(Volume. 2001-02)pdf1^'ST^ Administrators’Message It is with great pride that we, the administration team at Gilbert Paterson Community School, have served you over the past year. At times the 2001-02 school year has been difficult and at times exciting. But together we have grown as a community to become caring, concerned and compassionate citizens. The events of September 11, 2001 brought a sudden realization that we in Lethbridge do not live in isolation from the rest of the world. In spite of this unrest and uncertainty, there has never been a more favourable time in this great nation of ours. Young Canadians have educational and lifelong oppor­tunities abound. The choices presented can be mind-boggling, as technology has created a limitless boundary to our imagination. Yet, it is reality, which forces us to become strong citizens. Emerson said, “It is one of the most beautiful compensations of life that no man can sincerely try to help another without helping himself’. Young Canadians like yourselves must take the opportunities and advantages you have to work hard and make Lethbridge, Alberta, Canada and the World a community of caring, concerned and com­passionate citizens just as you have done at Paterson. Published in Canada Printed in USA 2001 On August 22 & 23, 2001, 22 students and 16 teachers participated in a Leadership Retreat at Gilbert Paterson Community They painted, ate, played games, ate, designed logos, ate, had a fashion show, ate, played ninjas, and got to know each other really well. The Ninjas in the Dark game got pretty crazy according to the stories the next morning. But they sure learned how to have fun and how to be good leaders for the years to come! 2 Leadership Retreat- August 2001 3 Welcome to Grade Nine To kick-off their return to school and their last year at GPCS, the grade 9s were treated to a pancake breakfast cooked and served by the teachers. With Mr. Philpott, Mr. Usman, Mr. Scott and Mr. Smith to pour and flip, what could possibly go wrong? 4 Welcome Back Breakfast 5 Turkey Trot 2001 On October 5, 2001 ,the Grade 8 Leadership class lead students at GPCS in a TURKEY TROT. Both the elementary and middle level students participated in the event that morning. Students were to partner up and then estimate the time it would take them to circle the school yard TWICE. The person(s) who walked, ran, skipped or whatever closest to their estimated time won— YOU GUESSED IT-- a turkey for 6 Halloween 2001 J. M 7 Outdoor Ed 8 Writing on Stone October 10-12,2001 Oct. 10- Mr. Boulet gathered his group outside of GPCS. Along with Mrs. Lysak and Mrs. King, they boarded a bus for Writing-On-Stone with none other than Mr. T. Spackman driving! Did they know what they were in for? Day One:winds calm but cool. Students set up camp in designated areas and then explored while the 3 fierce leaders, Boulet, King and Lysak lunched. One group returned from their explorations to find that a few birds had chewed their way into their food boxes. Sure nice of them to share with the locals!. With snacks in hand to feed Mr. Boulet and themselves, the students were lead on a hike around the park. They saw beautiful hoodoos and land features, cool ancient writings and SNAKES! Yep! Having only heard stories about snakes and slitheries, the group actually saw a rattle snake crawling around in his hole. That night the wind shook the tents while the coyotes howled while they slept. hen are we going —HOME? IIIKnWX. Day Two: windy, rainy, cold- The park officer came by with her bus and took the group on an official tour of the Writing On Stone park. She told stories about the native people who use to live on the land and pointed out the different writings left behind. Once back at the campsite, the group played Capture the Flag and explored the hoodoos nearby. Johnny, however, tried desperately to please his team and ended up with a sprained ankle. Needless to say, he had to get Mr. Boulet to give him a piggy back ride back to the campsite where he was attended to by Nurse Lysak. That night, after roasting marshmallows and singing campfire songs, they fell asleep to the howling of the coyotes and the snoring of their leader, Mr. Boulet......or was it Mrs. Lysak???? Day Three: Up and at it at the crack of dawn to return to GPCS.     Library Lore | Spring 2021 / Issue 7 1 To date, Karen, Chelsey, and Cindy have altered over 2,000 authority records from the original Library of Congress records and their associated bibliographic records, over 600 of which they have created completely new authority records for. Over 12,000 bibliographic records have been updated with new and/or revised subject headings (containing over 40,000 headings). Not only does this represent a large volume of work but it is work that is nuanced and requires specialized knowledge of library records, Library of Congress Subject Headings (LCSH), Indigenous Subject Headings, and library content management systems. The largest overall change has been correcting the LCSH Indians of North America to Indigenous Peoples throughout the catalogue. As not all records in the catalogue lend themselves to global update, the team continues to work through records. Some terms, such as “Métis” and “Michif” require that the subject matter of each catalogued item on the topic be evaluated to determine which term is applicable. Regional terminological differences between the US and Canada also require that individual records be investigated as to where they are referring to in North America. Further, ensuring that the authorized nation name in the catalogue is the known and approved name of the nation itself requires specialized and ongoing attention and monitoring. This monumental project faces challenges as the Library of Congress has not decolonized their classification system, and the records from OCLC are still being ingested by the library’s catalogue with older headings which require evaluation. As the team waits for the Library of Congress to decolonize their classification scheme, they are also looking at moving all works in the library’s collection created by, and some works created about, Indigenous peoples into the newly created Our Stories location on Level 10. The next steps in this project will include employing all these standards in the Library’s digitized collections which will involve evaluating the metadata associated with items in OPUS and the Digitized Collections. The University Library is proud of the work being done by this team to assist us in addressing the Canadian Federation of Library Associations’ Truth & Reconciliation Report and Recommendations (2017). In Spring 2019 a team of Technical Services staff, consisting of Karen McCallum, Chelsey Rathwell and Cindy Venhuis, began investigating the processes of decolonizing the cataloguing standards, subject heading assignments, and call number classifications. The investigation started by doing research regarding naming conventions of Indigenous peoples. After reviewing projects undertaken at several North American institutions, including the Xwi7Xwa Library at UBC, the ULeth Library team settled on the recommendations of the Manitoba Archival Information Network - Library of Congress Subject Headings (MAIN-LCSH) Working Group as being most applicable to our context. MAIN-LCSH strongly encourages other libraries to use their work on Indigenous Subject Headings to help with the decolonization projects. In the meantime, here are the faces you won’t be seeing around the library anymore (when we finally reopen!): Lynne Brown I began working at the University of Lethbridge on May 1st, 1974 in the cataloguing department. My initial plan was to work for a couple of years; well, 46 years later I retired from the Library. In 1976 I transferred to the Serials department, in 1980 I transferred to the Circulation department, and I finished my career in the CDS/GSD (Collection and Database Services/General Services Desk) departments. Over my years here I have met and worked with so many amazing people; I have loved my job at the University. Many lifelong friendships were formed. I can’t even begin to share favorite memories, there are so many of them. Everyone I worked with knew I liked things organized and straight so would often mess things up just to bug me. After a while I knew not to let it get to me; I would just follow them on shift and casually straighten things back up. I could have continued working for another 46 years; however, I do believe there does come a time to move on to the next chapter in your life, so I have done that. In retirement I plan on spending more time with family, my dogs, biking, golfing, having get-togethers with other retired staff, and eventually accepting that it’s okay to relax. Betsy Greenlees I started working at the University of Lethbridge in September 2001 in the Dean’s Ofice of the Faculty of Management. In April 2005 I moved on to the University Bookstore, working with faculty and the Copy Centre to produce student coursepacks. In September 2011 I landed in the new University Copyright Advisor ofice in the Library, as the copyright world became more complicated. Faculty, staf, and students consulted with the ofice on copyright matters for coursepacks, digital and print reserves, Moodle, presentations, theses…. For the last few years, I also assisted patrons at the General Services Desk. During some of my spare time, I provided freelance proofreading and copy editing for faculty, students, and several University publications. Now genealogy, photography, gardening, quiltmaking, and winemaker’s assistant (head bottler and quality assessor) are on my agenda. Our patio is always open for visits and/or assistance with the wine quality assessment – Dr. Deena’s health guidelines permitting! I have met and worked with so many wonderful people at the U of L over these 19 years, and many colleagues have become good friends. I wish you all the best in navigating these challenging times and hope some sort of normalcy returns soon! Carolyn Gaebel Hi All! Most of you are probably working from home these days and staying as safe and healthy as you can. And where am I, you ask? Well, this past August, I retired from the University of Lethbridge Library after almost 24 years. My background in libraries started in Lahr, West Germany, where my husband Terry and I were stationed with the military in 1988. I volunteered at the Canadian school library, which turned into a job where I learned how to do almost everything within a small library setting. When we moved back to Canada, I worked at a special government library for the Forestry Department in Fredericton, NB. I never knew there were so many kinds of classification systems for books. The one I remember the most was called the Universal Decimal Classification; another one was the Colon Classification. So, throw in a couple more and you have chaos in the stacks when trying to shelve books. Not sure if I ever got the hang of it. After Terry retired from the military we moved to Lethbridge in August 1996, and in November of the same year, I started working in the University Library. The library was located across from the cafeteria when I joined the Circulation Department. A great location, in the thick of things, so to speak. When I was not helping someone at the desk, I was adding reserves to our collection, entering data for maps, doing book repairs, and volunteering in our Interlibrary Loans Department. Before we moved the library into the new LINC building in 2001, the Circulation Department was disbanded, and I joined the Interlibrary Loan Department in behind the scenes. I worked there until I retired. At the same time, I was also part of the General Services Desk staff working at the front desk. Retirement? I am not sure what I thought I would be doing once I retired, but I joined the Great Canadian Plains Railway Society, who run the Galt Historic Railway Park just outside of Stirling, as their Treasurer, and I have been quite busy ever since! In our hopefully not too far away future, we plan to do some traveling, whenever we can, whenever it is safe to do so. I really enjoyed my time working in the University Library, and I miss all the staf and interacting with the patrons. Stay healthy and take care. Open Educational Resources During Open Access Week in October, the U of L was delighted to host Dr. Christina Hendricks from UBC. Dr. Hendricks is a professor of Philosophy, an expert in Open Educational Resources, and the Academic Director of the Centre for Teaching, Learning and Technology at UBC. Open Educational Resources (OER) are resources such as textbooks, videos, or images, that are free of cost to access digitally and that have an open license that allows reuse, revision, and redistribution. In addition to the cost savings for students, if educators replace commercial resources in their courses with OER, the benefits include being able to reuse and revise OER, adapting them to better fit a particular course or context, and easily keeping them up to date. Online events with Dr. Hendricks were very well-attended, and included educators from the U of L, Lethbridge College, across Alberta, and farther afield. Passion for Open Education was stoked by expert panelists, and educators learned new ideas and skills in a Pressbooks workshop. Pressbooks is one of the options for creating open textbooks, which is supported by Open Education Alberta and available for U of L educators to use. There are already thousands of high-quality, free, accessible Open Educational Resources that have been created and are available for use, re-use, and adaption in courses in many subject areas. Others were worried that they would not have time to contact their publishers to tell them about the new policy. This article explains how both of these concerns have been addressed. Most importantly, contributing your scholarly article to OPUS is easy and does not require you to contact your publisher. As soon as you receive notification that your scholarly article has been accepted for publication, all you need to do is forward the notice along with your accepted manuscript to [email protected] (this address is in the OA Policy itself and at the top of the OPUS homepage). Library staff will check your publisher’s policies to ensure that any required embargo period or prohibition against public archiving of the accepted manuscript is observed. In addition, earlier this year the Library compiled a list of 138 publishers that published one or more scholarly articles by U of L authors within the past four years. These publishers were identified primarily through the Web of Science database. Each publisher in the list received a letter from the University Librarian informing them of the University’s Open Access Policy and its applicability to all U of L academic staff, students, and post-docs. You can find a copy of the letter to publishers and the list of publishers who received the letter on this page. If publishers of your scholarly articles are not on the list and you would like them to receive a copy of the letter, please feel free to notify your subject librarian who will be happy to make the arrangements with the Library’s Research Services team and Library Administration.     1 Copyright Corner, May/June 2021 AC v. York at the SCC On May 21, 2021 the Supreme Court of Canada (SCC) heard the Access Copyright (AC) v. York University (York) case launched by AC in April 2013. For brief overviews of prior stages of this case, see the earlier Copyright Corner columns on rulings from the Federal Court (FC) in July 2017 and the Federal Court of Appeal (FCA) in April 2020. Even before it was underway, the hearing was destined to be a milestone because it was the last case to be heard by Justice Rosalie Abella as a member of the SCC before her retirement in July. The Canadian education sector is fortunate that the hearing took place during Justice Abella’s tenure on the SCC, as it was she who penned the 2012 SCC majority decision in Alberta (Education). That ruling, along with the addition of “education” to the s. 29 fair dealing purposes of the Copyright Act in 2012, triggered a sea change in how Canadian educators understand the scope of educational fair dealing. Before commencing the hearing, SCC Chief Justice Richard Wagner paid tribute to Justice Abella’s illustrious 45-year judicial career, which includes 17 years as an SCC judge. He thanked her for being such a strong champion of equality rights (among other things, she led the 1984 Royal Commission on Equality in Employment and gave us the term “employment equity”) and for her instrumental role in developing jurisprudence in this and other areas of the law. Justice Abella was invited to share a few words in which she expressed gratitude for colleagues and family who have supported and enriched her work and life experiences. She noted that she has been guided throughout by a desire to make justice and equality a reality for all Canadians. Turning to the May 21 hearing, counsel for AC led off by asking the SCC to overturn the FCA ruling that approved tariffs are not mandatory and to uphold the FC and FCA opinions that York’s fair dealing guidelines are not fair. AC’s main contention on the tariff question was that the 1988 and 1997 Copyright Act amendments expanding the collective administration of copyright beyond performing rights for music were intended to introduce a new mandatory licensing/tariff scheme. The problem, according to AC, is that universities and colleges continue to copy content in AC’s repertoire but refuse to pay royalties under the approved tariffs although they used pay for copying under negotiated licenses. Almost all of AC’s allotted one hour was spent on the tariff question, in part because seven of the nine judges had many questions about AC’s interpretation of Copyright Act provisions regarding tariffs and relevant jurisprudence. In different ways, the judges asked where to find the statutory authority backing up AC’s view that tariffs are mandatory. AC’s responses to these questions seemed to boil down to the idea that the 1988 Copyright Act amendments were intended to enable the kind of blanket licensing regime that was established over the 1990s and persisted through the 2000s, a regime AC says is unworkable if tariffs are not mandatory. AC’s counsel argued that while individual copyright owners can each sue for infringement, this is a virtually useless alternative due to the time-intensive and expensive process required to do so, which is not justified by the small individual royalty amounts at issue. In AC’s view, the FCA ruling on the tariff issue is problematic because it deprives the Copyright Board’s tariff-setting process of any practical purpose and leaves AC and the copyright owners it serves with no real remedy against users who do not pay. 2 On the fair dealing question, AC’s counsel said fair dealing is a question of fact, a matter of impression. They also said that in response to AC’s claim that York must pay the approved tariff fees, York’s reply was not that it didn’t need to pay, but that it had already paid. Counsel for AC expressed the view that the 25 volumes of evidence submitted by York to show it had paid for permissions were useless. For its part, York asked the SCC to uphold the FCA ruling on tariffs and to overturn the lower court rulings on the fair dealing guidelines. Counsel for York began by objecting to AC’s portrayal of universities as rogue institutions bent on pursuing selfish commercial goals by abusing fair dealing and seeking to avoid paying for what they use as though intellectual works are much the same thing as hydro. Regarding the tariff question, York’s position was that universities are not avoiding anything because nowhere in the legislative history is there evidence that Parliament intended, as the result of tariffs merely being issued, that users would be bound by them. York’s counsel quoted from the House of Commons debates on the second reading of the 1988 bill to amend the Copyright Act. In that excerpt, the performing rights society-based regime that had stood for 50 years was said to be working well and that amendments were proposed to extend the then-existing regime to cover other kinds of works. Interestingly, Justice Rowe commented that since the quotes were from a speech by the bill’s sponsoring minister and since second reading of a bill seeks approval in principle, this source may be the most authoritative that can be extracted from the debates regarding the purpose of the 1988 expansion of the collective administration of copyrights. The crux of York’s position on the tariff question, however, was that it has always been the case that royalties for a license established by tariff cannot be extracted from a person who does not agree to be covered by the license or tariff terms. York’s counsel summarized analyses of the language of relevant sections of the current and previous versions of the Copyright Act going back to the 1930s by way of evidence bolstering this position. This legislative history was also thoroughly reviewed in the FCA’s reasons for its 2020 decision. On the fair dealing question, York’s counsel presented three arguments. The first was that the FC and FCA rulings on York’s fair dealing guidelines were marred by a fundamental legal error. Instead of focusing on fair dealing in the university context as a user’s right belonging to students, York contended that the lower courts incorrectly focused almost exclusively on the perspective of York’ so-called mass copying. As reasons for believing the lower courts’ approach to be erroneous, York pointed to the addition of “education” as a new statutory fair dealing purpose that broadens the scope of fair dealing and the SCC ruling in Alberta (Education) which confirmed fair dealing is, in a school context, a statutory user’s right for students, not institutional “free loading,” as was implied in the FC ruling. In its second point on fair dealing, York contended that if the lower courts truly made a legal error in assessing fairness from the university’s instead of the student user’s perspective, errors in the FC and FCA assessments of the fairness of York’s guidelines must be examined. York suggested one such example within the second step of the two-part fairness analysis was the FC’s inference that York’s purpose in adopting its guidelines was to avoid paying fees. York argued if this is the real purpose of universities that rely on fair dealing on behalf of their students’ user rights, then their purpose must be illicit. York said that can’t be right, as there would always be an illicit purpose and s. 29 would not be a real user’s right if we must infer a commercial purpose when some money is saved as a result of exercising a user’s right. 3 York’s third point on fair dealing touched on a question raised by at least one of the judges – why is copying beyond the guidelines irrelevant? York said it would be relevant in an infringement action but not in the present case, as we first need to know if copying within the guidelines is fair dealing before the issue of what to do about copying beyond the guidelines can be considered. In York’s view, focusing on the issue of over-copying avoids the real question: what kinds of copying properly fall within fair dealing guidelines? York suggested it is appropriate for the SCC to provide guidance on how to address this question, as without acceptable guidelines, students will be unable to actualize their statutory fair dealing rights. Delivery of the SCC’s decision is anticipated within the next six months or so, and its arrival promises to be hugely consequential to the landscape of educational copying in Canada. Creating Open Textbooks on Pressbooks In early June, Joerdis Weilandt (Teaching Centre) and I presented the first of what we hope will be a regularly offered workshop on using the Pressbooks publishing platform to create openly licensed materials such as open textbooks and open lab manuals. All U of L faculty may sign up for a free Pressbooks account as part of the Open Education Alberta (OEA) initiative in which the U of L is a collaborating institution. Works published as part of the OEA initiative are made freely available to everyone to use as-is or to adapt, remix, or customize under one of four Creative Commons licenses chosen by the author. These open licenses ensure that authors retain copyright ownership and also allow certain public uses without the need for downstream users to seek permission.
