Juridical Analysis on the Effectiveness of Customary Court Mukim in Resolving Customary Disputes in Sabang City
This research aims to explain and analyze the effectiveness of the Mukim customary court in resolving customary disputes in Sabang City, located in the Aceh Province. The study employs an empirical juridical approach, utilizing literature review and interviews with respondents and informants. The study's location includes Mukim Sabang, Mukim Iboih, Mukim Ie – Meulee, and Mukim Balohan. The findings indicate that although the Mukim customary judicial system is supported by a robust legal framework, such as Law No. 11 of 2006 on Aceh Governance, Aceh Qanun No. 10 of 2008 on Customary Institutions, Qanun No. 4 of 2003 on Mukim Governance, and specifically, Sabang City Qanun No. 6 of 2010 on Mukim Governance, the Mukim customary court in Sabang City has not been operating effectively. Several factors contribute to this, including the lack of public awareness of the existence of the Mukim customary court, poor coordination between village and Mukim officials, inadequate facilities and infrastructure within the Mukim government, and difficulties encountered by the Mukim customary court in resolving disputes. Therefore, the support and involvement of the Sabang City local government are necessary to improve the effectiveness of the Mukim customary court, especially concerning the role of Mukim in resolving customary disputes by providing sufficient facilities and infrastructure to the Mukim in Sabang City. Additionally, attention should be given to the Sabang City Customary Assembly as the supervisory body for Mukim customary law, to better oversee the customary laws and their developments in Sabang City.
Islamic Law Study on Paylater Payment System in E-Commerce in Indonesia
With the development of information technology, e-commerce transactions are increasingly used and scoped. Currently, people prefer things that are practical and do not take time, so that the development of technology and the internet is felt by people around the world. The system of purchasing goods through e-commerce by means of payment through PayLater has become a matter of discussion in the wider community, especially in Indonesia where the majority of people embrace Islam. The research used is normative, with a descriptive type of analysis. While the problem approach is a normative juridical approach. The data used include primary, secondary, and tertiary legal materials which are then analyzed qualitatively. According to Islamic law, debt receivables are a form of muamalah permitted by Shari'a, but on the other hand, the implementation of muamalah must be carried out with caution so as not to contradict the provisions of Islamic Shari'a which in essence must not harm both parties to the transaction. The PayLater payment system in e-commerce in Indonesia is actually not a problem, as long as the agreed contract does not require an element of usury
The Expectations of eSport Becomes Part of Sports
The development of science and technology in the 21st century is increasingly rapid, as can be seen by the race of telecommunications companies to create communication tools that offer convenience. As a global industry considered from a financial perspective, eSport is receiving attention from various circles and is being developed to increase competition interest and financial benefits. Sports usually include forms of physical exercise that require strength, endurance, and motor skills. Sports and eSport are different. eSport players don't always move physically despite participating in competitions and rivalries. According to some experts, eSport are a subset of sports. The method used is library research in the form of article review. The implementation of library research consists of investigating, mapping, combining, and evaluating previous research findings on a particular topic or field of knowledge. This method uses various sources of information, including primary articles (n=29). The point is that eSport players tend to be sedentary lifestyle players, which results in problems with fitness and health, so it is not in accordance with the impact of traditional sports physical activities that use large muscles to move body parts while moving. The status of eSport in sport is being questioned in Sport Science studies, as it does not have a positive impact on the fitness and health of eSport players unlike traditional sports athletes. It is increasingly clear that eSport should be seen as electronic entertainment and competition rather than as part of a sport that includes dominant physical activity
The Cultural and Semiotics Dimensions of Benjang Helaran on the Three Elements of Wirama, Wirasa and Wiraga
Benjang Helaran is a traditional Sundanese performance art which offers a rich representation of the cultural and semiotic dimensions embedded within Sundanese society. This paper examines Benjang Helaran through the three foundational elements of Sundanese dance: Wirama (rhythm), Wirasa (emotion), and Wiraga (physical movement). These elements are not only essential to the structure and performance of the dance but also serve as semiotic tools that convey complex cultural meanings and social values. This paper explored the interconnection between dances (movement) to semiotics dimensions. The theories applied in this paper were Blanariu (2023) regarding deeper meanings encoded within the movements, costumes, and music of Sundanese dance and Indraswara (2024) about Benjang in aspect of culture and local wisdom. The findings showed that Wirama reflected the harmony between the dance and the natural cycles, symbolizing cosmic order and community balance. Meanwhile Wirasa let dancers to communicate feelings and spirituality, creating a connection between performers and the audience. The last part was Wiraga; embodied Sundanese ideals of beauty, discipline, and grace, each gesture and posture carrying symbolic weight within the cultural narrative. Through this exploration, the paper argues that Benjang Helaran, when analyzed through the triad of Wirama, Wirasa, and Wiraga, functions as both a cultural artifact and a semiotic system. It not only preserves and transmits Sundanese cultural identity but also communicates complex messages about societal values, beliefs, and emotional experiences. This integration of cultural and semiotic dimensions underscores the deep interconnection between performance and meaning in Sundanese traditions
The Role of Legal Institutions in Compensating for Damages Caused to Spiritual Personality
The issue of damages is one of the most challenging topics, which is stated as necessary in the principles of current laws and regulations; But how to compensate and how to evaluate it has not been determined. In the legal systems of different countries, there are ways to compensate for moral damage; However, there is no fixed and specific criteria for the methods of compensation for moral damage. The author believes that according to the foundations of Islamic law and Iranian law, the ability to compensate moral damage and the way to compensate it can be justified and inferred as follows: Spiritual damage and its compensation methods are cited In addition to the rule of harmless reason, another prediction of dowry in the case of physical injuries leads to moral damages. Rationally, they also decide to compensate the moral damages inflicted on individuals. In the Iranian legal system, moral damages can also be compensated. In Islamic jurisprudence, there is no known method to compensate for spiritual losses, but the common methods in customary law and in jurisprudence are also acceptable; Because the methods of compensation for spiritual damage are relative matters and the result of the legal and social thoughts of each age; And from the silence and non-repeal of the Sharia, we can get consent and Shariah ruling, so it can be stated that accepting financial compensation and all kinds of non-financial compensation in order to repair the spiritual damage can be justified and defended in Islamic jurisprudence
Teaching Module for Creating Songs with STAD Cooperative Learning Strategy in Music Art Learning at High School in Yogyakarta
This research aims to: (1) produce a teaching module for creating songs with a cooperative learning strategy of the STAD type as a teacher's guide in learning music at high schools in Yogyakarta and (2) determine the feasibility of teaching modules for creating simple songs with a cooperative learning strategy of the STAD type in learning music at high schools in Yogyakarta. This research is a type of research and development with the ADDIE development model developed by Dick and Carry. The subjects in this study consisted of expert validators, teachers and students. The trial design in this study consisted of two stages, namely: (1) the preliminary test stage addressed to expert validators and (2) the trial stage addressed to teachers and students. Data collection techniques used validity instruments, interviews and questionnaires. The data analysis technique consists of analyzing product feasibility data, analyzing teacher and learner response data. The results of this study are: (1) a simple songwriting teaching module product has been developed, this module is equipped with a Cooperative Learning learning strategy and a guide to the use of Adobe Audition video tutorials, (2) this module reviewed by two experts, learning experts with a final score of 78% with the category “Feasible” and material experts with a final score of 83% with the category “Very Feasible”
Casual-Oriented Sentences in Sea Today News: A Study of Translation Techniques
The forms of casual communication in both oral and written media do not necessarily retain grammatical elements. This is driven by the relatively short and/or concise sentences. The initial concept of casual language is as a colloquial language that has a reasonable structure among its users. In practice, the elements of regional languages are so inherent in the speech community. In addition, foreign language terms are also used through insertion which is then influence one’s language habit. This often triggers problems whenever it comes to translate casual sentences. Therefore, this research is done to explore the translation techniques used in translate casual sentences uttered by the host, co-host, and guest star in talk show although there have been many discussions about casual language, it is still rare to find research in the study of casual language translation. This study examines the translation product of a talk show from the official website of the English-language news channel owned by Sea Today News. The data was collected by doing document analysis including the simak (listen) and catat (record) methods. The source data were obtained in the form of document and cite. The result shows that establish equivalent technique (24.55%) dominates the translation. It is then followed by the other techniques such as paraphrase (11.65%), modulation (9.02%), reduction (7.49%), pure borrowing (4.16%), and discursive creation (3.74%). Translation techniques can function effectively depending on the translator’s understanding of the context in the source language. Techniques are used contextually and can only be identified through comparison between the source and target languages. Nonetheless, the application of translation techniques should be adjusted based on the nature of the technique whether it tends to be obligatory or optional for it may be applied more than one technique in a lingual unit. The implications of this research is to be a supportive reference for the next researchers who are interested in colloquial language translation and gives rise to the other translation variables that exclude from this present study such as translation shifts and translation quality
Ghana Citizenship Education: A Review from the Perspective of National Education Policy and Learning Models
This study aims to find out the perspective of national education policy and learning model of civic education in Ghana. This research uses a qualitative approach with a literature study method. The references in this study are divided into two, first, primary, namely journal articles that have high validity. Second, secondary, namely books and documents as an effort to minimize errors that are conceptual, procedural and praxis. Data analysis is gradual, namely, reduction, data display and verification. Civic education in Ghana begins at the primary level and continues through to tertiary education. The government of Ghana considers civic education an integral part of the national education system and has introduced policies and programs to strengthen civic teaching and learning throughout the education system. At the primary level, civic education is taught through social studies subjects, while at the secondary and tertiary levels it is provided as a separate subject. The Ghanaian government has also developed teaching materials and curricula dedicated to civic education, as well as conducted teacher training in integrating civic teaching into the curriculum and classroom activities. The teaching and learning model of Civic Education in Ghana emphasizes the local peaceful cultural and social context. The aim is to strengthen the values of cultural traditions and local wisdom that exist there.
Analysis of the Readiness Level of Junior High School Teachers: Implementation of the Merdeka Curriculum in North Ternate City
This study aims to analyze the level of readiness of Junior High School (SMP) teachers in the North Ternate District in implementing the Merdeka Curriculum (IKM). This study uses a quantitative descriptive approach to determine the level of teacher readiness based on five main indicators: knowledge of the Merdeka Curriculum, skills in managing learning, use of learning data, teaching adaptation, and commitment to the development of sustainable professionalism. Data was collected through questionnaires and analyzed using data processing facilities from Ms. Excell. The results showed that the level of teacher readiness was at Level 2 with an average percentage of 80%, which indicates that the readiness is quite good but requires improvement, especially in the skills in managing learning. The main recommendation of this study is the need to increase access to more intensive and comprehensive training
The Possibility of Converting Punishments in the Islamic Penal System
The full implementation of Islamic limits and punishments depends on the readiness of suitable grounds and conditions in the Islamic society, such as the formation of an Islamic government and the formation of social, political, economic, legal, judicial and penal systems and the absence of domestic and international obstacles. The permissibility of the execution of Hudud in the Age of Absence by the jurist Jame al-Sharai't does not mean insisting on the constant and unquestioning implementation of these punishments in all times and places; Rather, if the background and social conditions necessary for the implementation of Hudud punishments are not favorable, due to the mal effects that is created by their execution, it will be converted into proportionate punitive punishments as a secondary sentence. Like the verdict of stoning and apostasy, which cannot be implemented in the current conditions of the society. The change and conversion of maximum punishments will be done in three axes, firstly: change in the execution method, such as changing stoning to execution. Secondly: Substitution of lesser punishments, instead of maximum punishments, such as reducing one hundred lashes to less than that; Thirdly: Converting a limit punishment to a taziri punishment, such as turning amputation into imprisonment.It seems that the maximum punishments in the above three axes can be converted into proportionate punishments
