Get PDFThe high rate of divorce that occurs in society is caused by several factors, including; due to disharmony, no responsibility, and economic problems. Among divorce cases, the most filed for divorce are from the wife. There are several reasons for divorce regulated by Islamic Law, Marriage Law Number 1 of 1974 in conjunction with Law Number 9 of 1975, and the Compilation of Islamic Law, including, disputes and quarrels that occur continuously as reasons for divorce. However, Islamic Law, Marriage Law Number 1 of 1974 in conjunction with Government Regulation Number 9 of 1975, and the Compilation of Islamic Law, do not explicitly stipulate in detail the minimum time limit for marriage to be able to file for divorce for this reason, and there is no explanation any reason belongs to the constant strife and bickering. This causes multiple interpretations, because the scope is too broad, so many things are used as reasons for disputes and fights for divorce, and later it can become one of the drivers of divorce which is too easy to do in people's lives. The Marriage Law cannot determine a minimum time limit for disputes and continuous bickering as reasons for divorce, because divorce is a human right
Self Actualization of MOSMA Participants in Maintaining Cultural Identity in Scotland, United Kingdom
Get PDFThe importance of preserving and maintaining cultural identity has become a major highlight amidst ever-growing globalizations. In the context of student exchange, an interesting initiative has emerged in the Mora Overseas Student Mobility Award (MOSMA) program. This research aims to abstract the contributions and experiences of MOSMA participants in efforts to maintain Indonesian cultural identity in Scotland, United Kingdom. This research uses qualitative research methods with participant observation. Data collection was carried out by conducting in-depth interviews with MOSMA participants from various backgrounds. The research results show that MOSMA is not only a program for learning in the academic field but also a place to gain in-depth cultural experiences. MOSMA participants are actively involved in various activities, such as regular international student meetings, cultural discussions, introductions to traditional music and songs, all of which play an important role in maintaining and introducing Indonesia's cultural identity abroad. Apart from that, MOSMA also provides a platform to develop social skills, independence and a sense of belonging to the nation's cultural heritage. Through MOSMA, participants can feel a sense of pride in Indonesia's cultural identity, thereby strengthening their commitment to passing it on to future generations. In conclusion, MOSMA has proven itself as an effective program initiative in maintaining and strengthening Indonesia's cultural identity amidst globalizations. By continuing to provide adequate support and attention, MOSMA has the potential to become an inspiring model in maintaining cultural diversity throughout the world
Forensic Stylistic Analysis of UNNES Student’s Suicide Note
Get PDFSuicide notes are powerful pieces of evidence in suicide cases that left by individuals who commit suicide or who intend to commit suicide as massages, with the purpose is to voicing the victims’ feelings that remain unknown by people when they are alive. This study investigates the linguistic features contained in the suicide note written by UNNES student by using descriptive-qualitative as the research method and applying Prokofyeva's theory of suicide notes linguistic features. The suicide note is available and can be accessed online. This study aims to analyze the forensic stylistic approach towards suicide notes by showing the characteristics of linguistic features and interpreting the messages delivered by the victims on suicide notes. The researchers classified and described the data in five distinguished characteristics of linguistic features found in the suicide note; clear reasoning, expressing emotions, text structure, grammar, and punctuation. The findings revealed that all the features are present in the suicide note, yet the researchers found that there are different tenses used in the suicide note. The results found only ellipsis in the victim’s suicide note. The data findings in this research may assist future research regarding the study of forensic stylistics, specifically in investigating suicide notes
AN INVESTIGATING OF YEMEN EFL LEARNERS’ WRITING PROBLEMS
Get PDFThis study attempts to investigate the writing problems encountered by Yemeni EFL learners. The sample of the study comprised 70 undergraduate students from Sana’a University. The data were collected using a questionnaire to identify Yemeni EFL Learners’ Writing Problems. The results of the study indicated that students have some crucial problems when writing a paragraph or an essay. The results showed that the participants faced difficulty in planning or outlining the points before writing a paragraph or an essay. Furthermore, they faced difficulties in developing a good topic sentence for a paragraph and a thesis statement for an essay, writing supporting sentences to support the topic sentence, organizing ideas together in a unified and coherent manner, and writing a concluding sentence/concluding paragraph that summarizes the points of a paragraph or an essay. The study proposed some recommendations and suggestions to help Yemeni EFL learners to overcome their writing problems

The increasingly widespread development of the digital era has resulted in changes to payment systems that provide services that facilitate economic activity. This also has an impact on people's economic behavior. The emergence of cryptocurrencies or cryptocurrencies as digital currencies has almost the same function as other currencies. The difference is, cryptocurrency itself does not have a physical form like currency but is in the form of a block of data bound by a hash as validation. Even though its presence has a very good impact on its users, it is still a matter of debate both in terms of regulation and legality, especially from the perspective of Islamic law for its users. This research discusses buying and selling crypto shares from the perspective of muamalah fiqh. The method used in this research is library research with a qualitative approach. The results of this research want to show the provisions of Crypto law according to scholars because they relate to buying and selling in the view of muamalah fiqh. It is hoped that the implications of this research will be able to become a reference for crypto players and the general public to open up insight into the laws of buying and selling Crypto from the perspective of muamalah fiqh.
Abstrak
Perkembangan era digital yang semakin meluas, sehingga mengakibatkan terjadinya suatu perubahan pada sistem pembayaran yang memberikan layanan yang memudahkan aktivitas perekonomian. Hal ini juga berimbas terhadap perilaku ekonomi masyarakat. Kemunculan mata uang kripto atau cryptocurrency sebagai mata uang digital, memiliki fungsi yang hampir sama dengan mata uang lainnya. Bedanya, mata uang kripto sendiri tidak memiliki bentuk fisik seperti mata uang kartal tetapi berupa block data yang diikat oleh hash sebagai validasinya. Walaupun kehadirannya sangat berdampak baik bagi penggunanya, tetapi masih menjadi perdebatan baik dari segi regulasi maupun legalitas, terutama dari perspektif syariat Islam untuk penggunanya. Penelitian ini membahas mengenai jual beli saham crypto dalam perspektif fiqh muamalah. Metode yang digunakan pada penelitian ini adalah library research dengan pendekatan kualitatif. Hasil dari penelitian ini ingin menunjukkan ketentuan hukum Crypto menurut para ulama karena berkaitan jual beli dalam pandangan fiqh muamalah. Improving Consumer Legal Protection in E-Commerce: Analysis of Shopee's Policies and Mechanisms in Combating Counterfeit Products
Get PDFOnline marketplaces like Shopee offer unrivaled access to global products in the digital era. Online marketplaces have become the primary means of buying and selling, making it easy for consumers to obtain various products. However, this convenience also brings challenges, especially regarding legal protection for consumers. One of the problems that often arises is the sale of products that do not match the description. This study evaluates Shopee's policies and mechanisms in ensuring product authenticity and handling consumer complaints related to counterfeit goods. Using a qualitative approach with document analysis, this study explores Shopee's merchant agreements and consumer experiences. The research findings show that despite its strict policies, there are still gaps in the enforcement and complaint resolution mechanisms, which contribute to consumer distrust. There are still many cases of goods purchased by consumers that do not match the description, which is detrimental to consumers. Law Number 8 of 1999 concerning Consumer Legal Protection explicitly regulates consumer rights, such as obtaining open information from sellers. This gap requires an evaluation of the effectiveness of consumer protection policies against counterfeit product fraud cases. Recommendations provided include improving the verification process, proactive monitoring, and transparency in sanctions to strengthen consumer legal protection. This research contributes to the importance of consumer legal protection in e-commerce, offering insights for policy improvement and empowering consumers to navigate online transactions safely
PENYELESAIAN KDRT BERBASIS RESTORATIVE JUSTICE PADA KEPOLISIAN RESORT SINJAI PERSPEKTIF HUKUM ISLAM
Get PDFThis research examines the problem of domestic violence within the Sinjai Police Department. The aim of the research is to reveal the views of Islamic law on the mechanism for resolving domestic violence using the theory of restorative justice within the Sinjai Police Department. Qualitative research method with a normative and empirical approach, supported by primary data sourced from interviews, observation and documentation. As well as, secondary data sourced from legislation, National Police Regulations, the Koran, and related literature. The research results show that: First, the mechanism for resolving domestic violence cases using a Restorative Justice approach at the Sinjai Police is through the stages of complaints/reports from the public, providing victim protection, then investigators taking statements from victims or witnesses, and conducting an investigation of the crime scene. After that a case was filed. Apart from that, investigators use mediation. If you agree to make peace, a statement letter will be made to maintain the unity of the family, and the investigation will be stopped as part of restorative justice efforts. Second, the mechanism for resolving domestic violence cases using restorative justice from an Islamic legal perspective as an effort to provide the best for perpetrators and victims in accordance with the justice they expect. Whether the decision to reconcile or divorce has also been regulated in the Koran and is in accordance with the restorative justice mechanism

This research uses a descriptive qualitative method with a literature study approach. Data was collected from various literary sources, including scientific journals, books, and the works of Islamic education figures, which were analyzed descriptively-analytically.The research results show that Islamic guidance and counseling is effective in overcoming learning difficulties through strengthening Islamic values, individual strategies, collaboration with parents, and technology integration. This approach not only solves academic problems, but also helps build students' spiritual mentality. The originality of this research lies in the integration of Islamic values with modern guidance strategies, creating a counseling model that is adaptive to the challenges of education in the era of globalization.The implication of this research is the importance of strengthening counselor competence, using technology in counseling, and empowering the role of families in supporting the learning process. Digital Economy and MSMEs’ Revenue: Moderating Role of Internet Literacy

This study employed data from 100 MSMEs through Random Sampling and analysis with SPSS software version 26. The results highlight a significant positive correlation between the digital economy and revenue increase, showcasing its role in expanding product marketing through online platforms like e-commerce and facilitating online payments, thus enhancing business efficiency, customer service, and communication. Moreover, the digital economy streamlines sales data recording and analysis, enabling targeted product innovation to directly boost revenue. Notably, internet literacy moderates this relationship, emphasizing the importance of sharing information and knowledge to maximize the benefits of digital tools like online marketing and e-commerce. This underscores the critical need for accessible and affordable internet infrastructure to support SMEs in leveraging digital technologies effectively. The practical implications suggest fostering internet literacy among SMEs and prioritizing initiatives to enhance internet accessibility can significantly contribute to revenue growth, bolstering their competitiveness and sustainability. Policymakers and stakeholders should thus prioritize efforts to provide necessary support and training programs aimed at empowering SMEs to harness the potential of the digital economy for sustained growth and development
