In the absence of a single global standard, multinational businesses facing financial distress need a coordinated restructuring plan that works across courts in different countries. Among other choices, companies that select a foreign forum can use Chapter 15 of the U.S. Bankruptcy Code, which is designed to manage cross-border insolvency cases and provides a legal framework for managing debts and assets involving multiple countries.
