NE: Hi, I'm Nicole Eva, one of the librarians at the University of Lethbridge. I'm here with Dr. Adriane MacDonald, Professor of Policy & Strategy with the Dhillon School of Business. We got together to discuss open access, a topic which we both feel quite strongly about. Welcome, Adriane!
AM: Hi Nicole!
NE: Hi, thank you for joining us. So first of all, can you tell me why you're so passionate about open access?
AM: So why do I care about open access? I mean, one thing that really gets me going about open access is – one thing that really irks me I guess is, I don't really like the idea of public funds subsidizing large corporations, to benefit greatly from our research and our skill sets as reviewers as well. And then, to sort of come back; one thing that we talked about when we first started talking about this consideration that I didn't actually think about was how much it was costing the libraries to then get those subscriptions and those bundles that they do to push our libraries into buying packages that are much larger than we might need or including things that we might not want. And the financial strain that puts on our institutions. And it just really seemed to me as, really illogical, as to why this is something that's occurring. Of course, there's also the equity issue and making sure that people have access to the information that, in particular, that public institutions fund, at least in the Canadian context. And that whole other piece. But really what gets me is, why are we letting this happen with these large publishers? It just doesn't make any sense, especially in the climate right now where we have so much austerity. Where the idea of austerity and lack of resources is imposed on our universities. Why are we putting resources into this? It doesn't make sense to me.
NE: So how do you put that in action in your own research? How do you support open access?
AM: Yeah, I mean, I could do better. But the things that I – some of the stuff that I do for my research is I do look for open access journals, if possible. I, you know, really I also don't want to pay.
NE: Yeah, I always counsel people not to pay!
AM: Yeah, yeah. Like I don't want to do that either. So I should have said that I try to look for opportunities like that, but then I do the pre-prints. I haven't done it for OPUS, which I will, we just discussed. We do post those pre-prints onto one of our research websites. And I'll always make sure to do that even when I'm not doing research with that group and doing other research, I do try and make sure that those pre-prints are available. And then in my classroom, which is a little bit different than the research context, I try my best to assign readings and use resources that are already available to the students through the library. So using journal articles, asking them to look up journal articles, they also get that skill set as well. But just trying my best to use resources that are freely available to them or already paid through their tuition through the library. So those are two things that I do and then it's just an issue that generally I talk about with other academics. And then also we had written that article piece to raise additional awareness around this issue because I know before talking to you, it was definitely something that bothered me. But in learning more about the impact that it has on libraries… and then that really got me going. I definitely support the open access policy that we have at the University of Lethbridge and have contributed in a very light way.
NE: Well, that's sort of a segue to my next question I have written down, which was if your understanding of open access had changed at all from being involved in that?
AM: It certainly changed from working with you on the article that we worked on. I definitely learned a lot more. I guess one thing that really came to the forefront for me when talking to the group about the policy is there are these barriers in terms of workload. So a lot of my colleagues and I, myself, already feel like I'm overextended. So even though sending that… preparing the pre-print, or sending that one email off, doesn't seem like a lot – but when you're already doing all of these other things at seven o'clock at night when you just want to close your computer, and you just cannot do one more thing. Like it's just not, you know, even though it's something that I value deeply, and I know a lot of my colleagues do, having that One More Thing… it's hard. It's just hard and it doesn't sound like a big thing, but that was like… so thinking about how we can… and I think like what you talked about, you know, it's actually really easy. So one thing that I learned is just even from talking to you, and also I think I knew from when we were working on the policy, the librarians make it much easier for us to, you know, they do the work of looking into, like you said, the copyright and seeing what it exactly is that they need, and posting. And so a lot of that work is taken away. But, you know, at the end of the day though one thing as researchers – and I think that this is something that I need to remember – is that actually we benefit a lot from having it on there. So any article that I make sure to have publicly available gets cited more and that benefits me; but it, you know, and it also gets the research out there. And also it gives practitioners access to the articles as well. So not even just about citations, it’s also about making the information accessible to practitioners. And in the work that I do that is really important. It's important for probably all academics.
NE: Yeah, but especially when some of your people that you're trying to reach are non-academics; I mean, how else are they supposed to read this stuff? AM: Exactly. Yeah, I mean, so my most recent article, we put it out on Twitter and we were getting all these direct messages from local government practitioners wanting access to this article, right? So which is why we got it out on that pre-print article publicly available on the website, which we do always, but sometimes it's faster than than other times.
NE: That's great! Thanks so much. Dr. MacDonald, I think you've really hit most of the high points about the discussion of open access and its importance to us in academia. I really appreciate you taking the time to talk to me today.

Post-Secondary Educational Copying
The continued global state of flux in the copyright realm remains particularly palpable across the Canadian post-secondary sector. One issue that presently looms large is the outcome of York University v. Access Copyright (AC), a case in which York has appealed a July 2017 Federal Court decision. The appeal hearing took place in March 2019, but the Federal Court of Appeal has yet to deliver its ruling. For an overview of what’s at stake, see the September/October 2017 issue of this column.
Another key issue is tariffs. Last month the U of A, U of C, and U of L copyright offices prepared a joint objection to AC’s proposed post-secondary copying tariff for 2021-2023. Among other things, AC’s latest proposed tariff retains the 14.31 per student. Even though the proposed tariffs covering 2018 to 2023 are not yet certified, s. 73.2 of the Copyright Act provides that if a proposed tariff’s effective period begins before approval is in place and if that effective period immediately follows the expiry of a previous certified tariff, then that previous tariff’s permitted acts and royalties remain in effect. In other words, as long as AC continues to file proposed tariffs that leave no daylight between the expiry of one tariff and the effective date of a subsequent proposed tariff, terms of the latest certified tariff may continue to apply.
So must all institutions participate in the recently certified AC post-secondary tariffs? That, in a nutshell, is one of two key issues on which AC and Canadian post-secondaries fundamentally disagree, which led to the suit launched by AC against York in April 2013 (currently under appeal). The tariff question boils down to this: Is it a university or college mandatorily subject to the terms, conditions and payable fees of a certified tariff regardless of whether or not the institution deems the tariff to be an effective way to address its copyright compliance obligations? The Federal Court’s July 2017 decision suggests ‘yes,’ although the tariff at issue was an interim tariff. Thus, we await a Federal Court of Appeal decision regarding York’s appeal.
The New New NAFTA Agreement
The new NAFTA agreement (CUSMA) signed in November 2018 was recently amended in December 2019. Mexico’s Senate approved the revised version in December 2019 and the U.S. Senate did the same in January 2020, allowing the U.S. ratification process to move forward as the agreement now awaits U.S. Presidential approval. Canada has not yet begun its process to ratify the agreement, but that may change after Parliament resumes sitting at the end of January.
But does this trade agreement have anything to do with copyright? It does. Chapter 20 of the agreement is dedicated to IP rights, including patents, trademarks, and copyright. Section H, “Copyright and Related Rights,” includes the following provision in Article 20.63:
The new agreement comes into force three months after all three countries complete their domestic processes for ratifying the agreement. In Canada, the Federal Cabinet will ratify the new agreement after all laws and regulations needed for enforcing the agreement are in place. Canada will be obligated to amend the Copyright Act to extend the term of copyright protection as provided in Article 20.63. Currently the term of copyright in Canada is the life of an author plus 50 years after death, which is the long-standing minimum term stipulated in the Berne Convention. My hope is that Parliament implements the required copyright term extension in a way that ameliorates the resulting curtailment of the public domain in Canada.1
Open Access Policy
On a brighter note, in December 2019, General Faculties Council approved a motion to adopt the proposed Open Access Policy. See the Library’s Open Access Policy page for more information.

“16 new runners signed up to run this year. We participated in many local events, including the Run for
the Pumpkin 4km and the Lethbridge Police 5km. We had a promising group of grade 9 athletes, who
did well at both cities and zones. Our seniors did well on a challenging course during Zones in
Cardston. Grade 12 athlete Brody Roelofs attend Provincials running in the Senior Boys 6km. We look

The 2016 Bulldog Football season was showcased by a group of players who exhibited hard
work and determination day in and day out. A highlight of the season was a late August
trip up North to Edmonton and Cold Lake where the Bulldogs played in a 3 team
pre-season jamboree and took in a very exciting CFL game between the Eskimos
and the Rough Riders. We are all looking forward to another exciting season in
2017andwe wish all of our Graduating players the best of luck in all of their

Winston Churchill’s curling teams competed against the four other high schools in a
round Robin Bonspiel throughout the year. Churchill’s teams wer very competitive
and showed exceptional sportsmanship throughout the season. Our girls team was
successful in winning a spot in the South Zone play downs this year.

building and competition. Through participation in the
Chinook Invitational Tournment, the grade nine
Jamboree and Lethbridge City Playdowns, the
students have played hard and shown great spirit.
Many moved on to play at the zone level, with
Provincials in their sights.

After coming off of their 4th Provincial Championship win in five years, the Griffins are aiming for
a 3rd consecutive win in the 2017 season. The graduating class is hard working and
showing great potential and coachability which will help the strength of the program for
years to come.

The 2017 Track & Field season looks very promising! A ton of new athletes
have joined the team, with a large number of those students in grade 9. We
are looking forward to the athletes developing over the next track & field
seasons, as they figure out which events best suit their abilities. Our joint
practices at the U of L with the other high schools are always beneficial as
the students train for their respective meets-the practices really give those
athletes who attend a competitive edge! We are also fortunate to have
a few returning upperclassmen with lots of experience to share with
the new athletes. How will the season turn out? Only time will
tell!
