President Trump and Control of Administrative Agencies: The Firing of NLRB Commissioner Gwynne Wilcox
No full textOn November 18, Gwynne Wilcox will join Dan Silverman at Cardozo to discuss her lawsuit against Trump and his administration for firing her as an NLRB commissioner. This conversation will be moderated by Professor David Rudenstine.
On January 27, 2025, President Trump removed Wilcox from the Board prior to her term’s expiration in 2028. Wilcox was the first Board Member to have been removed in 90 years of the Board\u27s inception in 1935. Wilcox filed a lawsuit in Federal Court in Washington, DC, against President Trump challenging her unprecedented and unlawful termination based upon current statutory law and well-established Supreme Court precedent. The termination is unlawful under a 1930\u27s SCOTUS decision that this court seems determined to overrule. Her case is still pending.

Extreme Prison Sentences: Legal and Normative Consequences
No full textThe article examines the phenomenon of extreme sentences—defined as those exceeding 200 years—in the federal criminal justice system, raising critical questions about their rationale, proportionality, and alignment with traditional theories of punishment. Through an empirical study of 55 such cases, the analysis highlights the role of mandatory minimums, cognitive biases, and an exclusionist mindset in driving these sentences. It critiques the normalization of extreme penalties and their implications for mass incarceration, deterrence, and human dignity
Preserving the Future: Recognizing Intergenerational Equity in United States Constitutional Jurisprudence in Light of Evolving Climate Rights Litigation
No full textClimate rights litigation is an essential part of holding states accountable for their climate change obligations. This type of litigation has increased across the globe, and domestic and international courts have issued landmark rulings that serve as precedent for reinforcing state obligations and protecting constitutional and human rights in the process. One focus of these cases is intergenerational equity, which implicates the theory that inadequate state action on climate change violates the rights of future generations. This Article explores the evolution of this theory in domestic and international law, illustrating its increasing importance in climate rights litigation and the necessity of the role of the judiciary in protecting future generations. This Article draws on current United States constitutional law and its ability to provide an avenue for recognizing the rights of future generations through the Fifth Amendment Due Process Clause and its relationship with the Fourteenth Amendment Equal Protection Clause. The analysis focuses on principles from landmark climate rights decisions explaining the disproportionate burden placed on future generations as a result of subpar climate action policies and also highlights why United States courts are in a critical position to recognize and protect future generations
