    Banning Trans Student-Athletes Won\u27t Save Women\u27s Sports

    In the past few years, a wave of anti-LGBTQ+ legislation has been passed in the House of Representatives and state legislatures. As of February 2024, twenty-five states have laws or regulations which ban “transgender students from participating in sports consistent with their gender identity.” With deceiving names like the “Save Women’s Sports Act” and the “Protection of Women and Girls in Sports Act of 2023,” these laws discriminate against trans student-athletes, purportedly in the name of fairness and women’s empowerment .The stark reality is that these bills do nothing to cultivate fairness and safety for student-athletes and do not further the interests of women and girls in sports. Instead, these laws politicize the lives of children to stoke fear, intolerance, and discrimination, and deny all students the benefits of equal participation in sports.     Without Congressional Action, An 1873 Law Could Result In A National Abortion Ban

    On March 26, 2024, the Supreme Court heard oral arguments for U.S. Food and Drug Administration v. Alliance for Hippocratic Medicine which involves Food and Drug Administration (“FDA”) regulations of mifepristone, a drug that induces abortion. The case raises questions about the future of abortion access throughout the U.S. and, more broadly, the ability of courts to review and limit the FDA’s expert decision-making and regulating. During the oral arguments, two Justices were focused on a long-dormant law that could be used to ban abortion nationally with no action from congress: The Comstock Act.     The Cardozo Journal of Conflict Resolution will present this year’s award to Dr. Richard Haass, President Emeritus of the Council on Foreign Relations and Senior Counselor with Centerview Partners. Dr. Haass chaired the multiparty negotiations in Northern Ireland that provided the 2014 Stormont House Agreement, earning him the 2013 Tipperary International Peace Award. Dr. Haass also served as the Director of Policy Planning of the U.S. Department of State under Secretary Powell from 2001 to 2003 during which he played a pivotal role in shaping U.S. foreign policy and addressing global challenges. He is the author or editor of fourteen books on American foreign policy, one book on management and one on American democracy. His latest book is titled The Bill of Obligations: The Ten Habits of Good Citizens. The term “fandom” refers to communities of fans who come together through social media to express their shared admiration for a particular artist. When individuals unite to celebrate their mutual love for a musician, a genuine sense of connection and community is established. Through discussions about their shared passion for the artist, they often discover common interests and experiences that go beyond the music, fostering authentic friendships.     The Screen Actors Guild-American Federation of Television and Radio (“SAG-AFTRA”) strike finally ended on November 9th, after months of contentious dealings between the two groups centering on concerns over the future of acting and the ability to compensate talent fairly. While we can now all finally celebrate the anticipated return of our favorite shows like Euphoria, House of the Dragon, and Stranger Things, we should also take a moment to critically analyze why SAG-AFTRA and the Alliance of Motion Picture and Television Producers (“AMPTP”) have historically continued to have conflict and how these groups can learn to negotiate better to prevent future strikes.     Mediation Between States and Criminal Defendants for Post-Conviction Relief Under State DNA Statutes

    With new advances in DNA technology, it has become easier to use DNA testing to find perpetrators of crime where DNA evidence is present. Many incarcerated individuals claiming innocence seek to have the evidence tested during post-conviction in light of new technology. Forty-seven states now have DNA statutes that allow testing during the post-conviction stage. A new problem arises because state prosecutors are often reluctant to agree to DNA testing, which leaves litigation as the remaining method—which is inefficient. The process would be more efficient if a third party worked with the state and the defendant.
