La digitalizzazione della cooperazione giudiziaria in materia civile e commerciale nell’Unione europea: L’assunzione transfrontaliera delle prove nel prisma della piattaforma informatica decentrata e-CODEX
The contribution deals with the new EU rules on the taking of evidence abroad in civil and commercial matters covered by the Regulation (EU) n. 1783/2020. First, the author describes the main aspects of the Regulation, with particular emphasis on the provisions dedicated to e-justice. One of the main focuses of the paper is the “digital by default” principle, that identifies the digital channel as the preferred method of communication between authorities of Member States. The coordination amongst national judicial systems lays on a decentralised and interoperable IT platform, based on the e- Justice Communication via Online Data Exchange technology (e-CODEX): the taking of evidence exchange system (ToE). Therefore, in light of the Regulation (EU) n. 850/2022, the author introduces the most important features of the e-CODEX. Finally, the last part of the paper addresses the issue of the compatibility between the use of the abovementioned technology and the protection of fundamental human rights.Il contributo affronta il tema della nuova disciplina europea sull’assunzione di prove all’estero in materia civile e commerciale recata dal regolamento (UE) n. 1783/2020. L’autore ne esplora gli aspetti principali, dedicando particolare attenzione alle disposizioni in tema di giustizia elettronica, emanazione del principio digital by default, attraverso cui il canale digitale è stato elevato a metodo di comunicazione predefinito e preferenziale tra le autorità competenti degli Stati membri. Il coordinamento tra i sistemi giudiziari nazionali passa attraverso una piattaforma informatica decentrata ed interoperabile, basata sulla tecnologia e- Justice Communication via Online Data Exchange (e-CODEX) che, nel contesto dell’assistenza istruttoria transfrontaliera, assume la denominazione di sistema “taking of evidence” (ToE). In seguito, il regolamento (UE) n. 850/2022 introduce i caratteri essenziali di e-CODEX. Da ultimo, viene discussa la compatibilità dell’impiego di tale tecnologia con l’esigenza di salvaguardare i diritti fondamentali e le garanzie processuali degli individui
Incoación expropiatoria del palacio de los Álava-Esquivel desde el Derecho español y el Derecho internacional
The Álava Esquivel Palace, a property located in Vitoria-Gasteiz, is declared Basque cultural heritage. However, its owner is the Tangier City Council. Currently, the Vitorian palace is deteriorated and in danger of falling, due to non-compliance with its duties as owner of the municipality of Tangier. For this reason, this study proposes the expropriation of the property, by and for the Vitoria-Gasteiz City Council, through a unilateral expropriation and/or a lump sum agreement.El Palacio de los Álava Esquivel, inmueble situado en Vitoria-Gasteiz, está declarado como patrimonio cultural vasco. Sin embargo, su propietario es el Ayuntamiento de Tánger. Actualmente, el palacio vitoriano se encuentra deteriorado y en peligro de desprendimiento por el incumplimiento de los deberes como propietario de la municipalidad de Tánger. Por ello, el presente estudio plantea la incoación expropiatoria del inmueble, por y para el Ayuntamiento de Vitoria-Gasteiz, a través de una expropiación unilateral y/o un acuerdo de suma global.

Anti-arbitration injunction y Ley de Cooperación Jurídica Internacional
Recently a Court of First Instance of Madrid rejected the recognition in Spain of an Anti-arbitration injunction issued by a third State (a non-EU Member State). This is the irst Spanish jugdment that has addresses such a controversial issue. Although the resolution is certainly brief, it is worth taking the opportunity to consider in some detail and to generalize whether these types of mea-sures or judicial resolutions are or are not recognizable in Spain in the application of the International Legal Cooperation Act.De forma todavía reciente, un Juzgado de Primera Instancia de Madrid ha rechazado el reconocimiento en España de una Anti-arbitration injunction dictada por un tercer Estado (un Estado no miembro de la UE). Se trata de la primera resolución judicial española que aborda directamente tan con-trovertida cuestión. Pese a que la resolución es ciertamente escueta, merece la pena aprovechar la ocasión para plantearse con cierto detenimiento y en abstracto si este tipo de medidas o de resoluciones judiciales son o no reconocibles en España en aplicación de la Ley de Cooperación Jurídica Internacional

In the context of cross-border real estate, private international law is relevant due to the legal challenges that arise when a property is situated in two or more different states. Whether that property is contiguous or separate, whether it is for professional leasing or not, there are multiple cases and scenarios that can be encountered, and this paper aims to delineate some of them.En el contexto de inmuebles transfronterizos, el derecho internacional privado es relevante debido a los desafíos legales que surgen cuando una propiedad se encuentra situado en dos o más Estados diferentes. Si ese inmueble es contiguo o separado, si es para un arrendamiento de tipo profesional o no. Son múltiples los casos y supuestos que se pueden encontrar y en este trabajo se pretende delimitar algunos de ellos

Caso superliga: Comentario de la stjue de 21 diciembre 2023, c-333/21
In the judgment in question, the CJEU answers the questions referred for a preliminary ruling by the 17th Commercial Court of Madrid in the case brought by the Superliga against FIFA and UEFA. Those questions concern whether the decision of those two bodies not to authorise the holding of the Superliga in their markets of activity infringes competition rules and European freedoms. The Court concludes that it does. It states that, in relation to the competition rules, which are the subject of this study, this conduct by FIFA and UEFA constitutes an abuse of the dominant position held by these companies by preventing new competitors from entering the market (art. 102 TFEU) and, furthermore, as associations of undertakings, their conduct is harmful to competition and cannot be exempted from the sanction, inter alia, for eliminating competition on the market (art. 101 TFEU).En la sentencia objeto de comentario, el TJUE responde a las cuestiones prejudiciales planteadas por el Juzgado de lo Mercantil número 17 de Madrid en el caso de la demanda interpuesta por la Superliga contra la FIFA y la UEFA. En estas cuestiones se pregunta si la decisión de estas dos entidades de no autorizar la celebración de la Superliga en sus mercados de actuación vulnera las normas de competencia, además de las libertades europeas. El Tribunal de Justicia concluye que sí. Indica que, en relación con las normas de competencia, que son las objeto de estudio en este trabajo, este comportamiento de la FIFA y la UEFA supone un abuso de la posición de dominio que ostentan estas empresas, al impedir la entrada de nuevos competidores en el mercado (art. 102 TFUE) y, también, como asociaciones de empresas, su conducta lesiona por objeto la competencia de sus asociados (art. 101.1 TFUE) y no puede quedar exenta de la sanción, entre otras razones, por la ya comentada de impedir la entrada de nuevos operadores al mercado (art. 101.3 TFUE)
Reflexiones en torno a la jurisprudencia del TJUE sobre la acción indemnizatoria del art. 82 RGPD (asuntos C-300/21; C-340/21; C-456/22; C-667/21; C-687/21; C-741/21)
The purpose of this paper is to address the issues raised by the recent case law of the CJEU on Art. 82 GDPR. Although in theory the judgments analysed are intended to “clarify” the meaning of this provision, in some aspects they are not very enlightening, either by raising new doubts or by adopting confusing approaches to key elements of liability.El propósito de este trabajo es poner de manifiesto las interrogantes que suscita la reciente jurisprudencia del TJUE en torno el art. 82 RGPD. Aunque teóricamente las sentencias analizadas vienen a “aclarar” el sentido de dicho precepto, en algunos aspectos resultan poco esclarecedoras, bien arrojando nuevas dudas, bien realizando planteamientos confusos en torno a elementos claves de la responsabilidad
El consumidor europeo: ¿un caso de identidad equivocada?
European consumers enjoy protection, if they are natural persons who act outside professional purposes and have as counterparts professionals (traders). Applying the test of the three conditions, it is possible that consumers who do not need protection to fall within the scope of the consumer protection laws. This is the reason why we are wondering about the “identity” of the European consumer.To elucidate the issue we will use a few questions, which, in a logical sequence, would be asked by any jurist more or less familiar with the matter of EU consumer protection. First, why do consumers need protection? Are they vulnerable? How are consumers protected and “identified” in cross-border contracts? Does the irrebuttable presumption of consumer vulnerability generate fair judgments?We will conclude by pointing out that EU consumer protection has reached a critical moment, when the irrebuttable presumption of consumer vulnerability generates exaggerations and, possibly, imbalances. Protective laws are used as a shield by consumers who do not actually need them, which produce results that are contrary to the purpose for which they were designed .Los consumidores europeos gozan de protección, si son personas físicas que actúan fuera de fines profesionales y tienen, como contrapartes, profesionales (comerciantes). Aplicando la prueba de las tres condiciones, es posible que los consumidores que no necesitan protección caigan dentro del alcance de las leyes de protección al consumidor. Ésta es la razón por la que nos preguntamos sobre la “identidad” del consumidor europeo.Para dilucidar la tema utilizaremos algunas preguntas que, en una secuencia lógica, formularía cualquier jurista más o menos familiarizado con la materia de la protección del consumidor en la UE. ¿Por qué los consumidores necesitan protección? ¿Son vulnerables? ¿Cómo se protegen y se identifican los consumidores en los contratos transfronterizos? ¿La presunción irrefutable de vulnerabilidad del consumidor genera decisiones justas?Concluiremos señalando que la protección del consumidor en la UE ha llegado a un momento crítico, en el que la presunción irrefutable de la vulnerabilidad del consumidor genera exageraciones y, posiblemente, desequilibrios. Las leyes protectoras son utilizadas como escudo por consumidores que en realidad no las necesitan, lo que produce resultados contrarios al propósito para el que fueron diseñadas
