Igboland, Jewishland? : separatism-based religion in the "Promised Land"
No full textThis article examines the role of Jewish identity in the Igbo nationalist movement under the Indigenous People of Biafra (IPOB), a separatist group founded in 2012 by Nnamdi Kanu to restore the defunct Republic of Biafra (1967–1970). This article's argument is supported by the concept of redemptive separatism, arguing that IPOB constructs a national religious identity to seek political and moral legitimacy. Unlike previous groups, IPOB's nostalgic and divine narratives are realized under their objective to establish a Biafran Jewish state. This study finds that Kanu's rhetoric has shaped a religious nationalist identity in both Israel and Nigeria, to argue that the Igbo are God's chosen people and to garner further support. Separation of the Statement of the Administrative Decisions in International Protection Case
Get PDFTento článek se zabývá problematikou oddělitelnosti výroků správních rozhodnutí ve věci mezinárodní ochrany. Poukazuje zprvu na rozdíly obou forem mezinárodní ochrany a popisuje jejich vztah. Následně shrnuje na pozadí několika procesních situací možné oddělení výroků v těchto věcech – především oddělitelnost výroků v případě neudělení žádné z forem mezinárodní ochrany, oddělitelnost výroků v případě udělení doplňkové ochrany a oddělitelnost výroků v případě odnětí azylu či doplňkové ochrany. Tyto procesní situace jsou rozebrány v kontextu dosavadní judikatury správních soudů. Článek se zabývá také důsledky této (ne)dělitelnosti výroků správních rozhodnutí a dopady judikatury správních soudů do správní praxe, především pokud jde o udělení azylu osobě požívající doplňkovou ochranu.This article analyzes the obligation to issue two separate statements in administrative decisions on international protection. It first points out the differences between the two forms of international protection and describes their relationship. It then summarises, against the background of several procedural situations, the possible separation of statements in these cases – in particular, the separation of statements in the case of not granting either form of international protection, the separation of statements in the case of granting subsidiary protection and the separation of statements in the case of withdrawing asylum or subsidiary protection. These procedural situations are discussed in the context of the existing case-law of the administrative courts. The article also discusses the consequences of this (non)separation of the statements of administrative decisions and the implications of the case law of the administrative courts for administrative practice, especially as regards the granting of asylum to a beneficiaries of subsidiary protection status
ECHR and Sentencing Sexual Violence: Well Meant, Poorly Executed?
Get PDFČlánek kriticky diskutuje závěry dvou nedávných významných rozsudků Evropského soudu pro lidská práva (věci M.G. proti Litvě a Vučković proti Chorvatsku), které se týkají trestání sexuálního násilí. V obou případech ESLP shledal, že tresty uložené národními soudy byly nepřiměřené závažnosti spáchaných trestných činů (zejména kritizoval uložení podmíněných trestů odnětí svobody) a kritizoval úroveň odůvodnění trestů. Učinil tak však bez toho, aby dostatečně rozvedl, na základě čeho posoudil přiměřenost trestu a kvalitu jeho odůvodnění. Detailní analýzou principů posuzování přiměřenosti trestu a kvality odůvodnění a empirických výzkumů článek dokumentuje nepromyšlenost závěrů učiněných ESLP. Článek tak vyjmenovává, jaká rozhodnutí vrcholné soudy musí učinit, chtějí-li dojít k závěru, že trest je nepřiměřený či nekvalitně odůvodněný, a jaké důsledky tato jednotlivá rozhodnutí mají pro rozhodování o podobných věcech. Na závěr článek diskutuje možnosti postupu českých soudů v reakci na rozebrané rozsudky ESLP.The article critically discusses the conclusions of two recent landmark judgments of the European Court of Human Rights (M.G. v. Lithuania and VuĊković v. Croatia) concerning sentecing sexual violence. In both cases, the ECtHR found that the sentences imposed by national courts were disproportionate to the seriousness of the crimes committed (in particular, it criticised the imposition of suspended prison sentences) and criticised the level of justification for the sentences. It did so, however, without sufficiently explaining the basis on which it assessed the proportionality of the sentence and the quality of the reasoning. Through a detailed analysis of proportionality principles and principles of proper sentence justification, the article documents the unsophisticated nature of the conclusions reached by the ECtHR. The article thus enumerates the decisions that the highest courts must make if they wish to conclude that a sentence is disproportionate or poorly justified, and the implications of these individual decisions for the adjudication of similar cases. Finally, the article discusses the possibilities for the Czech courts to act in response to the ECtHR judgments discussed
Supportive parenting and adolescents digital citizenship behaviors: The mediating role of self-regulation
No full textA plethora of studies have shown that parenting practices can lead to problematic Internet use. However, few studies have explored how parents foster positive online behavior in adolescents. This study addresses this gap by using self-determination theory to examine how supportive parenting practices, such as autonomy support and structure provision, can influence digital citizenship behaviors in adolescents. The study considered the mediating role of adolescents’ self-regulation, and examined how sex and adolescence stage moderate these relationships. The study included 570 Mexican adolescents (48% girls and 52% boys), and structural equation modeling and multigroup invariance statistics were conducted for analysis. The results showed that autonomy support was positively associated with all dimensions of digital citizenship, while structure provision was only positively associated with online civic engagement. Self-regulation was found to mediate the relationship between autonomy support, structure provision, and digital citizenship behaviors. The multigroup analysis confirmed that sex and adolescence stage did not affect the relationship between parenting practices and digital citizenship behaviors. Overall, the results suggest that supportive parenting practices can encourage positive digital citizenship behaviors among adolescents
