Get PDFIn developing a business, a person cannot be separated from the help of others. So that other people become partners in running a business. As the case in Bintang Jaya Abadi Travel Service Agency in Banyuwangi and Ayu Lestari Restaurant in Situbondo. Both of them enter into a cooperation contract in order to promote their businesses. Bintang Jaya Abadi Travel Service Agency wants to progress with the increase in customers or enthusiasts. This is inseparable from the existence of good services and facilities. Likewise, Ayu Lestari Restaurant wants to move forward. The cooperation contract that they do is in writing. However, with other travel service agencies, restaurants also use written cooperation. The cooperation contracts they do are sale and purchase agreements and greetings (orders). The contract between them is in accordance with the shari'ah objective, namely safeguarding property (hifdz al-maal). One form of action that can keep property so that it is used for right actions is the enactment of transactions, meaning that the transactions they carry out are in accordance with the principles of Islamic law

Get PDFReligious education for Muslim is Islamic Education originating from Al-Qur’an dan As Sunnah. This study elucidates the dynamic of the change and development of Islamic education in the era after the death of the prophet Muhammad shallall?hu 'alaihi wa sallam, especially in the period of Khulaf?ur R?syid?n. It was revealed how the education system had been implemented in each caliphate and the situation having influenced the educational system. The finding showed that the pattern of the education in the era of caliph Abu Bakar radh?yall?hu ‘anhu was generally still same as the system applied in the era of the prophet of Muhammad shallall?hu 'alaihi wa sallam. The massive development occurred in the period of caliph Umar bin Khatab radh?yall?hu ‘anhu which was continued with the caliph Utsman bin Affan radh?yall?hu ‘anhu. Nevertheless, there were some fundamental changes, especially in the regulation as well as the education method

Get PDFThe research discusses Ijtihad Jama’i or more familiar known as Collective Ijtihad. It uses Library Research with a descriptive comparative study approach which explains the definition of Collective Ijtihad, the importance and its position under Islamic Law according to contemporary Islamic scholars. The results have shown that Collective Ijtihad is an agreed Islamic law (fiqh) mechanism upon respectable Islamic scholars (mujtahid) to generate law verdict from recent thematic issues. The earliest step analyzes previous law verdicts from similar cases based on prior Islamic scholars’ notions. The latter work comes into the judgment selection process to produce a decree with most robust yet relevant from available references. Currently, Collective Ijtihad has high gravity in the making of pure tasyri’ (Islamic Law), stationed under original Ijma’ but superior to Qiyas and all Individual Ijtihad yet should be applied as Islamic Law determination method (istinbath) due to relaxed prerequisites and straightforward implementation compare to Individual Ijtihad, which is very influential in deciding contemporary Islamic Legislatio

Telaah Fatwa tentang Nikah Siri
Get PDFThis research discusses about Fatwa regarding Siri Marriage or known as Unregistered Marriage. In the other countries, this phenomenon called ‘Urfi Marriage. This research comprised in normative category because analyzing documents and literatures related to Fatwa regarding Siri Marriage. Qualitative Description is used as an approach to compare between Indonesian Ulema Council or Majelis Ulama Indonesia (“MUI”) with other five Fatwa councils from different countries: (1) Kingdom of Saudi Arabia (“KSA”), (2) Egypt, (3) Jordan, (4) Kuwait, and (5) Libya. The results show that in substance and procedure, Siri or ’Urfi Marriage activities in five nations are indifferent. The distinction only occurs on the naming aspect. Indonesia and KSA have the same terminology which is Siri Marriage, whereas three other countries employ ‘Urfi Marriage expression. From legal perspective, those five nations have similar concept that, if the marriage complies with the Islamic basis and requisite, then it fulfills legitimate sharia condition for marriage in Islam. But, to accomplish rights in civil law, it needs to register the marriage officially in the country’s appointed institution.

No full textThe figure of a Kiai as the director of Ma'had Aly Sukorejo Situbondo is very crucial in motivating lecturers’ work.This research aims to find and to analyze the role and the strategies of Kiai in enhancing the lecturers’ work motivation. It uses a qualitative approach that emphasizes inductive analysis through reduction, presentation, and conclusion. The role of Kiai's leadership in enhancing lecturers’ work motivation at Ma'had Aly Sukorejo Situbondo is in his capacity as a competitive supervisor in every lecturer’s ability to increase personal awareness so can do work based on main duties and functions (TUPOKSI), by giving an example and spiritual guidance before instructing. The Kiai's strategy as the director of Ma'had Aly are holds a meeting with masyayikh, maintain sustainable control to Ma'had Aly 's regulation, buildsan adjacency with all elements (egalitarian), uses uswatun hasanah approach and Sufistic strategies, discipline in carrying out the duties. The positive impact of the strategies of Kiai in enhancing the lecturers’ work motivation at Ma'had Aly Sukorejo is the lecturers respect him more, dare to express their aspirations, but still maintain politeness
