The legal status of 'data' in the Law of armed conflict : interpretability as a 'objects' in article 52 of AP1
Get PDFIT技術の発展が著しい現代において、武力紛争法はIT技術の進化に対応できているのだろうか。例えば、第1追加議定書第52条の軍事目標の要件は「物については」と規定しているが、「データ」が「物」に該当するかについては国際法学者及び国家の間でも見解の一致を見ていない。そこで、本論文では武力紛争法のサイバー空間への適用に際して重要となる「データ」と「物」の解釈について、学者や国家の見解を通して再考する。In this age of rapid development of information technology, is the law of armed conflict able to keep pace with the evolution of information technology? For example, the requirement for military objectives in Article 52 of Additional Protocol I stipulates "in so far as objects are concerned", But there is no consensus among international law scholars and states as to whether "data" constitutes a "objects". Therefore, this paper reconsiders the interpretation of "data" and "objects," which is important when applying the law of armed conflict to cyberspace, through the views of scholars and states.研究ノート(Note)departmental bulletin pape
