    Accessibility of Welfare Services with Legal Status of Consultation Support Services A Comparative Study on Laws Stipulating the Basic Matters of Social Welfare in Japan and South Korea

    This study considers how the accessibility of welfare services is promoted by the legal status of consultation support services through a comparative study between Japan and South Korea. This study focuses on the right to use welfare services, the provision of information on welfare services, the arrangement of consultation support institutions, and the social workers under the basic laws of social welfare in both countries. Japan’s Social Welfare Act does not include any clear provisions regarding the right to use welfare services. However, it provides provisions for promoting the appropriate use of welfare services. Korea’s Social Welfare Services Act and Framework Act on Social Security state that the right to use welfare services includes the right to apply for and receive welfare services. Japan’s Social Welfare Act stipulates that Japan must endeavor to provide information pertaining to social welfare services, whereas South Korea’s Social Welfare Services Act stipulates that South Korea must provide information. Regarding consultation support institutions, Japan’s Social Welfare Law prescribes projects to establish consultation support systems that based on the communities, which is commendable for ensuring accessibility to welfare services. South Korea’s Framework Act on Social Security facilitates the establishment of social security delivery systems. In Japan, national qualifications for certified social workers and certified mental health social workers are stipulated by a law separate from the Social Welfare Act.
