    AbstrakKonsep subjek hukum adalah salahkonsep inti dalam hukum. Dalam teori tradisional, konsep ini hanya dimaknai hanya berkaitan dengan hak dan kewajiban belaka. Sementara Hans Kelsen melihat bahwa ada persoalan kuasa dalam hak dan kewajiban. Namun, kuasa ini bukanlah kuasa terutama dalam konsep subjek hukum, karena menurut teori tradisional, ada kuasa di baliknya yang menentukan sesuatu itu adalah subjek hukum yang memiliki kuasa hak atau tidak. Relasi antarkuasa ini berpotensi tidak adil, dan bahkan berpotensi menjadi jahat, karena secara potensial ada manipulasi berbaur fiksi atas nama keyakinan agama atau pandangan sosial tertentu, sehingga si penguasa ini dapat menentukan sesuatu itu adalah subjek hukum yang memiliki kuasa atau tidak. Jikalau tidak memiliki kuasa, maka sanksi akan disiapkan untuk menghukum perilaku yang dianggap menyimpang. AbstractThe concept of legal subject is one of the core concepts in law. In traditional theory, this concept is only interpreted in its relation to the rights and obligations. While Hans Kelsen sees that such concept is related to power in rights and obligations. However, this power is not the supreme power in the concept of legal subjects, because according to traditional theory, there is another power behind it which determines the existence of a legal subject whether it has power or not. This power relation is potentially unfair, and even vicious, because there is plausible manipulation mixed with fiction in the name of a religious belief or a social view, hence such power can determine whether a legal subject has power or not. If it has no power, then sanctions will be defined to punish certain behavior that is considered socially improper

    DISPUTE SETTLEMENT IN THE OMBUDSMAN AND THE COURT OF LAW REGARDING COMPENSATION IN PUBLIC SERVICE DISPUTE

    Public Service is the embodiment of the main tasks of a governance. But in its implementation sometimes it also causes disputes due to losses experienced by community members due to a bad public service. Therefore Law No. 25 of 2009 concerning Public Services regulates dispute resolution in the implementation of public services. At least there are two types of ways to resolve compensation in public service dispute that caused by Tort in the Public Service, namely the Non-Litigation settlement through the Ombudsman, and the Litigation settlement through the Court. However, in further studies it was found that there was an overlap of authority between the Ombudsman and the Court in resolving public service disputes. This paper will try to discuss this in depth in terms of the philosophy of the existence of the Ombudsman, and its implications for its Special Adjudication authority. Aside from that, this paper will also discusses about the procedure of proceedings in the Administrative Court regarding public service disputes

    The constitution is approved as a law capable of guaranteeing human rights and protection of the constitution and past coordination, as well as being the corpus of the administration of the rule of law entity itself. Regarding the state of Indonesia and the United States, if examined by these two countries, they have similarities in the form of republican government or presidential system of government. However, on the contrary, in the impeachment transition, the two countries appear to be dichotomous both formally and materially. Therefore, this scientific article discusses reviewing the impeachment provisions of the Presidents of the two countries who agree to develop agreements and principles in checks and balances in trying to actualize the value of the country\u27s legal justice. Therefore, in approving the discourse of research methods, descriptive-comparative methods are used with normative-philosophical and comparative-critical discussions. On that basis, this study discusses the practice of presidential impeachment in Indonesia to consider more legal justice, because it is through a legal process involving the Constitutional Court which implements practices in the United States that only involve the Senate and the House of Representatives which incidentally is a political institution. It considers the constitution in the basic law of the country

    The Law Number 11 of 2020 concerning Job Creation amended 79 laws, including Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Far from being comprehensive, the Job Creation Law amended the system of law enforcement regarding business competition that had been in place for over twenty years. With a normative method, this research aims to discuss the legal implications of the effectuation of the Job Creation Law regarding the enforcement of the law concerning business competition. This research reveals that Law 11/2020 could lead to a better legal certainty and adequacy of law enforcement concerning business competition in Indonesia in the time to come.Â

    This study is a type of empirical legal study conducted based on the discrepancy between the existing provisions and theories and the legal facts occurring among the society, that is, the transaction of goods carried out by crossing the border between two countries.Any hindering obstacles and barricades to the law enforcement over illegal businesses can be settled through social and cultural, economic, political, and security approaches. Alternative solutions that should be applied in dealing with such legal issues can be establishing buildings in the border area, which are specifically directed to help accelerate the handling of three fundamental problems faced in the scope of the development of the border area in question, one of which is delimitation and delineation aspects of the state\u27s boundaries, the aspect of affirming national borders on watershed areas between Indonesia and Timor Leste, the aspect of development discrepancy in the form of fulfilling infrastructure needs in the economic field to foster opportunities for the border areas to participate and compete amid both global and regional markets

    This study aims to trace the contradictions of sentencing arrangements in child sexual abuse crimes in Aceh after the enactment of Qanun No. 6 of 2014 with Law No. 35 of 2014 on Child Protection. The regulation of child sexual abuse punishment in jinayat law in Aceh has different interpretations from other laws and regulations, including Law No. 35 of 2014 on Child Protection. So the essence of the deterrent effect for perpetrators that should be part of the goal of criminalization is not so achieved. In addition, Qanun Jinayat also has the potential for impunity for the government with Article 9 and Article 11 Qanun No. 6 of 2014 on the reasons for justification and forgiving reasons. The method used in this paper is a normative juridical method, using secondary data or library data. The study results showed that in Aceh, there had been a dualism of the legal regulation of child sexual abuse. The provisions of qanun jinayat are still many shortcomings in providing protection and rights for children as victims, so law enforcement tends to choose positive laws. It is recommended that the Aceh government to harmonize the law between jinayat law provisions and positive laws relating to sexual harassment

    Senyatanya pengaturan tindak pidana kesusilaan yang fokusnya terkait homoseksual (gay dan lesbian) belum sepenuhnya diakomodir dalam KUHP, manakala pelaku dan korbannya adalah orang dewasa. Di kalangan penegak hukum militerpun timbul perdebatan adanya anggapan kekosongan hukum, tatkala oknumnya adalah sesama Prajurit TNI.  Oleh karenanya, menarik untuk dianalisis dasar pertimbangan hakim militer dalam penjatuhan pidana perkara kesusilaan yang terkait homoseksual. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan yuridis normatif yang selanjutnya dianalisis secara yuridis kualitatif. Hasil penelitian menyimpulkan berdasarkan putusan tindak pidana kesusilaan yang terkait homoseksual (lesbian dan gay), setalah dilakukan dianalisis telah merujuk pada SEMA sebagai supervisi bagi hakim dalam memutus perkara, dimana selain dibuktikan terbuka melanggar susila juga dikategorikan melanggar perintah dinas

    Perubahan UUD NRI Tahun 1945 membawa perubahan besar dalam sistem kekuasaan kehakiman. Pembentukan lembaga baru seperti MK dan KY selain MA, diharapkan dapat mewujudkan cita-cita reformasi dengan prinsip checks and balances. Manifestasi pengaturan kewenangan lembaga kekuasaan kehakiman secara atribusi diatur dalam Pasal 24, 24A, 24B dan 24C UUD NRI Tahun 1945.  Berdasarkan sifatnya kewenangan kekuasaan kehakiman mencakup kewenangan limitative dan non limitative yang diatur melalui undang-undang masing-masing lembaga. Namun, pengaturan kelembagaan kehakiman tersebut menimbulkan dilematisasi dan ketidak harmonisan hukum. Hal ini diakibatkan multi tafsir pengaturan kewenangan masing-masing lembaga. Sehingga polemik kelembagaan tersebut diselesaikan melalui proses judicial review. Permasalahan muncul ketika proses revisi undang-undang yang dibatalkan oleh MK, tidak dipenuhi dalam proses legislasi sehingga tetap memunculkan disharmonisasi hukum antar kelembagaan kekuasaan kehakiman

    Kajian ini bertujuan untuk menelusuri kontradiksi pengaturan hukuman dalam tindak pidana pelecehan seksual terhadap anak di Aceh pasca diberlakukannya Qanun No. 6 Tahun 2014. Pengaturan hukuman pelecehan seksual terhadap anak dalam hukum jinayat di Aceh mempunyai perbedaan penafsiran dengan peraturan perundang-undangan lainnya termasuk UU No. 35 Tahun 2014 tentang Perlindungan Anak. Sehingga esensi efek jera bagi pelaku yang seharusnya menjadi bagian tujuan pemidanaan tidak begitu tercapai. Selain itu, Qanun Jinayat juga berpotensi untuk terjadinya impunitas bagi pemerintah dengan adanya Pasal 9 dan Pasal 11 Qanun No. 6 Tahun 2014 mengenai alasan pembenaran serta alasan pemaaf.
