    Buyer, Beware of Addiction

Addictive products kill more than 700,000 people in the United States every year. Despite the large-scale risks that addiction poses, the law requires manufacturers of addictive products to disclose little-to-no information about the risk of addiction—the single most consequential characteristic of a class of products contributing to mass death every year. While consumers understand that addictive products are, in fact, addictive, they generally do not understand the magnitude of the addiction risks that they face. Metaphorically, consumers understand that they are playing a game of “Russian roulette” when they consume an addictive product—but they play without knowing how many bullets are in the gun. This Article considers how and why the law fails to require meaningful addiction risk disclosure. It goes on to discuss what meaningful risk disclosure might entail, including easily digestible quantitative measures of how likely addiction is, information about risky patterns of use, and warning signs of early-stage addiction. This Article suggests that an overhaul of the current approach to addiction research and disclosure is necessary to bring decades-old disclosure requirements in line with current medical research

Reforming the Rules: A Proposal for Modifying the Model Rules of Professional Conduct to Permit Partnerships Between Lawyers and Nonlawyers in the Practice of Law

The Model Rules of Professional Conduct prohibit partnerships between lawyers and nonlawyers in the practice of law, a ban that purportedly exists to protect lawyers’ professional independence of judgment. Despite this noble sentiment, the prohibition ultimately hurts the legal market, to the expense of potential clients, by limiting the professional options available at the lawyer’s disposal. The existence of lawyer-nonlawyer partnerships, recently espoused by two states, both decreases the costs and barriers involved in obtaining justice and encourages much-needed legal innovation. While other scholars have proposed schemes that would permit such partnerships without compromising the lawyer’s professional responsibility, their methods arguably fail to align the incentives of lawyers with those of their nonlawyer partners. This Note attempts to address this issue by drawing from traditional principles of partnership law and vicarious liability. Holding lawyers, individually, to a strict liability standard concerning the legal misconduct of their nonlawyer partners while designating their partnerships as independently disciplined entities safeguards the professional responsibility of lawyers and nonlawyers alike, paving the way for reform of Model Rule 5.4(b)

Judge Roy Bean was a legendary justice of the peace in Texas, known as the “Law West of the Pecos.” However, he was not known for his encyclopedic knowledge of the law. Judge Bean “had only one law book, a copy of the Revised Statutes of Texas, printed in 1879, as authorized by the Sixteenth Texas Legislature.” He relied exclusively on that book, and “[e]ven though the legislature sent him new books every two years, reflecting new laws, he burned them. He said he liked the old book better and he like those laws better, too.
