crew ships. However, that premise is no longer guaranteed as unmanned systems and vessels begin to embark on the waters. As the international community and U.S. legislators grapple with whether the law of the sea and domestic maritime law must adapt to accommodate the newest seafarers, it becomes evident that they need to be fully prepared to answer questions of liability and responsibility regarding unmanned vessels. This will become especially apparent when unmanned vessels collide with manned or other unmanned vessels. This article provides a framework to analyze liability and responsibility for collisions that occur in peacetime and during periods of armed conflict under the law of the sea and domestic maritime law based on the degree of autonomy of such vessels

    China’s military diplomacy plays a crucial role in advancing the nation\u27s foreign policy objectives and safeguarding its strategic interests. This report highlights a diverse array of activities within military diplomacy, including senior-level meetings, joint military exercises, naval port calls, UN peacekeeping operations, and academic exchanges. Our findings reveal a significant—but incomplete—recovery in China\u27s military diplomacy activities in 2023, following a period of reduced contacts with foreign militaries during the COVID-19 pandemic. Southeast Asia and Russia remain primary partners for China, with emerging strategic importance also seen in Africa, Oceania, and the Middle East. Overall, China\u27s military diplomacy underscores its efforts to diversify partnerships and assert its global influence, emphasizing regional stability and international cooperation in pursuit of its diplomatic goals.https://digital-commons.usnwc.edu/cmsi-maritime-reports/1037/thumbnail.jp

    The Commander’s Handbook on the Law of Naval Operations is used in the United States and throughout the world as a restatement of U.S. doctrinal law positions on matters affecting the operations of the U.S. Navy, the U.S. Marine Corps, and the U.S. Coast Guard. Judge advocates and legal advisers have occasion to conduct deeper research to identify the context and source of the rules reflected in the Commander’s Handbook. Responding to this need, an Annotated Supplement to The Commander’s Handbook was produced in 1997 and published as volume 73 of International Law Studies. In the intervening decades, international law has evolved, and the underlying sources and context have grown considerably. Judge advocates have long used the Annotated Supplement as a resource alongside the Commander’s Handbook and as a point of departure for further inquiry. This 2024 updated Annotated Supplement excerpts numerous U.S. government sources to provide clarity and fidelity to the text of the Handbook, including U.S. legislation and executive branch policy proclamations and the Department of Defense Law of War Manual

    Report No.2: Integrated Naval Deterrence in the Arctic Region—Strategic Options for Enhancing Regional Naval Cooperation

    Despite recent advances to strengthen regional deterrence cooperation, questions remain on the evolving role and posture of naval forces in the Arctic region, and what further steps can be taken. At the NASI 2022 seminar in Copenhagen, the Heads of Navy of the Arctic-Seven nations and Arctic stakeholders such as France and the United Kingdom asked the NASI 2023 cohort to provide an independent assessment of naval force posture, the trans-Arctic dimensions of national security policies in the context of a more contested “Blue Arctic” and critical dilemmas that regional senior defense and naval leaders could face at the strategic and operational levels. In particular, the NASI 2023 cohort was asked to focus on key challenges and opportunities for further developing bilateral and multilateral cooperation among naval forces to strengthen Integrated Naval Deterrence in the Arctic region.https://digital-commons.usnwc.edu/nasi/1001/thumbnail.jp
