Full text linkapplication/pdf本稿の目的は，2000年以降の日本の地域公共交通政策について，国土交通省総合政策局による「政策統合（policyintegration）」の様態を規定した要因を分析することである。
日本の地方都市では，1990年代からの規制緩和や人口減少を背景に，各地で公共交通の衰退が深刻化した。このような状況に対し，中央省庁再編によって誕生した国土交通省は，総合政策局を中心に地域公共交通政策として，従来の輸送機関毎のセクター別の対策ではなく，複数の輸送機関の連携や他の政策領域への政策目的を反映する政策統合のアプローチによる対策を模索した。
政策過程の分析結果から，まず，政策統合の様態として，「主流化」政策への相乗りによる政策統合が総合政策局の戦略として進められたため，整合性や一貫性に欠ける対応となったことが指摘される。そして，政策統合の様態を規定した要因として，組織能力・組織戦略・プロセスの観点から，①限定的なリソース，②限定的な統合戦略手段，③セクター別組織戦略の継続，④政策遺産の影響，⑤政治主導の罠という5 つが指摘される。departmental bulletin pape
A Study on Management Accounting Practices and Accounting Education in the Era of Artificial Intelligence
Full text linkapplication/pdfThis paper examines the impact of AI and digital technologies on management accounting and accounting education. Historically, management accounting has focused on minimizing deviations from pre-set goals using a “cybernetic model.” However, recent studies emphasize the role of accounting in enhancing organizational capabilities by enabling flexible decision- making in high-uncertainty environments. With the rapid advancement of AI, the role of accountants is shifting towards higher-value tasks like judgment and advisory services. AI’s evolution from simple automation to complex models, such as foundation models (FM) and multimodal foundation models (MFM), brings both opportunities and challenges. These technologies enable integration of diverse data types but also face issues like data sufficiency and potential biases. In accounting practice, AI’s application is constrained by data security concerns and the difficulty of replicating vast learning datasets. Educationally, traditional methods focused on calculation and technical skills need to adapt to new realities. Emphasizing experiential learning, understanding business contexts, and decision-making skills becomes crucial as automation takes over routine tasks. Full text linkapplication/pdfUnder tax treaties, when a resident a Contracting State (country of residence) receives dividends paid by a resident of the other Contracting State (country of source), the beneficial owner may be entitled to tax benefits, a reduction or exemption from withholding tax if a recipient is the beneficial owner. However, if the recipient is not recognized the beneficial owner, the dividend will be taxed at the normal withholding tax rate of the other Contracting State. Accordingly, it is important to clarify the meaning of the term beneficial owner in tax treaties.As the purpose of tax treaties is to eliminate double taxation between treaty countries and to prevent international tax avoidance and tax evasion, it is necessary to consider the interpretation of the beneficial ownership from the purpose of tax treaties. A Consideration on the Commencement of Execution in Substitution Theft : Focusing on the Supreme Court's Decision of February 14, 2022(Reiwa 4)
Full text linkapplication/pdf特殊詐欺の一形態であるすり替え窃盗における実行の着手時期に関して、下級審レベルの判断では、いわゆるクロロホルム決定（平成16年決定）の判断枠組みに依拠し、窃取行為との密接性及び窃取に至る客観的危険性という基準により着手時期の前倒しを認めていたが、着手時期を架け子による欺罔行為時とするもの、架け子の欺罔行為とすり替え役の待機行為、訪問行為も併せて考えるものもあり、その判断に統一的な基準が示されるには至っていなかった。また学説においても、架け子役による電話の時点で実行の着手を肯定しうるとする見解（架電時説）や、すり替え役の被害者宅訪問時をもって実行の着手を肯定すべきとする見解（訪問時説）が主張されていたところ、近時、最高裁は架け子がすり替えの前提となるうそを述べ、すり替え役である被告人が被害者宅付近まで赴いた時点で窃盗罪の実行の着手が認められると判示し、すり替え役が被害者宅を訪問する前の時点でも窃盗罪の実行の着手が認められうることを明言した（最高裁令和4年2月14日決定）。本稿は、この最高裁決定を取り上げて、あらためて事案の概要及び本件最高裁決定の要旨を確認するとともに、実行の着手に関する総論レベルでの議論との関係では、本来的な構成要件該当行為を起点としてそれと密接な行為の時点で着手時期の前倒しを肯定するという形式的限定とともに既遂に至る具体的な危険性による実質的限定を重畳的に認める多数説の立場に立ちつつ、すり替え窃盗の実行の着手時期との関係では架電時説の立場に立った上で、本件最高裁決定の当否の検証を試み、すり替え窃盗における実行の着手時期について考察を加えるものである。推薦査読付論文departmental bulletin pape
A Study of Chihei Nakamura's “NanpouYushin” : Aspects of People and God of “Southern Literature”
Full text linkapplication/pdf中村地平は〈南方文学〉を提唱し、宮崎県や台湾、シンガポールなどの南方を舞台とする作品を数多く残した作家である。「南方郵信」は地平が〈南方文学〉を提唱する以前の作品であるが、宮崎を舞台とし、後に地平自身が南方に材をとった作品系列に位置づけている。本作の有する〈南方文学〉の特徴として、描かれる土地・風物の他に、これまで作者の人間観、癒しや救いの場として南方が描かれている、ということが指摘されてきた。本稿では本作の登場人物と神にかかわる言説に注目して〈南方文学〉の要素を検討する。
「南方郵信」に登場するのは南方の村に暮らす人々である。村人たちの気質に着目すると、楽天的な態度や素朴な言動、「好色な噂話」を「開け放してしやべるのが好き」といった特徴がある。同時代、北方の農村の厳しい現実を「梟」や「鶯」などに描いた伊藤永之介は、本作の非現実的な「牧歌的農村」風景に疑問を呈する。しかし、「南方郵信」に描かれる村は決してユートピアではなく、孤独や貧しさ、男女関係から生じる問題など厳しい現実もある。しかし、そういった現実は笑いとともに「好色な噂話」や民話的な空想などのユーモアをもって眺めかえられているのである。このような村人たちの向日的な現実の受け止め方や態度は〈南方文学〉の特徴の一つとして指摘できる。
また、「南方郵信」における村人の死生観と神にかかわる言説は同時代の、反近代・脱西洋の潮流と同調したものとして捉えることができる。「南方郵信」は地平も参加していた「日本浪曼派」同人を中心に反近代・脱西洋と日本伝統への回帰の思想が強くなっていた昭和一〇年代に発表された。
本作において、死後、神となった魂は「太古からまるで変らなかつたかのやうに、静か」で「悠久な自然のなか」を漂う。近代化した都市ではなく、南方の自然に還っていく魂や神という考えは特定の信仰対象や教義のある宗教とは違った、日本人の心性や自然観に調和するものである。ここでは人々と神が地続きの自然のなかに存在する。地平は天孫降臨の地である宮崎で過ごした日々のなかでこうした自然観を培った。本作における神話・民話的な物語舞台は、近代的な都市文学とは異なる日本独自の原風景的な南方の地への意識が強く表れたものなのである。査読付論文departmental bulletin pape
