    Implementasi Deposito Spesial Nisbah Perspektif Hukum Islam

    Salah satu produk perbankan syariah yang berbasis tabungan adalah simpanan yang menggunakan unsur maturity. Bank memberlakukan akad mudharabah terhadap simpanan berdasarkan kesesuaian keduanya, yaitu tenggang waktu antara setoran dan penarikan. Masa tenggang ini merupakan salah satu sifat simpanan dalam perjanjian deposito berjangka yang bervariasi antara lain 1, 3, 6, 12, dan 24 bulan. Salah satu jenis DPK yang mencuat perkembangannya adalah Setoran Khusus Nisbah. Dengan kombinasi hasil penelitian dengan beberapa kajian teoritis maka peneliti dapat memahami alur proses keikutsertaan Setoran Khusus Nisbah yang diaplikasikan oleh nasabah dan melakukan penyetoran yang telah mengikuti teori dan bukti Syar'i, serta kesepakatan yang dipraktekkan sesuai dengan ketentuan Syara '. Pada proses awal penentuan bagi hasil, BMI Capem Situbondo terlebih dahulu menghitung HI Per MIL atau HI-1000, yaitu angka yang menunjukkan hasil investasi yang diperoleh dari penyaluran setiap Rp. 1000 dana nasabah, dan pembagian rasio setoran khusus dibagi menjadi 4 level yang memiliki detail berbeda yang valid

    The Students’ Satisfaction of Online Learning Services

    The online learning era found significant momentum when the coronavirus was spreading globally. Innovation, creativity and online learning tools increased significantly and rapidly. All levels of education, from early childhood to university, were racing to provide online learning. This context made the satisfaction dimension of necessity that must be realized by schools/educational institutions. Measurement of satisfaction in learning services was related to five dimensions including reliability, responsiveness, assurance, empathy and tangible. This study aimed to look at the level of satisfaction and the factors that contribute to satisfaction of online learning during the covid-19 pandemic. This study used a qualitative approach with a survey research type based on quantitative descriptive data analysis. The results showed that the average level of satisfaction reached 75%. While, the contributing factors were methods and strategies, and also the discipline and feedback attitudes of the teachers

    Factors for Implementation of Qanun in Aceh Education: Study on Islamic Value-Based Basic Education

    The purpose of this study was to analyze the implementation of the Qanun on the implementation of Islamic values-based education and to interpret the obstacles and supports for implementation. Implementation referred to the content concept and context of Grindle's policies. The research method used a case study approach that was explanatory, with the type of research being descriptive qualitative data analysis. The research findings were: (1)—the implementation of the Qanun based on the principles of national policy. The specific policies of Aceh still guided it, and these principles were squeezed into educational goals and curricula. (2) the supporting factors for implementing the contents of the Qanun represent the interests of the target group, the types of benefits obtained, the type of change desired, and the elite actors in power. In contrast, the obstacles to implementation were the lack of adequate resource support, the absence of derivative policies, the degree of change that had not provided significant results, and the low compliance and responsiveness of implementing agencies

    Islam recommended that all people work and earn a living to meet the needs of themselves and their families. Working for a living in Islam was likened to or equated with people who jihad in the way of Allah. Sharia law strongly recommends investing in halal profit. One form of investment was the sale and purchase of shares, which was a form of cooperation with other parties to obtain profits. Stocks were commodities or assets that can be traded on the stock exchange. Buying and selling shares was nothing new in this country. Transactions such as the stock exchange were regulated and the system was well organized. Buying and selling shares were one of the various types of trading transactions. Buying and selling in an Islamic economy was a business activity that can be seen in many ways, such as fiqh mu'amalah (Islamic economic law). Buying and selling securities showed that someone had ownership of the assets of a company was certainly allowed as long as it is following sharia principles, excluding elements of maysir and so on

    Praktik Leasing di Indonesia dalam Tinjauan Hukum Islam

    The development of leasing in Indonesia was in line with the development of banking, both bank and non-bank institutions. This development was certainly inseparable from the demands and needs of the community that they cannot fulfil on their own. The emerging financing institutions carry out activities in the form of providing funds or capital goods by not withdrawing funds directly from the public. The existence of leasing as a means for developing investment financing and empowering the community's economy was still considered to have several problems. Although the practice of leasing in Islamic law was equated with the contract of ijarah vomitiyah bi at-tamlik, in practice in Indonesia the process of leasing agreement was considered fasid, because there was an element of ambiguity in the contract agreement as regulated in the provisions of multi-aqad agreements, both conventional and sharia.  This research will discuss the practice of financing in the community categorized as leasing under the provisions of applicable law and a review of Islamic law on the implementation of such leasing

    Social Media Acceptability among Ulama in Ogan Ilir District, South Sumatra, Indonesia

    Social media was born as a derivative of information and communication technology (ICT) development. It is stimulating new habits for people to produce, consumption, and distribution information in online interaction. Although many researchers have studied social media, no one has provided attention to social media and ulama (Islamic scholar). This article aims to describe patterns of ownership, access, perceived usefulness, and ease of use of social media among ulama. Based on qualitative research in Ogan Ilir District, South Sumatera Province, we found that the acceptability of social media among ulama in Ogan Ilir District is positive. Online life has become the new identity of ulama in this area. They use social media for broadcasting da’wah message and selling or buying goods and service. However, no ulama are producing their messages of da'wah. Facebook is the most popular social media among ulama. We also find that feeling safe and comfortable, get the real benefits from social media, network quality, and jihad in cyberspace have positive contributions to social media adoption within ulama. We identify the availability of time, audience response, negative content, addictive situations, and internet cost as the inhibiting factor of social media adoption among ulama. We discussed these findings and suggested practical recommendations and agenda for further research

    Pandangan Tokoh NU Jember tentang Hadirnya Wali yang telah Mewakilkan Perwaliannya dalam Majlis Akad

    Tujuan dari penelitian ini adalah untuk mengetahui bagaimana mereka memandang tokoh NU di Jember dan bagaimana mereka memandang hukum Islam tentang keberadaan wali yang mewakili perwaliannya dalam pernikahan anak mereka. Penelitian ini menggunakan pendekatan kualitatif, teknik pengumpulan data yang dipilih adalah wawancara. Hasil studi menemukan bahwa tokoh NU di Jember memiliki sudut pandang yang berbeda. Beberapa tokoh nu berpandangan bahwa wali yang telah mewakili perwaliannya dapat menghadiri upacara dan tidak berpengaruh pada pernikahan selama bukan salah satu saksi nikah, yang lain berpendapat bahwa wali diharapkan untuk meninggalkan upacara, beberapa lainnya Bahkan ada anggapan bahwa wali tidak boleh menghadiri upacara tersebut karena bisa mengakibatkan kontrak tidak sah. Sedangkan dalam pandangan hukum Islam mengatakan bahwa wali yang mewakili perwaliannya diperbolehkan menghadiri akad nikah pada saat akad asalkan tidak menjadi saksi nikah karena dapat dibuat akad tidak sah karena wali memiliki status ganda

    Sengketa Ekonomi Syariah adalah perselisihan antara lain ; orang-perorangan, kelompok orang, atau bahkan badan usaha yang berbadan hukum maupun yang tidak berbadan hukum, yang menimbulkan akibat hukum  antara satu dengan yang lainnya berkaitan dengan kegiatan usaha yang dilaksanakan menurut prinsip Syariah. Konsep sulh (perdamaian) sebagaimana mestinya tersebut dalam berbagai kitab fiqh merupakan doktrin utama hukum Islam dalam bidang muamalah untuk menyelesaikan suatu perkara, dan sudah merupakan condition sine quo non dalam kehidupan masyarakat manapun, karena pada hakikatnya perdamaian bukanlah suatu pranata positif belaka, melainkan berupa fitrah dari manusia. Segenap manusia menginginkan seluruh aspek kehidupannya nyaman, tidak ada yang mengganggu, tidak ingin dimusuhi,ingin damai dan tentram segala aspek didalam kehidupan. Dengan demikian institusi perdamaian adalah bagian dari kehidupan manusia. Undang-undang Nomor 30 Tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa mengatur tentang bagaimana proses penyelesaian sengketa di luar Pengadilan, yakni melalui konsultasi, mediasi, negosiasi, konsiliasi dan penilaian ahli yang menjadi pilihan pelaku usaha untuk menyelesaikan problem yang dihadapi dalam menjalankan bisnisnya

    Investasi Bisnis Porang di Perum Perhutani KPH Bondowoso Perspektif Hukum Ekonomi Syari’ah

    Dalam rangka meningkatkatkan sumber daya hutan, Perum Perhutani Bondowoso membuka kesempatan untuk melakukan mitra kerjasama. Dalam hal ini, PT Bumi Nusantara Coconut telah melakukan perjanjian kerjasama dengan Perhutani dan LMDH Sumber Mas yang berkongsi khusus pembibitan porang. Ada beberapa bentuk kemitraan bagi hasil pengelolaan sumberdaya hutan dengan proses dan ketentuan bagi hasil yang diatur dalam perjanjian, Pertama; Perum Perhutani dengan LMDH bagi hasilnya 70% LMDH, 30% Perhutani. Kedua; ketika melibatkan investor, bagi hasilnya 40% Perhutani, 40% Investor dan 20% LMDH sesuai kesepakatan perjanjian. Sementara, investasi bisnis porang yang terjadi di RPH Pakisan, ketentuan bagi hasilnya masih kurang jelas. Perhutani 30%, Investor 65%, sedangkan LMDH 5% sampai 10%, tergantung pemberian dari Perhutani. Dari hasil analisis data peneliti dapat menyimpulkan bahwa proses dan ketentuan bagi hasil investasi bisnis porang adalah sah, berdasarkan perjanjian kerja sama dan praktek yang terjadi dilapangan, karena tidak bertentangan dengan konsep hukum ekonomi syari’ah yang proses kegiatannya termasuk akad syirkah ‘inan.     Eksistensi Obligasi Syariah (Sukuk) Korporasi di Indonesia pada Masa Pandemi

    This article explained how the existence of corporate sharia bonds (Sukuk) during the pandemic. Sukuk was one of the instruments owned by Islamic financial institutions, namely the Islamic capital market. The existence of the coronavirus had existed for one year. By using the library research method, and using qualitative descriptive, namely the method by describing and interpreting the existence of Islamic bonds (Sukuk) in the pandemic period qualitatively, namely the description and description in words based on library data, journal articles, OJK and related data. The data collection method used the documentation method then the data was processed so that it completes this article. The results showed that the record was the outstanding value of Sukuk from 2016 to January 2021 had increased from 11.88 trillion to 30.25 trillion. Meanwhile, the number of outstanding Sukuk had experienced a good development from 2016-January 2021, namely from 53 to 161. And the accumulated value of Sukuk issuance had also increased, from 2016-January 2021 from 20.43 trillion to 55.15 trillion. Meanwhile, the accumulated number of Sukuk issuances also increased from 102 to 274
