Get PDFKey stages in the establishment and further development of the institution of special knowledge in Russia is analyzed, from the pre-revolutionary period to our days. The procedural status of forensic science, forensic experts and forensic specialists in the Russian criminal procedure is examined. The procedural status of experts and specialists in the Russian criminal procedure is compared to that in other countries. The author observes that in the early stages the functions of knowledgeable persons were not clearly delineated by the law, and there were no regulations on how forensic evidence analysis should be requested and conducted, but by the mid-1920s the terms «forensic science» and «forensic expert» were present in the Russian legislation. The procedure for requesting and conducting forensic examinations was defined starting in 1960; the use of special knowledge in investigative actions became the function of the specialist. The status of the specialist was further elaborated in 1966. With the adoption of the Criminal Procedure Code of the Russian Federation in 2001, the specialist's legal status was expanded, giving them the right to present their opinion and testify on the probative value of evidence, and their rights and responsibilities were refined

Get PDFThe analytical review examines the issues of forensic investigation into the circumstances of production of digital video and audio recordings. The paper presents the organization and lines of inquiry in forensic analysis of video and audio evidence, computer forensics, forensic linguistics, and psychological evaluation established in the system of forensic science organizations of the Russian Ministry of Justice by 2013–2016. The analysis covers the issues of independent or integrated application of the listed types of special knowledge in order to meet the discipline-specific and comprehensive objectives of determining the circumstances of video/audio production. General strategies and types of forensic diagnostics of production circumstances are discussed without too much emphasis on the methodological minutiae of every stage of the investigation.В обзоре рассмотрены вопросы проведения экспертных исследований обстоятельств изготовления цифровых видео- и звукозаписей (ОИЗ). Обсуждены организация и направления экспертных исследований в рамках криминалистической экспертизы видео- и звукозаписей, судебной компьютерно-технической экспертизы, судебных лингвистических и психологических экспертиз, сложившихся в системе судебно-экспертных учреждений Минюста России в последние годы (2013–2016 гг.). Проанализированы вопросы раздельного использования и интеграции перечисленных специальных знаний для решения родовых и комплексных задач по установлению ОИЗ. Get PDFThe paper examines methodological problems associated with one of the types of examinations conducted by construction forensics experts. The objective of such examinations is to establish the variety, scope, and cost of construction work involved in the reconstruction of buildings and structures. Considering the courts' growing demand for this kind of investigations, on the one hand, and current inadequacy of supporting methodologies, on the other, the authors offer a detailed description and conclusive rationale for an optimal procedure for the epistemic actions designed to achieve one of the most commonly addressed forensic objectives.Рассмотрены методические проблемы одного из видов исследований, проводимых при производстве судебной строительно-технической экспертизы. Данные исследования имеют целью установление видов, объемов и стоимости строительных работ, выполненных при реконструкции зданий и сооружений. Учитывая, с одной стороны, постоянно растущую потребность судопроизводства в исследованиях этого вида, а с другой - недостаточную проработанность методических основ их проведения, авторы детально обосновали оптимальный порядок действий при решении одной из актуальных судебно-экспертных задач.
