    Legal Validity and Implications of Remarriage During Divorce Proceedings in Indonesia: An Islamic Family Law Perspective

    This study examines the phenomenon of unregistered marriages (sirri) conducted by women who are still undergoing divorce proceedings at the Religious Court of Teluk Nibung. The primary objective is to analyze the legal status of such marriages from the perspective of Islamic law and Indonesian positive law. Employing a qualitative method with a juridical-empirical approach, the research draws on interviews, observations, and document analysis. The findings indicate that remarriage during an unresolved divorce process is driven by socio-economic factors, spousal neglect, and limited legal awareness. From the standpoint of Islamic jurisprudence, particularly within the Shafi’i and Hanbali traditions, such marriages are invalid because the woman is not yet considered a widow in the sharī‘ah sense and has not completed the prescribed iddah period. Under Indonesian statutory law, these practices contravene the principle of monogamy as enshrined in Law No. 1 of 1974 and the Compilation of Islamic Law. This study highlights the incompatibility of the practice with both normative frameworks and underscores the urgent need for legal education and stronger institutional oversight to prevent deviations. The research contributes to the discourse on marriage law by offering a socio-legal perspective that integrates doctrinal analysis with community realities

    Penelitian ini membahas peran Kantor Urusan Agama (KUA) Kecamatan Bojong dalam menanggulangi pernikahan dini melalui bimbingan konseling Islami. Pernikahan dini masih menjadi persoalan serius yang berdampak pada ketidaksiapan mental, ekonomi, dan sosial pasangan muda. KUA sebagai lembaga resmi yang membina keluarga Muslim memiliki tanggung jawab strategis dalam memberikan edukasi sebelum menikah. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan studi kasus. Teknik pengumpulan data dilakukan melalui observasi, dokumentasi, dan wawancara dengan pihak KUA. Hasil penelitian menunjukkan bahwa KUA Bojong secara aktif memberikan Bimbingan Perkawinan (Bimwin) yang berisi materi keislaman dan kesiapan berumah tangga. KUA juga bekerja sama dengan sekolah, desa, dan tokoh masyarakat untuk melakukan sosialisasi. Faktor pendukung pelaksanaan bimbingan ini adalah kolaborasi lintas sektor dan materi bimbingan yang relevan, sementara faktor penghambatnya meliputi rendahnya minat baca remaja dan kurangnya kesadaran akan pentingnya ilmu dalam membina rumah tangga. Secara keseluruhan, peran KUA Bojong cukup signifikan dalam mengedukasi dan menekan angka pernikahan dini di wilayahny

    Artikel penelitian ini fokus mengkaji model komunikasi layanan konseling akademik dalam penguatan minat belajar bahasa Arab melalui perspektif Model SMCR David Kenneth Berlo. Melalui penelitia kepustakaan, ditemukan bahwa model komunikasi SMCR David Kenneth Berlo dapat diterapkan dalam layanan konseling akademik untuk menguatkan minat belajar bahasa Arab peserta didik. Rendahnya minat belajar menjadi tantangan dalam pendidikan, dan layanan konseling akademik hadir sebagai solusi melalui komunikasi interpersonal yang bermakna. Dengan empat komponen utama berupa umber, pesan, saluran, dan penerima, model komunikasi ini membantu konselor memahami aspek psikologis, sosial, dan budaya peserta didik. Model komunikasi SMCR David Kenneth Berlo menjadi wadah pengembangan layanan konseling akademik yang pada gilirannya dapat menguatkan minat belajar bahasa Arab peserta didik

    The Challenges Faced by Indonesian Diaspora Teachers in Applying a Religious Psychology Approach to Teaching at Sangkhom Islam Wittaya School, Thailand

    This study aims to reveal the challenges faced by Indonesian diaspora teachers in applying a religious psychology approach to teaching at Sangkhom Islam Wittaya School, Thailand. Using a qualitative approach, this research employs a case study method involving observation, in-depth interviews, and document analysis. The research subjects consist of Indonesian diaspora teachers teaching at the school. The results show that teachers face challenges in the form of cultural differences, language barriers, adaptation to the local curriculum, and difficulties in integrating religious values with students' educational needs. Additionally, support from the school and local community plays a crucial role in helping teachers overcome these challenges. This study contributes to the development of more effective teaching strategies for Indonesian diaspora teachers, especially in religious-based schools abroad.Â

    This research aims to analyze property ownership and social responsibility. Through a thematic exegetical approach (tafsir maudhui), this research examines the status of wealth in the Qur'an, the concept of wealth ownership in the Qur'an, and the implementation of property rights as a form of social responsibility. The research findings indicate that 'Mal' (wealth) is mentioned in the Qur'an, with its various derivations, 87 times.  Wealth (al-Mal) itself is defined as anything that possesses legal and concrete (a'in) value, is generally desired by human nature, can be owned, stored, and utilized.  Islam views wealth as something highly important in human life, to the extent that Sharia designates it as one of the five essential matters that must be fulfilled, protected, and considered to realize human well-being in this world and the hereafter; property ownership, based on the Qur'anic concept, manifests as wealth for economic activity, as an indicator of collective welfare, and includes prohibitions against hoarding and consuming wealth unjustly.  A Muslim who possesses wealth is commanded to help others as a form of social responsibility. Islamic teachings command its adherents to disburse a portion of their wealth in the form of zakat, infaq, and sadaqah.This research recommends that everyone distribute a portion of their wealth according to the guidance of the Qur'an. Zakat, infaq, and sadaqah, disbursed as a form of social responsibility, reflect humanity's chosen role in managing the wealth entrusted by Allah SWT

    Membaca Al-Qur’an menjadi suatu keharusan bagi tiap kaum muslim. Adanya pengajaran sejak dini diharapkan agar kaum muslim dapat mengetahui serta memahami bacaam yang dibaca ketika beribadah kepada Allah.banyak sekali metode yang digunakan untuk belajar membaca Al-Qur’an, salah satunya metode tartil. Tujuan dari penelitian ini adalah untuk mengetahui apakah ada efek dari penerapan metode Tartil pada kemampuan membaca Alquran Santri Madrasah Diniyah Nurul Hidayah Tanah Merah Bangkalan. Untuk mencapai tujuan ini, Pendekatan penelitian kuantitatif digunakan. Total populasi adalah 30 siswa di Madrasah Diniyah Nurul Hidayah Tanah Merah Bangkalan kelas III-VI. Si Sampel yang diambil adalah seluruh kelas III-VI dari populasi, yaitu 30 siswa. Metode yang digunakan dalam penelitian ini adalah observasi, angket, dan dokumentasi. Sedangkan untuk pengolahan data uji validitas menggunakan rumus regresi linier sederhana. Hasil penelitian ini menunjukkan bahwa variabel metode tartil berpengaruh positif dan signifikan terhadap kemampuan membaca Alquran. Angka R kuadrat 0,445 menunjukkan bahwa pengaruh penerapan metode Tartil terhadap kemampuan membaca Alquran siswa adalah 44,5%, variabel kemampuan membaca Alquran siswa dipengaruhi oleh penerapan metode Tartil, sisanya 55,5% oleh variabel lain

    This study examines the professionalism of Islamic Education (PAI)teachers as a pillar of character education in the era of globalization.The research employs a qualitative descriptive approach with aliterature review method, analyzing various sources, including journalarticles, books, and official documents. The findings highlight that PAIteachers play a crucial role in shaping students’ character throughmoral education, role modeling, and guidance. However, challengessuch as the rapid advancement of technology, cultural shifts, and thelack of teacher training hinder the effective implementation of charactereducation. To address these challenges, teachers must integrateinnovative teaching strategies, utilize digital learning tools, andcollaborate with parents and the community. This study underscoresthe necessity for continuous teacher development to ensure thatcharacter education remains relevant and effective in the face ofglobalization.Â

    The Rights of Indigenous Law Communities in Forest Management in the West Seram Regency: A Perspective of National and Customary Law

    Recognition of indigenous legal communities as legal subjects with rights over their territories and natural resources is a constitutional mandate, as stipulated in Article 18B, paragraph (2) of the 1945 Constitution of the Republic of Indonesia. In West Seram Regency, indigenous legal communities have a traditional governmental structure that manages customary forests as part of the territorial domains. This article aims to analyze the implementation of the rights of indigenous legal communities in forest management from a constitutional perspective and local practices. The research method used is a juridical-empirical approach with data collection techniques through literature study and interviews with local leaders and regional officials. The research findings indicate that although there is a normative recognition of the rights of indigenous peoples, the implementation at the local level, especially in West Seram Regency, still faces regulatory, administrative, and political obstacles. This causes the legal status of customary forests to be unclear and vulnerable to overlap with state claims or corporate permits. Therefore, affirmative steps are needed from local governments through regional regulations and collaborative programs that strengthen the position of indigenous communities as key actors in the management of forests based on local wisdom. The local wisdom of customary law communities, accumulated throughout the history of the development of customary law communities, plays a significant role for the customary law communities and their rights, including communal land rights both in marine and terrestrial areas.Â

    Telematics in Global Digital Trade: A Case Study of Temu and Shein and Its Implications For E-Commerce Regulations in Indonesia and UNCITRAL

    Digital trade has rapidly developed with the support of telematics technology, which enables connectivity among economic actors worldwide. Major e-commerce platforms like Temu and Shein leverage this technology to accelerate product distribution and expand their market reach. Temu, with its business model that directly connects producers and consumers, reduces distribution costs and speeds up delivery. Shein, which adopts a fast fashion model, utilizes telematics-based applications to enhance the speed of production and distribution, as well as to quickly respond to fashion trends. Nevertheless, the global e-commerce sector faces significant regulatory challenges, particularly concerning digital taxation, consumer protection, and personal data protection. In Indonesia, these regulatory challenges become more complex due to cross-border digital transactions involving international platforms that do not fully comply with local regulations. Therefore, this study aims to analyze the role of telematics technology in supporting global digital trade and its impact on e-commerce regulatory policies, as well as to propose policy measures to address the existing challenges. This research uses a qualitative approach with document analysis and literature review from various related sources. The findings indicate that regulatory updates and stronger international cooperation are crucial to addressing cross-border e-commerce regulatory challenges and enhancing consumer protection and fair implementation of digital taxation

    Climate Constitutionalism in Indonesia: Legal Pathways for Climate Action

    Climate change constitutes a multidimensional environmental and constitutional challenge that demands coherent legal frameworks capable of guiding state responsibility in mitigation and adaptation efforts. This study examines Indonesia’s climate governance through the lens of climate constitutionalism, focusing on how constitutional norms, legal institutions, and policy structures shape the state’s climate obligations. Employing a normative-empirical approach, the research analyzes constitutional provisions, statutory regulations, judicial decisions, and international climate agreements, complemented by institutional reports and selected case studies. The findings reveal that although Indonesia’s Constitution recognizes the right to a good and healthy environment, fragmented legal frameworks, institutional layering, and weak inter-sectoral coordination undermine the effective realization of substantive climate rights. The absence of an explicit constitutional interpretation linking climate obligations to fundamental environmental rights further limits state accountability and constrains the integration of intergenerational and ecological justice into national policy. This study argues that strengthening climate governance does not require a formal constitutional amendment but rather a reinterpretation of constitutional duties through the lens of climate justice. By articulating climate constitutionalism as a normative and institutional pathway, this research contributes to the broader discourse on constitutional environmentalism and offers a context-sensitive model for Global South countries seeking to align domestic legal systems with climate imperatives. Future reforms should prioritize institutional coherence, enhanced judicial engagement, and meaningful public participation to ensure that constitutional environmental commitments translate into enforceable and measurable climate action
