Positive work concepts in personnel facilitating children and persons with disability : a qualitative analysis of free answers
Get PDFTwo aspects are considered vital in the duties discharged by personnel who assist people with disabilities. The first facet concerns the work environment including human relationships and the treatment received in the workplace. The second feature involves subjective rewards attained by the facilitators from the work. This paper attends to the latter aspect and examines features of specific positive work concepts articulated by the personnel with regard to what rewards they gain from their current responsibilities. The free answers obtained from a questionnaire survey administered to 223 members facilitating children or persons with disability were utilized for qualitative analysis. The results of the evaluation of the descriptions were classified into five core categories. Statements on positive work concepts as well as assertions on work concepts that were not constructive were included in the analysis. The core categories incorporated many types of positive opinions on work, including the pleasure attained from the relationship with users and the personnel's self-growth. The pleasure gained from the relationship with users was often described as difficulties. This paper examines the statements included in the aforementioned three core categories and on the assertions of positive work concepts included in the other two core categories.論文(Article)departmental bulletin pape

Get PDF損害保険代理店が保険契約締結の代理権を付与されていることから，事故発生後に事故者が代理店と共謀して事故発生前に契約成立日や保険料支払日を不正に遡及させて偽装するアフロス契約が存在し得る。実質的契約当事者が共謀して保険契約申込書や保険料領収書の日付を事故前に遡らせて作成すると，書証の持つ事実上の推定力により，保険者において保険料未収の証明責任を事実上負担することになり，従来，訴訟上において，その立証が極めて困難であると考えられてきた。
本来，保険契約は保険者と保険契約者間において保険契約の意思表示の合致すなわち申込と承諾により成立する諾成契約であり，保険料の支払または書類の作成をまたず，合意だけで成立することは判例や学説の一致した見解である。
しかし，保険実務では通常の保険契約は事実上，要式化されており，約款上，保険料領収前事故保険者免責規定がある。したがって，実質的に保険料の支払行為とほぼ同時に損害保険契約が成立すると考えられることから，保険料領収証等の交付が損害保険契約成立の証拠と看倣して， これがない場合には損害保険契約の成立が認められない。
そこで，保険始期に接近した保険事故が発生し， アフロス契約が疑われ，事実関係が真偽不明の場合，保険料未収の証明責任が問題となるが， これを本稿では， もっともIT化が進む自動車保険契約において，保険会社が敗訴した最近の裁判例を手掛かりに改めて考察したい。論文(Article)departmental bulletin pape
Activity and perspective of psychiatric social worker in Kumamoto DPAT : role and new possibilities of logistics at phase3 and 4
Get PDFIn this research, the purpose was to analyze the knowledge, skills, value ethics, and difficulties in DPAT activities used by Logistics (Psychiatric Social worker: PSW) who conducted DPAT activities. The voice data obtained by the interview survey were analyzed and considered by the qualitative research method. As a result, seven categories were extracted for "expertise of PSW effectively used as Logistics in DPAT", and its structure was tried. In addition, four categories were extracted for "the difficulty in performing Logistics activities in DPAT as PSW", and the structure was tried. From these results, it became clear that PSW, which carried out DPAT activities, crossed the border its role as logistics and demonstrated its expertise. On the other hand, it also became clear that they had various difficulties. Furthermore, PSW placed "a viewpoint that captures the overall relationship between people and situations" at the core of that perspective. By taking advantage of such specialties, PSW has been objecting to "the role of PSW as Logistics". And, it was suggested that PSW had new possibilities when fulfilling its duties as Logistics.論文(Article)departmental bulletin pape
Peasant inheritance customs and patriarchy in medieval England : using the whole orientation of Morimitsu Shimizu as the analysis concept
Get PDFapplication/pdfThis paper focuses on the analysis of peasant inheritance customs and patriarchy in Medieval England using “the Whole rientation” conceptualized by Morimitsu Shimizu as the analysis frame. The purpose is to explore whether there was a structural difference between Japanese traditional family “Ie” and English one in the feudal age. The contract behaviors on inheritance spread among peasants in Medieval England even if it was limited. Women without husbands reserved the rights to transit their properties. These characteristics imply that “the Whole Orientation” was not firmly formed among the English peasant families and that as a result the patriarchy within the family in Medieval England was relatively weak comparing with Japanese traditional family “Ie”. The facts that women have kept the inheritance rights under a certain condition since the feudal age influenced to the social position of women after modernization.論文(Article)departmental bulletin pape

Get PDFKirishima International Music Festival was founded under the name of "Kirishima International Music Festival / Master courses" in 1980. There were 3 aims, rising the cultural level in Kagoshima, rising the educational level of Japanese artists and the tourism resources development of Kagosima. Sharing these purposes, the people in Kagoshima, especially in Kirishima, support this festival, the foundation makes the programs and the local government offers the financial support.
