TOOLS FOR ENSURING THE SUSTAINABILITY OF THE ECONOMY OF THE SOCIAL SPHERE BY REGIONS OF RUSSIA (ON THE EXAMPLE OF COMMERCIAL CLINICS)

The article examines the impact of digitalization on the sustainable development of commercial clinics in Russian regions, considered as a factor in ensuring regional economic security and socio-economic sustainability. The challenges and opportunities in the stated field are analyzed and the solutions are given. Materials and methods. The study is based on the hypothesis that digital tools have a direct and significant impact on the sustainability of social organizations such as commercial clinics. An empirical assessment of the hypothesis included the calculation and comparison of integral indicators of the economic sustainability of commercial clinics and the level of their digital maturity using methods developed by the authors. Results. The presence of regional differentiation in terms of sustainable development of commercial clinics, correlating with differences in the level of digital maturity, is shown. It is proved that digital technologies can significantly improve the quality of medical services and optimize clinical processes, but their implementation may also face certain problems, including high costs for equipment upgrades and staff training, combined with data security threats. The authors propose to use innovative management methods, activate investments attraction, and develop information security strategies to solve the relevant issues. Conclusions and recommendations. For commercial clinics it is important to adapt to new technologies which should allow Russian commercial clinics to ensure successful functioning within the framework of the social sphere, also contributing to the economic sustainability of regions

Get PDFObjetivo: Este estudo visa analisar criticamente as complexidades legais que envolvem a violência sexual em zonas de conflito, com um enfoque específico no Iraque e na Síria, países que não são signatários do Estatuto de Roma do Tribunal Penal Internacional.Método: Por meio de uma análise legal comparativa, o estudo examina a discrepância entre os crimes delineados no Estatuto de Roma e as leis domésticas do Iraque e da Síria, como o Código Penal Iraquiano de 1969. Investiga como essas disparidades afetam a acusação e a caracterização dos crimes de violência sexual cometidos em conflitos armados.Resultados: Os achados destacam uma lacuna significativa no arcabouço legal, mostrando que as leis domésticas do Iraque e da Síria não criminalizam adequadamente atos de violência sexual conforme delineado no Estatuto de Roma. Esta lacuna legal representa desafios na persecução penal dos perpetradores e na entrega de justiça às vítimas. Além disso, o estudo revela as práticas atuais e limitações dentro do sistema judiciário iraquiano no tratamento desses crimes.Contribuições: O estudo contribui para a compreensão dos desafios legais na persecução da violência sexual em zonas de conflito, especialmente em países não signatários do Estatuto de Roma. Oferece percepções sobre as reformas legais necessárias e a cooperação internacional para preencher a lacuna entre os padrões internacionais e as leis nacionais. A pesquisa também fornece recomendações valiosas para a adaptação dos sistemas judiciários a fim de abordar e penalizar de forma mais efetiva esses crimes hediondos, avançando assim a luta global contra a violência sexual em conflitos armados
MECHANISMS FOR EFFECTIVE INTERACTION BETWEEN AUTHORITIES AND BUSINESS ENTITIES IN THE CONTEXT OF THE COVID-19 PANDEMIC AND POST-COVID ECONOMY
Get PDFObjective: The article aims to analyze and assess the mechanisms for effective interaction of the state, regional authorities, and business entities in the context of the COVID-19 pandemic and the post-COVID economy.Methods: The study utilizes a multifaceted approach, encompassing data analysis and statistics to assess the pandemic-related activities of small enterprises. It employs correlation analysis to gauge the relationship between state support and business development. Content analysis evaluates the quality of regulatory measures during biological threats, while expert analysis, logical reasoning, and data visualization techniques facilitate data collection and interpretation.Results: The study reveals that the effectiveness of government support measures during the pandemic is directly related to the quality and volume of regulatory policies implemented by the state and regional authorities. The research identifies the strengths and weaknesses of these measures and explores opportunities and threats associated with government-business interactions. The results demonstrate that government support played a crucial role in mitigating the economic and social consequences of the pandemic, particularly for small- and medium-sized enterprises.Conclusion: The study emphasizes the importance of strong collaboration between government authorities and businesses during times of crisis. It highlights the effectiveness of regulatory policies and support measures in safeguarding the business ecosystem. The conclusions drawn highlight the need for continuous improvement in the mechanisms of interaction between government and businesses to ensure economic resilience in the face of future biological threats. The lessons learned from the COVID-19 pandemic can inform policy decisions and strengthen the partnership between the government and the business sector in the post-COVID era
A IMPLEMENTAÇÃO DE PROGRAMAS DE COMPLIANCE AMBIENTAL NA GESTÃO EMPRESARIAL E SUA IMPORTÂNCIA NA MITIGAÇÃO DE CRIMES AMBIENTAIS
Get PDFObjetivo: analisar a relevância do compliance na gestão empresarial, considerando aspectos legais ligados à prevenção e a sustentabilidade ambiental, especificamente para as empresas que desenvolvem atividades de risco de forma a verificar se a ausência dessa ferramenta pode ou não acarretar prejuízos à empresa.Metodologia: Para tanto, esta pesquisa recorrerá a uma revisão de literatura multidisciplinar sobre o tema tendo por finalidade demonstrar que o desenvolvimento econômico aliado à observância de regras impostas por programas como o compliance, enquanto instrumento de gestão ambiental e, formatado para funcionar dentro da estrutura empresarial, tem papel de suma importância na preservação do meio ambiente e no desenvolvimento sustentável.Resultados: Para tanto também será feita uma abordagem sobre a aplicação do ESG - Environmental, Social and Governance – e sua importância estratégica como indicador de mercado. Para o desenvolvimento da pesquisa ainda será analisado os eventos catastróficos ocorridos nas cidades de Mariana e Brumadinho com o rompimento das barragens construídas e de responsabilidade do grupo Vale S/A.Contribuições: Portanto, através da análise de casos reais, salutar será a reflexão sobre implementação de programas preventivos com especificidades na preservação de um meio ambiente ecologicamente equilibrado voltando-se para a busca da harmonia dos três pilares corporativos empresariais: o lucro, o social e o ambiental. ABSTRACTObjective: to analyze compliance inspection in business management, considering legal aspects related to prevention and environmental sustainability, specifically for companies that carry out risky activities in order to verify whether or not the absence of this tool can cause damage to the company.Methodology: To this end, this research will accompany a multidisciplinary literature review on the subject with the purpose of demonstrating that economic development combined with the observance of rules imposed by programs such as compliance, as an instrument of environmental management and, formatted to work within the framework business, plays an extremely important role in preserving the environment and sustainable development.Results: For this purpose, an approach will also be taken on the application of ESG - Environmental, Social and Governance¬ – and its strategic importance as a market indicator. For the development of the research, the catastrophic events that occurred in the cities of Mariana and Brumadinho, such as the collapse of the dams built and the responsibility of the Vale S/A group, will be analyzed.Contributions: Therefore, through the analysis of real cases, a healthy reflection on the implementation of preventive programs with specificities in the preservation of an ecologically balanced environment, turning to the search for the harmony of the three corporate business pillars: profit, social and the environmental.Keywords: compliance; business management; environment

The study analyzes the depiction of the holy Apostles' paths in contemporary cinema, which has effectively captured the concept of path transformation and recreated these events in Christian movies based on the Holy Scriptures. The notion of "a path" serves as a metaphor, representing an exaggeration that transcends into the realm of art and culture. It encompasses the entirety of the cultural landscape and incorporates the idea of an "eternal path," symbolizing perpetual searching and movement. Pilgrimage, comprising a physical journey towards a spiritual destination, represents a novel orientation and route—a fusion of old and new elements constantly evolving amidst contemporary temporal challenges. Utilizing a postmodern format—engaging with a tablet and headphones—one can delve into the farthest corners of our Earth in search of the spiritual essence of art and culture. This involves listening to spiritual music, exploring virtual museums and exhibitions, experiencing theatrical productions, or immersing oneself in feature or documentary films depicting the journeys of St. James and St. Paul. CASE LAW REGARDING THE LEGALITY OF SOCIAL MEDIA CYBER-BLACKMAIL
Get PDFSocial media evidence (SM) is a relatively new and rapidly growing area of digital forensics. Criminal investigations may greatly benefit from the digital information trail left on social media if it is correctly analysed, especially in situations involving cyber-blackmail. It can be difficult to gather evidence from social media and show it in court, though. It is important to respect both the law and the individual's privacy while gathering social media evidence for cyber blackmail offences. Forensic investigators can conduct fruitful investigations and quickly gather legally reliable evidence if they are given sophisticated tools for controlling the quantity and variety of social media content. The present state of evidence gathering, admissibility, and jurisdiction on social media is studied in order to penalise individuals who engage in cyber-blackmail. In addition to examining Iraqi laws and regulations, the research also considers the difficulties courts today have while gathering, evaluating, presenting, and confirming social media evidence. Moreover, a review of the key elements of a lawsuit, including the case's purpose, the seriousness of the threats made, and the supporting documentation. A descriptive and analytical technique was used to analyse the issue, explain it in all of its aspects, and provide a diagnosis. As a result, we discovered that, in order to prevent cyber-blackmail, the court investigator may run into difficulties because of a legal loophole and a lack of resources for gathering digital evidence in the social media sector. Important aspects of cyber blackmail, such as its scope and character, were also made clear by this study

Drawing from dialectical analysis, historical examination, formal legal scrutiny, and comparative jurisprudence, the research explores the complexities of these systems.Results: The study shows an increasing interest in mixed legal systems, their heterogeneity, and their classification based on different criteria. The authors discuss the advantages and disadvantages of mixed legal systems, emphasizing their interconnectedness and features of functioning. The authors conclude that further interpenetration of legal systems and legal families is possible in the future, which is largely related to legal globalization

Get PDFRESUMOA proteção e efetivação dos direitos humanos são compromissos assumidos internacionalmente pela República Federativa do Brasil e consolidados pela sistemática do Direito Internacional dos Direitos Humanos. Internamente encontram guarida na Carta Constitucional, que se funda no princípio da dignidade da pessoa humana e se materializa através da concretização dos direitos humanos. O novo pacto social estabelecido pela Constituição Federal de 1988 impõe ao Estado (em sentido amplo) o dever de promover os direitos fundamentais, dentre eles o do meio ambiente hígido e do desenvolvimento sustentável. Assim, apesar da inexistência de normativa específica no que se refere à atividade paradiplomática, os Municípios/ Poderes locais têm o dever-poder de efetivar os direitos fundamentais relacionados ao interesse local e para tanto podem e devem utilizar os instrumentos de governança global e paradiplomacia, isoladamente ou em cooperação com o Governo Federal.Palavras-chave: Governança Global; Direitos humanos; Direitos fundamentais; Paradiplomacia; Poder local; Desenvolvimento sustentável. ABSTRACTThe protection and effectiveness of human rights are commitments assumed internationally by the Federal Republic of Brazil and consolidated thru international human rights law. Internally they are supported on the Constitucional Chart that is based on human dignity and materialize on the effectiveness of human rights. The new social pact established by the Federal Constitucional of Brazil from 1988 imposed to the State the duty to promote human rights, such as a healthy environment and sustainable development. Therefore, despite the lack of specific legislation about paradiplomacy, the local power has at the same time the possibility and the obligation to promote fundamental rights and to do so can and must practice global governance and paradiplomacy, isolated or in cooperation with the Federal Government.Keywords: Global Governance; Human Rights; Fundamental rights; ´Paradiplomacy; Local power; Sustainable development.
