    Doktrin Res Ipsa Loquitur Pada Perlindungan Konsumen

    Economic growth in Indonesia can be encouraged by increasing consumer confidence. In the event of a violation of consumer rights, consumers have the right to claim compensation from business actors, but in fact, consumers and business actors have an unequal position. Consumers have difficulties in terms of civil evidence. An imbalance in the distribution of the burden of proof is an injustice for the disputing parties. The research was conducted using normative juridical research methods and comparative research methods, namely research methods carried out by studying secondary data and library materials and approaches to comparing the laws of one country with the laws of other countries. This research was conducted through library research and field research to enrich the sources. The results of further research are described in descriptive writing that relates the problem to legal theory in evaluating the practices carried out by research objects. There are 2 conclusions from the research results. First, that the position of the re ipsa loquitur doctrine in the principle of proof in consumer protection cases is closely related to the evidence imposed by judges on business actors as parties who have responsibility for the products consumed by consumers as well as those who suffer less losses to provide more justice for consumers. and in line with the principle of proof contained in UUPK and the second conclusion is that the res ipsa loquitur doctrine can be applied in cases of consumer protection if it fulfills the elements that are the requirements of the application of the re ipsa loquitur doctrine

    Normative provisions based on Chapter IV, Part Two of Employment, Article 25 Paragraph 3 of Law No. 6 of 2023 Concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 Concerning Job Creation to become a Law that stipulates that annual leave is given at least 12 (twelve) working days after workers or laborers have worked for 12 (twelve) months continuously. The gap in das sein is that the provisions of Chapter IV, Part Two, of Employment Article 25, Paragraph 3, of Law No. 6th, 2023, apply to workers in the company. Researchers observe that there is a gap between das sein and dass sollen. The formulation of the problem is: what are the normative rights of workers, and what are the sanctions for companies that do not provide workers' normative rights. The type of research used by researchers in this study is empirical-juridical. The research approach used is empirical-juridical, which is closely related to the case approach. The source of legal material uses primary data, namely interviews and observations conducted by researchers by visiting the research site directly. Secondary data uses primary legal materials, namely applicable laws and regulations, secondary legal materials, namely books, journals, and relevant previous research results, as well as tertiary legal materials in the form of websites. Data collection techniques using in-depth interviews and observation All primary and secondary data in this study were collected and analyzed qualitatively. Conclusions are drawn deductively. The result of his research is that the normative right to annual leave has not been implemented by the company. The conclusion is that the normative rights received by workers who are bound by PKWT at a Mining Contractor Services Company consist of economic rights, political rights, medical rights, and social rights. Sanctions for companies can be punishable by imprisonment for a minimum of 1 (one) month and a maximum of 12 (twelve) months and/or a fine of a minimum of Rp. 10,000,000.00 (ten million rupiah) and a maximum of Rp. 100,000,000.00 (one hundred million rupiah) in accordance with Chapter IV, Part Two of Employment, Article 68, Paragraph 1, of Law No. 6th, 2023, concerning Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation to become Law

    The movement of people across countries has both positive and negative impacts on society. Globalization has changed the way humans move massively and quickly. Indonesia, as a country with a strategic geographical position between two continents and two oceans, plays a role as a center of human crossing. Indonesia's vast sea area is an important potential to be developed, and President Joko Widodo initiated the World Maritime Axis policy to drive the economy in the sea area. Government agencies in the sea area are part of the ecosystem that supports policies in the sea area. Policies related to law enforcement in the sea area continue to develop along with the expansion of activities at the border. Immigration has a strategic role because it regulates traffic at the state border, maintains state sovereignty, and supports the implementation of sea area policies. This research aims to evaluate the strategic role of immigration by applying a progressive legal theory approach and using normative legal research methods. Progressive law returns the law to its substantial purpose, so that legal changes should not eliminate the substance. This research aims to answer the challenges of the times by adapting the law in accordance with the purpose of the law. In the context of international law of the sea (UNCLOS 1982), this research looks at the strategic role of immigration in law enforcement in the sea area, including the territorial sea zone and additional sea zone. The cooperation of law enforcement agencies in the maritime area is key to maintaining state sovereignty and security at the border. This research contributes to the understanding of the strategic role of immigration in supporting Indonesia's territorial sea policy

    Pembangunan sarana dan prasarana sebagai wujud program untuk peningkatan akreditasi pada KB Omah Among Kabupaten Malang. Studi ini mengevaluasi upaya kelompok Kuliah Pengabdian Masyarakat dibawah naungan Universitas Widyagama Malang dalam meningkatkan status akreditasi KB Omah Among Kabupaten Malang melalui pembangunan sarana dan prsarana berupa penanggulangan kebocoran ruang guru yang dialihfungsikan menjadi gudang. Kelompok kami menghadapi tantangan dalam memenuhi standar akreditasi KB Omah Among karena sarana dan prasarana yang kurang memadai. Untuk mengatasi masalah ini, kelompok kami melakukan rencana pengembangan sarana dan prasarana yang komprehensif, termasuk perbaikan ruang guru, pengecatan ayunan dan dinding ruang guru, pembaharuan struktur kelas, penyediaaan media belajar, serta penambahan media edukasi berupa lukisan dinding

    Legal Responsibility For Occupational Safety Of Parcel Delivery Courier Partners In Indonesia

    The lives of courier partners in the package delivery industry in Indonesia are full of safety-threatening challenges, especially when they use the "Cash On Delivery" (COD) payment system. Courier partners are often intimidated and mistreated by some customers, often buyers do not want to pay for COD packages because they feel the package is not suitable or the delivery is late, they must also be faced with the risk of traffic accidents. Courier partners are also considered informal workers who do not have clear attachments to service provider companies or government agencies, which causes companies to not have clear guidelines for risk management in this matter. This research was conducted to find out how legal responsibility for the work safety of courier partners in Indonesia and to find out the challenges and risks experienced by courier partners when carrying out their work. The research method used in this research is normative juridical using a statutory approach. Primary and secondary legal materials were obtained through literature studies and analyzed using descriptive methods. The results showed that the law enforcement used to protect the work safety of courier partners is Law No. 1 of 1970 concerning work safety

    Legal Review of Environmental Law Concerning Illegal Sand Mining

    This research aims to analyze the regulations, enforcement, and legal sanctions related to illegal sand mining in Batam City. Additionally, the study seeks to assess the environmental impact of illegal sand mining activities and evaluate the efforts made by the Batam City Government and law enforcement authorities in combating illegal sand mining practices. A normative juridical approach, particularly the statute approach, is employed in this research. The research methodology involves data collection, examination of legal regulations, doctrines, juridical aspects, and societal norms. The results indicate that authorities with jurisdiction should anticipate potential issues and environmental damage arising from illegal sand mining. Therefore, the protection of the environment and natural resources needs to be strengthened to ensure the safety of Batam City residents. The Batam City Government is expected to take decisive measures to halt illegal sand mining, including the implementation of criminal sanctions and confiscation of tools used by illegal actors in accordance with applicable regulations

    Effect of Internal Reflectors on Daily Performance of Double Slope Solar Stills with Porous Fin Absorber Plate

    The potential of energy and sea water in Indonesia is relatively high, but it has not been utilized massively to reduce the shortage of fresh water on the islands. Utilization of this potential can use solar stills. Solar still is a relatively cheap technology, easy to obtain materials, environmentally friendly and easy to construct, but this technology has shortcomings in its low productivity. Efforts to increase productivity have been made by many researchers, but there has not been a study of internal reflector integration in a double slope solar still using a porous absorbent plate tested for 23 hours. This study aims to examine the effect of adding an internal reflector on the performance of a double slope solar still. The performance of the double slope solar still is identified by evaluating freshwater productivity and efficiency. This research was conducted experimentally comparing with and without internal reflector. The addition of internal reflectors varies in placement, as for the placement on the north and south sides (RUS), the south side (RS), and the north side (RU). Data collection starts at 07.00 p.m. until 06.00 a.m the next day and is carried out for 5 days. Research comparing the performance of RUS, RS, RU compared to TR and concluded that there is an increase in temperature of fins, seawater and cover glass when using the addition of internal reflector. The increase in temperature has an effect on daily productivity for RUS, RS and RU between 12.88-16.13%, 8.71-12.56%, and 1.70-2.88%, respectively. In addition, the addition of the internal reflector has a positive effect on increasing the daily efficiency for RUS, RS and RU between 12.69-15.93%, 8.60-12.46% and 1.65-2.82%, respectively

    PERENCANAAN BENDUNG PADA STUDI KASUS DAERAH IRIGASI TAPUS KABUPATEN TANAH BUMBU KALIMANTAN SELATAN

    Bendung Tapus merupakan bangunan utama yang berfungsi untuk mengairi irigasi pada sub-DI Tapus Kiri seluas 6.183,3 hektar dan sub-DI Tapus Kanan seluas 2.344,7 hektar. Perencanaan Bendung Tapus merupakan salah satu upaya menyuplai air irigasi untuk Bendungan Kusan. Bangunan utama Bendung Tapus direncanakan menggunakan mercu tipe bulat dengan mempertimbangkan kriteria pemilihan tipe mercu yang berdasar pada Pedoman Kriteria Perencanaan. Berdasarkan perhitungan hidrolis Bendung Tapus direncanakan memiliki tinggi 2,65 m dengan lebar 38,70 m dan jari-jari mercu 1,40 m. Peredam energi direncanakan menggunkan tipe bucket dengan jari-jari 7,10 m untuk mencegah terjadinya kerusakan peredam energi akibat adanya gaya hantam, karena jenis sungai yang membawa material hanyut berupa batuan besar (boulder). Bangunan pengambilan pada Bendung Tapus Kiri direncanakan mempunyai 4 buah pintu dengan lebar 1,50 m dengan 3 buah pilar selebar 1 m. Untuk bangunan pengambilan Tapus Kanan memiliki 2 buah pintu dengan lebar 1,50 m dengan pilar selebar 1 m. Bangunan pembilas direncanakan berada di sebelah kanan dan kiri bendung. Dengan lebar pintu 1,20 m sebanyak 3 buah dengan 2 pilar selebar 0,90 m untuk bangunan pembilas sebelah kiri. Dan lebar pintu 0,80 m sebanyak 2 buah dengan pilar selebar 0,80 m untuk bangunan pembilas sebelah kiri. Struktur keamanan bangunan Bendung Tapus direncanakan aman dan stabil dalam kondisi normal dan gempa pada saat air normal dan air banjir

    PERBANDINGAN BIOETANOL DARI LIMBAH KULIT NANAS DAN LIMBAH KULIT PISANG

    Sumber daya alam tak terbarukan semakin terkuras oleh eksploitasi tanpa batas. Untuk mengurangi ketergantungan pada bahan bakar fosil, bioetanol dari limbah kulit nanas dan pisang dipelajari dalam penelitian ini. Penelitian ini menggunakan metode eksperimen dengan bahan baku bioetanol dari limbah kulit nanas dan kulit pisang, serta alat destilasi. Variabel bebas penelitian ini mencakup penggunaan kulit nanas dan kulit pisang, variabel terikat meliputi kadar bioetanol, suhu fermentasi, suhu destilasi, suhu api pembakaran, dan karakteristik titik api. Variabel terkontrol termasuk berat fermipan untuk fermentasi dan berat kapas untuk uji pembakaran.Kulit nanas menghasilkan bioetanol 92,8%, sedangkan kulit pisang 88%, karena kandungan gula yang lebih tinggi pada kulit nanas. Proses fermentasi dan distilasi diamati selama beberapa hari dengan hasil yang menjanjikan untuk menjadi bahan bakar alternatif

    ANALISIS PENGENDALIAN BIAYA DAN WAKTU PADA PROYEK TRANSMISI 500 KV DI SUMATERA DENGAN METODE EARNED VALUE: STUDI KASUS MUARA ENIM – NEW AUR DURI

    Pemerintah Indonesia terus mengembangkan jaringan transmisi listrik dalam program kelistrikan jangka panjang. Proyek Pembangunan Transmisi 500 kV Sumatera Paket 3 Zona 4 & 5 Muara Enim – New Aur Duri merupakan proyek strategis untuk meningkatkan kapasitas daya dan keandalan listrik di Sumatera, dengan nilai kontrak Rp 2.979.717.105.158 dan durasi 1095 hari kalender. Namun, pada minggu ke-76 di bulan Juli 2023, prestasi proyek baru mencapai 21,679% dari target 40,375%, menyebabkan deviasi -18,696% dan potensi keterlambatan penyelesaian proyek. Penelitian ini mengevaluasi pengendalian biaya, waktu, dan pekerjaan proyek menggunakan metode Earned Value (EVA). Metode kualitatif dan kuantitatif digunakan dalam penelitian ini, dengan data diperoleh melalui wawancara, observasi, dan studi dokumentasi. Indikator kinerja yang dihitung meliputi Earned Value, Actual Cost, Budgeted Cost, Schedule Variance, Cost Variance, Budget at Completion, Cost Performance Index (CPI), Schedule Performance Index (SPI), Remaining Work at Completion, dan To Complete Performance Index. Hasil penelitian menunjukkan proyek mengalami keterlambatan signifikan dengan penyimpangan jadwal sebesar -Rp 705.795.603.206, namun efisiensi biaya tinggi dengan penyimpangan biaya Rp 1.924.910.568.803. Indeks Kinerja Jadwal (SPI) sebesar 0,737 mengindikasikan proyek lebih lambat dari jadwal, sementara Indeks Kinerja Biaya (CPI) sebesar 36,830 menunjukkan efisiensi biaya yang tinggi. Perkiraan Biaya untuk Pekerjaan Tersisa (ETC) adalah Rp 957.558.879.185 dan Perkiraan Biaya pada Saat Penyelesaian (EAC) adalah Rp 1.011.282.531.640, lebih rendah dari anggaran yang direncanakan. Disimpulkan bahwa proyek mengalami keterlambatan signifikan dan perlu upaya percepatan penyelesaian. Rekomendasi meliputi optimasi sumber daya, peningkatan koordinasi tim, penjadwalan ulang dengan penambahan shift atau lembur, pemantauan progres real-time, evaluasi rutin, dan pengendalian biaya ketat
