Status of Property Assets in Marriages Without a Prenuptial Agreement from the Perspective of the Civil Code and the Marriage Law: A Review of Supreme Court Decision No. 2981 K/Pdt/2024

    No full text
General background: The regulation of property assets in Indonesian marriage law operates within a dual framework involving the Civil Code and the Marriage Law, each establishing different principles on ownership and control. Specific background: These differences create practical ambiguity in marriages concluded without a prenuptial agreement, particularly when determining the status of separate and marital property upon dissolution. Knowledge gap: Despite substantial jurisprudence, limited scholarly analysis examines how both legal regimes interact in real disputes, especially in cases where property acquired before marriage becomes contested inheritance. Aims: This study analyzes the status and distribution of property assets in marriages without a prenuptial agreement by comparing the Civil Code and the Marriage Law, using Supreme Court Decision No. 2981 K/Pdt/2024 as a case reference. Results: The findings show that during marriage, property classification follows the Marriage Law, but upon dissolution—especially by death—the distribution of assets reverts to the parties’ respective legal system, resulting in the Civil Code governing inheritance for those subject to civil law. Novelty: This research clarifies the normative intersection between marital property and inheritance law in the absence of prenuptial agreements. Implications: The study highlights the need for harmonization between the Marriage Law and the Civil Code to ensure legal certainty and prevent interpretive inconsistencies in future marital property disputes. Highlights: Clarifies differences between the Marriage Law and the Civil Code in regulating property without a prenuptial agreement. Highlights how dissolution of marriage shifts asset distribution to the parties’ applicable legal system. Emphasizes the need for harmonization to prevent inconsistent judicial interpretations. Legal Review of Land Acquisition from Indigenous Peoples in the Nusantara Capital City (IKN) Project: Tinjauan Hukum Terhadap Pengadaan Tanah Masyarakat Adat Dalam Proyek Ibu Kota Nusantara (IKN)

    No full text
General Background: The development of the new capital city, Ibu Kota Nusantara (IKN), as a National Strategic Project requires large-scale land acquisition, including areas traditionally occupied by Indigenous communities. Specific Background: Although legal frameworks such as the Basic Agrarian Law, the IKN Law, and Presidential Regulation No. 65/2022 formally acknowledge Indigenous land rights, their implementation remains inconsistent. Knowledge Gap: There is still no clear mechanism for verifying customary (ulayat) rights, determining culturally appropriate compensation, or ensuring meaningful participation of Indigenous communities in land acquisition processes. Aims: This study aims to examine the effectiveness of the existing legal framework governing land acquisition for IKN and assess the extent of protection afforded to Indigenous peoples. Results: The findings show that despite normative recognition of Indigenous rights, practical implementation faces barriers, including unclear procedures, limited community involvement, and compensation that fails to reflect the social, cultural, and spiritual value of customary land. Novelty: This research highlights the urgent need for specific legal instruments regulating the recognition and protection of ulayat rights within national strategic projects—an aspect largely absent in current regulations. Implications: Strengthening regulations, establishing holistic compensation standards, and ensuring inclusive participation and dispute-resolution mechanisms are essential to achieving a fair and sustainable land acquisition process for Indigenous communities affected by the IKN project. Highlights: The legal framework recognizes Indigenous land rights, but implementation remains inconsistent. Customary land holds cultural and spiritual value that is not reflected in current compensation models. Strengthened regulations and inclusive participation are essential for fair land acquisition in IKN. No full text
General Background This study addresses the growing need for organisations to adopt long-term strategic approaches capable of sustaining competitiveness in dynamic markets, where marketing excellence increasingly depends on deliberate decision-making and adaptive learning. Specific Background Within the retail apparel sector in Ziona Mall and Al-Harithiya, the concept of strategic patience has been recognised but insufficiently examined in relation to marketing excellence and the mediating role of the marketing lens. Knowledge Gap Despite its theoretical prominence, empirical evidence on how strategic patience is channelled through marketing perspectives to enhance marketing excellence remains limited. Aims This research investigates the direct effects of strategic patience on the marketing lens and marketing excellence, and evaluates the marketing lens as a mediating mechanism. Results Using data from 189 employees and structural equation modelling, the study reveals strong and significant effects of strategic patience on the marketing lens, a weaker yet significant direct effect on marketing excellence, and a robust indirect effect indicating partial mediation. Novelty The study demonstrates that strategic patience contributes to marketing excellence primarily through the marketing lens rather than through direct influence alone. Implications These findings highlight the need for apparel retailers to strengthen culture management, knowledge development, and stakeholder engagement so that strategic patience can translate into sustainable marketing performance.Highlight : The study underscores the strong link between strategic patience and the marketing lens, which serves as the primary mechanism for elevating marketing excellence. Findings show that stakeholder engagement remains the weakest dimension, indicating the need for more consistent external collaboration. Customer value emerges as the lowest-performing aspect, signalling that stores must clarify and strengthen the value delivered to customers Keywords : Strategic Patience, Marketing Excellence, Marketing Lens, Ziona Mall, Al-Harithiya&nbsp

Component Tolerance and Performance of 2-Way Passive Crossovers: Toleransi Komponen dan Kinerja Penyeberang Pasif Dua Arah

    No full text
General Background: Passive 2-way crossover filters play a crucial role in dividing audio signals between woofer and tweeter channels, where their performance is highly dependent on the precision of passive components. Specific Background: Variations in capacitor and inductor values, along with their tolerances, can significantly alter crossover frequency, phase characteristics, and harmonic distortion, yet these effects are not fully quantified in practical implementations. Knowledge Gap: Limited studies provide an integrated empirical–analytical assessment of how component deviations influence frequency response, THD, and impedance stability in real passive 2-way filters. Aims: This study evaluates the influence of component tolerances on crossover frequency accuracy, filter slope behavior, phase stability, and distortion performance. Results: Experimental findings show that ±10–15% component deviations shift crossover frequency by 7.1–8.5%, reduce filter slope by 2.1–3.2 dB/octave, increase THD from 0.8% to 3.2% at 10W, and induce impedance fluctuations that shift the crossover point by an additional 3.2%. Inductors exhibit higher sensitivity (0.72–0.78) than capacitors (0.45–0.52). Novelty: This study provides a combined simulation–measurement analysis linking component tolerance to measurable acoustic deviations. Implications: The results highlight the need for ≤5% tolerance components and pre-assembly verification to ensure stable crossover performance. Highlights: Component tolerances significantly shift crossover frequency and reduce filter accuracy. Inductors have a stronger impact on system performance than capacitors. Using ≤5% tolerance components improves stability, distortion, and overall audio quality. Keywords: Passive Crossover Filter, Component Tolerance, Crossover Frequency Shift, Total Harmonic Distortion, Impedance Stabilit
