INDONESIA-MALAYSIA’S LEGAL PROTECTION FOR BUSINESSES UNDER THE COD (CASH ON DELIVERY) PAYMENT SCHEME IN THE MARKETPLACE
Get PDFABSTRACTThe COD (Cash on Delivery) can impact cash flow due to payment delays, especially for businesses with tight margins. In order to address the issue of business actors' legal protection when using COD as a payment mechanism in the marketplace, this paper seeks a solution. Research on laws and other relevant legal literature is done by the author as part of the normative juridical legal research approach used to write this publication. To make corporate operations more productive and efficient, Marketplace aims to reduce their unnecessary complexity. With the marketplace emerging, everyone may now purchase and sell goods and services with ease, at a low cost, and in a timely manner, as there are no restrictions on location, time, or distance. Â There are numerous payment methods available in the marketplace, one of which is COD (Cash on Delivery), which allows customers to pay directly on the spot when they receive the things they ordered. However, in practice, the parties who transact in the Marketplace frequently suffer significant losses, necessitating the existence of legal protection for the parties that transact in the Marketplace, both consumers and business entities, in order to protect their rights
APLIKASI MAá¹¢LAHAH MULGAH SEBAGAI METODE ALTERNATIF PENETAPAN HUKUM PROGRESIF
Get PDFThis article examines maá¹£lahah mulgah as an alternative method of establishing progressive law, in resolving contemporary legal cases in Indonesia. The problem is that maá¹£lahah mulgah has so far been underestimated in the ushul fiqh method. The research approach used is qualitative, with a literature study on the application of maslahah mulgah, rules or norms in Islamic law. Meanwhile, the analysis techniques used are qualitative content analysis and holistic interpretation. The results of the discussion show that Maá¹£lahah mulgah can be applied to contemporary legal problems that continue to occur in various aspects by considering the dimensions of the spirit of shari'ah, maqaá¹£id al-syari'ah, maá¹£lahah al-'ammah, and tagayyur al-azminah da al-amkinah, especially on legal problems that fima la naṣṣa fih, and sukut al-Syari 'an syar'iyyah al-'amal ma'a qiyam al-ma'na al-muqtaá¸a lah. Islamic Education is a lesson that provides material in the form of writing and reading the Qur'an which makes sleepy. If this is allowed, it will produce a young generation that is lazy, less intelligent, and less competent. When students' participation is passive, the teacher will be considered a failure in teaching and inappropriate in choosing learning methods. Motivation is the main benchmark of the success of a learning process. Motivation will be formed if there is an intention within us to make students active in the classroom. Teachers must also find ways to make PAI learning interesting so as to generate student learning motivation. This research uses a collaborative method between qualitative and quantitative, where the data we get is sufficient to answer the puzzle of the object to be studied. The author took the research title as above because he wanted to prove that the cooperative learning model of Jigsaw method developed will make learning more interesting and can increase students' learning motivation wherever they are. Get PDFThis study aims to find out the da'wah strategy used by Muhammad Faizar on the social media platform YouTube. This research has a focus on increasing Muslim awareness of Islamic teachings. The technique used is a framing analysis technique in collecting data from videos uploaded by Muhammad Faizar to identify and evaluate important elements in forming his da'wah strategy. Content in the form of videos is thoroughly analyzed by considering the type of content, the use of language, interactive approaches, and the use of social media. This da'wah strategy brings the dai and mad'u closer to each other allowing the exchange of ideas and ideas, giving the mad'u the opportunity to ask questions and give feedback. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif untuk mendeskripsikan peran dari media dan komunikasi dalam membentuk persepsi investor terhadap citra dari investasi syariah, dengan teknik pengumpulan data yang digunakan yaitu literatur dan studi pustaka. Hasil penelitian ini menunjukkan bahwa media dan komunikasi memainkan peran penting dalam membentuk persepsi investor terhadap citra investasi syariah. Informasi yang disampaikan melalui media dan komunikasi dapat mempengaruhi minat dan pengetahuan investor terhadap investasi saham. Harmonization of Islamic Law and Customary Law in the Pambissa Kampong Tradition in Latimojong Village
Get PDFThe research aims to determine the role and influence of Islamic law in the implementation of the pambissa kampong tradition in Latimojong, the adaptation and change of customary law in the pambissa kampong tradition and its impact on the sustainability of this tradition, and the process of harmonization of Islamic law and customary law in the pambissa kampong tradition and the factors that influence it. The type of research used is empirical legal research. To support this empirical legal research, a normative approach and a sociological approach are used. Shows: (1) The role and influence of Islamic law in the implementation of the Pambissa Kampong Tradition in Latimojong is that customary law adopts Islamic law in its entirety, both in terms of principles and in terms of implementation. Its implementation is adjusted to Islamic law. If there are differences in principle between Islamic law and customary law, then the implementation of Islamic law must be a priority. (2) Changes in customary law in the Pambessa Kampong tradition and its impact on the continuity of this tradition are customary law, which means that rules are made from the behavior of a growing community and developed until it became a law that was obeyed unwritten. So that customary law changes according to the conditions prevailing in society. (3) The process of harmonization of Islamic law and customary law in the Pambessa Kampong tradition and the factors that influence it. Harmonization in question is an effort to harmonize customary law and Islamic law in one national legal system. If all this time there seems to be a difference between customary law and Islamic law, it is urgent to restore harmony between the two

This study aims to determine the application of religious moderation in educational institutions, to find out the concept of local wisdom of the Bugis community, to determine the correlation of Islamic education with local wisdom of the Bugis community, to find out the optimization of religious moderation in supporting SDG's based on local wisdom of the Bugis community. The type of research that the author used in this study was qualitative research. Qualitative research is a study aimed at describing and analyzing phenomena, events, social activities, attitudes, beliefs, perceptions, thoughts of people individually and in groups. The approach used in this study is a sociological approach and a psychological approach. This research was conducted at SMA Negeri 13 Bone. The data analysis is carried out in stages; data reduction, completing the selection of collected data based on the relevance of the research topic; presentation of data, displaying data according to the problems discussed in this study; and verification or drawing conclusions, making corrections and checking with relevant sources and journals so that conclusions can be made. The results showed a lack of student understanding related to religious moderation, so optimization, introduction and socialization to students are needed in order to be able to understand religious moderation well as supporting the realization of SDG's

No full textABSTRACTThis study aims to identify the stages of the Human Resources Management Model (HRM) at Dayah Modern Yapena Lhokseumawe, including 1) Recruitment Management, 2) Placement Management, 3) Development Management, and 4) The Effect of HR Management on Graduate Quality. The research used descriptive qualitative methods with data collection techniques through observation, interviews, and documentation. The results showed that the recruitment process includes mapping skills needs, closed announcements, oral and written test selection, and work orientation. Placement of educators according to qualifications, and various development programs have been carried out, such as language training and fiqh programs. Internal evaluations are conducted twice a year and externally four times a year, despite workload and budget constraints. The quality of graduates has proven to be very good with many alumni being accepted into reputable universities and student achievements in various competitions.Â
Temporary Waqf in Indonesia: Legal Basis and Implementation Challenges
Get PDFThis research aims to analyze the concept and implementation of temporary waqf by Law Number 41 of 2004 and evaluate the experience of the Darul Waqf Al-Hadiy Foundation in managing such waqf. The research method used is qualitative with an Empirical Law type, involving data collection through interviews and observations and qualitative descriptive analysis of primary and secondary data. The research results indicate that based on Law Number 41 of 2004, temporary waqf is permitted and regulated. However, implementing temporary waqf at the Darul Waqf Al-Hadiy Foundation faces various challenges, including difficulties in creating sustainable programs, high rehabilitation costs, and administrative complexity. Although temporary waqf provides significant benefits for Islamic religious education and the welfare of the local community, its management requires better education and improved competency for nazhir. More effective and sustainable waqf management can be achieved if the nazir has adequate experience and capabilitie
