Hukum dan Manajerial Wakaf di Malaysia
Dalam ranah epistemologi hukum Islam (kitab fiqih), secara terminologis wakaf sering didefinisikan sebagai “penahanan (pencegahan) harta yang bisa dimanfaatkan; yang tidak lenyap eksistensinya, dengan cara tidak melakukan tindakan (menghilangkan) bendanya, disalurkan kepada hal yang mubah yang konkrit.â€Studi tentang wakaf di Malaysia biasanya terselip dalam liputan studi hukum keluarga yang lebih populer; perkawinan, perceraian, status anak angkat, dan hukum waris. Dengan kajian ini diharapkan tergambar tata cara pengaturan harta wakaf di Malaysia, yang akhirnya berimplikasi praktis; dapat dipertimbangkan aplikasinya untuk konteks Indonesia, sejauh hal itu konstruktif. Telaah atas tema ini akan coba diolah dengan pendekatan sosiologis-historis dengan asumsi bahwa pendekatan normatif dan historis per se tidak mampu lagi menghasilkan satu konklusi yang komprehensif. Kata Kunci : Wakaf, Hukum Wakaf, Manajerial Wakaf.Â
KEPEMIMPINAN KYAI YANG BERORIENTASI PADA IMTAQ DAN IPTEK (Studi Kasus di Pondok Pesantren Wilayatul Ummah Kampung Damai Ponorogo)
Abstract: This study about kyai leadership and focused on his leadership orientation. Findings show that the leadership of the kyai is oriented to development of IMTAQ and that completed with IPTEK can produce a leader that has good emotional and spiritual quotient (ESQ). It is recommended that, who are improve their leadership orientation, should improve the quality of IMTAQ and the quality of IPTEK capability
PEMILIKAN TANAH PERSPEKTIF ISLAM
Dalam kontek Indonesia, tanah adalah primadona harta benda. Status seseorang bisa ditentukan oleh kekuasaan tanah yang dimiliki. Dengan begitu, masalah kepemilikan tanah sangat komplek sekali. Namun demikian pelaksanaan undang-undang tersebut masih jauh dari harapan. Masyarakat lemah, petani gurem masih sering dikalahkan untuk kepentingan individu ataupun kelompok yang mengatasnamakan kepentingan umum. Sehingga ini menjadi issu trend di setiap saat dari dulu hingga sekarang.Al Qur’an menetapkan hak manusia untuk mengelola, menanami dan memiliki hasil produksinya. Semua ulama Islam sependapat, bahwa pemilik hakiki atas tanah adalah Allah SWT. Adapun pengertian milik pada manusia bersifat tidak hakiki malainkan majazi dan tidak mutlak. Sehingga pada masa Nabi prioritas utama atas kepemilikan sebidang tanah berada di tangan pemerintah dan selanjutnya baru diperuntukkan untuk individual. Karenanya pemerintah dapat menghadiahkan, membatasi maupun menarik kepemilikan sebidang tanah dari seseorang sesuai dengan kemaslahatan masyarakat.Â
KRITIK TEORI BELAJAR MENURUT PANDANGAN ISLAM
Islamic Education requires that a teacher in addition to having a deep and broad knowledge of science to be taught, but also must be able to convey that knowledge effectively and efficiently and have a noble character. About the need for a noble character of a teacher has long been a concern and a review of the scholars of Islam in the century classic. For example, Ibn Muqaffa say that good teachers are teachers who want to try to start by educating themselves, improve their behavior, straightening his thoughts, and keep the words he said before delivering it to others. While the Imam Al-Ghazali said that: a teacher who deliver science should be clean, do and act as guidance as, being affectionate towards his pupils and students should treat them like his own son, the teacher must always control, advise, give a message - a message of moral about science and the future of their students and do not let them proceed to a higher learning before they have mastered the previous lesson and have a noble character. Balance the development of science (reason) and morality (the heart of behavior) is something that should always be controlled by the teacher. That is the teacher who in addition to foster reasonable intelligence can grow his thoughts also a noble character. So the theory of education according to Islamic education is to be as guidance as, being affectionate towards his pupils and students should treat them like his own son, the teacher must always control, advise, give a message - a moral message about science and the future of their students and do not let them continue learning to a higher before they have mastered the previous lesson and have a noble character. Islamic education in various aspects based on the values of noble and godlike universal, then the strategic step for us Muslims should realize the theory of learning by implementing Islamic education in accordance with the nature and character. In contrast to the theory of learning that emerged from the thinkers of the western experts educators.Key Words: Theory of learning, Islamic perspective, Islamic learning
