Burden of proof on accidental cause in automobile liability insurance accident
Get PDF自動車保険における保険事故の偶然性の立証責任の所在について、傷害保険や物保険（火災保険や車両保険など）に関する一連の蛾高裁判決の結果、一定の法解釈が形成されていると考えられる。すなわち、4つの傷害保険(人身傷害保険、自損事故保険、無保険車傷害保険、搭乗者傷害保険）の保険事故の偶然性の立証責任は被保険者が負い、車両保険については保険者が負うということである。
この問題に関する訴訟は、被保険者による故意招致事故が高度に疑われた事案において、訴訟外で保険者による免責主張が行われ、被保険者がそれを不服として保険金請求訴訟を提起し争われたものである。実際の訴訟では、保険者が被保険者の故意招致免責の明確な立証が困難であることから、保険者が保険事故の支払要件の中で、被保険者が保険事故の偶然性の立証責任を負うと主張したことで、立証責任の所在を巡り、争われたものである。したがって、本問題は被保険者のモラルリスクを排除する上での訴訟上の法技術の問題であると考えられ、実際の保険実務では、保険者が被保険者の故意招致の立証を通じて、免責主張が行われるものと考えられるが、それが訴訟になった場合の対応としては、押さえておく必要がある命題である。
そこで本稿では、自動車保険において、残る問題として、これまでほとんど取り扱われていない、対人賠償責任保険及び対物賠償責任保険に係る事故の偶然性の立証責任について、物保険における一般的法解釈(保険者が負う）が両賠償責任保険に射程するのかという命題について考察するものである。論文(Article)departmental bulletin pape
Art Management and the Possibility of Art Intervention as a main Constituent
Get PDFThe present paper considers the possibility of art intervention as a main constituent to advanceregional policies for community renovation, based on on-site interview and field research in Taiwan ２～６ May 2018.
My purpose is to explore how we can use arts and cultures to rebuild and revitalize communities that have experienced challenging and placemaking (to reorganize places as a new common space) economic, social and cultural circumstances for the purpose of seeking to sustainable development against such as a decline in a major local industry or community deterioration.
It is through the behavioral example of community development by intervention of arts that individuals, including disable people and community can be stronger and have a greater capacity to manage their resources for community renovation by initiating and supporting many art-ledrecovery projects.
And from this research, we have learned some lessons that especially human life which is beyond the producing physical materials can possible. And we will have alternative wellbeing, and what is more we are conscious of our having own originality to realize the act of recognizing the social value of something.
So we will be able to create intrinsic value (John Ruskin) to fulfill the entire human nature which we will realize a new society like a neither wealth nor beauty but life.論文(Article)departmental bulletin pape
