    Eco-Necrotourism and Public Land Management: Last Chance Tourism, Ecological Grief, and the World’s Disappearing Natural Wonders

    Last Chance Tourism. 500 Places to See Before They Disappear. 100 Places to Go Before They Disappear. As these (real) book titles attest, climate change, often in combination with loss of biodiversity, has created a new kind of ecotourism, which we term eco-necrotourism--the desire to see natural wonders and rare species before they are lost or transformed forever. As a scholarly topic, eco-necrotourism is a small facet of an emerging necessity for climate change law and policy: the need for planners, managers, lawmakers, and policy writers to consider human psychological responses to climate change and its impacts. However, those responses will be placeand culture-specific, making this new component of climate change adaptation law as varied and complex as climate change adaptation itself. This Article offers a manageable starting place for theorists, managers, and policymakers: the potential impacts of human psychological responses to climate impacts on management of the world\u27s nature parks. Eco-necrotourism emerges from the intersection of two separately observed phenomena: the long-acknowledged promotion of last chance tourism and the relatively recent naming and explorations of ecological grief. While these two phenomena have become active topics of discussion in other disciplines, this Article is the first, we believe, to discuss their intersection and the emergence of eco-necrotourism as legal problems. Thus, this Article\u27s first contribution to the legal literature is to demonstrate to readers--most importantly public lands managers--that eco-necrotourism is both real (at least for certain public natural wonders) and important for nature park managers who must increasing deal with climate change and its impacts, including the psychological responses of former, existing, and future visitors. The exact implications of eco-necrotourism for managers will, of course, vary according to the impacts that a nature park is experiencing, how tourism intersects with those impacts, and the legal authorities governing management of the protected area. Nevertheless, eco-necrotourism surfaces at least four novel and significant considerations for management: cognizing visitor psychological responses in adaptation planning; the need to reconceptualize use and access; preparing for the last visitor problem; and interrogating the meaning and methods of achieving intergenerational equity. More generally, however, this Article provides the first concrete example of how subjective human psychological responses may complicate climate change adaptation planning. Specifically, instead of merely assessing likely climate change impacts and mapping scenarios--with, of course, input from the relevant communities, individuals, and interest groups--managers and governments will increasingly need to acknowledge that building capacity to address psychological reactions to climate change impacts is a crucial part of climate change adaptation

    Socio-Economic Considerations of Living modified Organisms and Impacts on Trade: Evolution of Environmental Disputes at the World Trade Organization

    The Convention on Biological Diversity (CBD) is the most important international treaty concerning the conservation of biodiversity and the Cartagena Protocol is a specific instrument to regulate biosafety measures for Living Modified Organisms ( LMOs ). In this Protocol, apart from mandatory environmental and health risk assessments, the Parties can also voluntarily adopt socio and economic considerations ( SECs ) arising from LMOs, as stated in article 26. However, the definition of SECs is still under negotiation, therefore it does not currently have a definite concept and meaning. Also, the last Conference of the Parties proposed to expand SECs by adding extra cultural, traditional, religious and ethical considerations, resulting in an even broader and possibly non-measurable requirement. As for trade, the World Trade Organization (WTO) rules, especially the General Agreement on Tariffs and Trade, the Technical Barriers to Trade Agreement and the Agreement on the Application of Sanitary and Phytosanitary Measures, do have exemptions for stricter standards based on environmental concerns and protection. Although each one is used for a different trade purpose (i.e., bans, tariffs and sanitary measures), they share some common characteristics: science-based and precise language. Hence, as they currently stand in the CBD, it is unclear whether the SECs are aligned with the WTO rules, possibly leading to future trade disagreements if enforced, especially through domestic biosafety laws. In this respect, several countries already have regulations that include provisions to adopt SECs if desired. This study assesses whether the WTO rules and private standards apply and are in accordance with SEC requirements on biosafety regulations. For that, firstly, it is essential to determine if the trade rules and language cover socio and economic concerns or if these concerns only apply to environmental and health impacts per se. Also, this study analyzes whether the COP/MOP decisions to the expansion of SECs by adding cultural, traditional, religious and ethical criteria are helpful or will only cause more incompatibility and enlarge the gap between the CBD and the WTO. In this regard, this study also investigates whether the WTO panels and the Appellate Body, as important actors in pacifying international trade conflicts with their history of jurisprudence, can provide some guidance to answer these questions or perhaps other dispute settlement bodies of International Law can be more responsive regarding environmental and social concerns. This study also indicates how Environmental Law Principles are evolving as sources of International Law. As a consequence, it will become clearer if and how SECs can be an enforceable requirement for biotechnology, improving the lives of farmers and local communities, and just not an arbitrary trade measure used by countries as a new tool for green protectionism, without fulfilling CBD’s goals or society’s needs for more sustainable practices

    Decision-Making Among Doctoral Nurse Graduates: Degree and Career Trajectory

    Objective: The purpose of this qualitative descriptive study is to understand the decision-making process of doctoral nurse graduates regarding their education and career trajectory. Background: The nurse faculty shortage is expected to increase over the next several years as more PhD nurse faculty continue to retire. The nurse faculty shortage and demand for doctoral prepared nurses has been a point of discussion among the nursing profession for over 10 years because of its impact on the overall nurse shortage and nurse scholarship. Though government and state agencies, professional organizations, and the private sector have recognized the need for PhD nurse faculty and have subsidized educational funding toward developing qualified candidates, these efforts have fallen short. This qualitative descriptive study sought to contribute to the body of research related to increasing the number of PhD nurse faculty.Setting: Recruitment and interviews were virtual with use of email, phone, and Zoom. Methods: Participants who met with inclusion criteria were selected by convenience or snowball technique. Inclusion criteria included being doctoral nurse program graduates within the last 4 years, being employed, and being able to read and speak English. Data were collected with a demographic questionnaire and semi-structured questionnaire derived from SCCT framework. Procedure: Participant interviews were recorded via Zoom. Interviews were transcribed with Otter.ai transcription software. Transcripts were inventoried using NVivo 12 content mapping and thematically analyzed using Braun and Clarke’s framework.Findings: Mentors were influential during early career development and with choice of doctoral degree.Conclusion: More research is needed in the area of faculty mentoring relationships during early career development and for recruitment of PhD nurse candidates

    An insider scope of the present relationship between generation Z and luxury brands: Producing and executing creative display advertisements for five luxury brands

    This paper takes a deeper look into Generation Z’s current relationship with luxury brands to gain a better understanding of how to successfully advertise and gain the loyalty of this cohort long-term. By exploring the psychographics of Generation Z consumers and gaining a feel for their lifestyles, shopping habits, and purchase behavior, digital advertisements were developed for five luxury brands to appeal to these consumers through working with graphic design elements that will lure Generation Z consumers to purchase from these brands. In order for Generation Z consumers to identify with the luxury brands illustrated in the digital advertisements, fundamentals of design including composition, layout, color, and photography were displayed to best attract these consumers. By thoroughly analyzing the behavior and preferences of Generation Z consumers, I have developed and executed five digital advertisements of the luxury brands Balmain, Burberry, Louis Vuitton, Prada, and the latest Generation Z luxury brand, Telfar, to not only appeal to these consumers, however, but also to develop long-lasting relationships with them to ensure their loyalty in the years to come. After both photographing and designing the creative advertisements, I found that the significance of luxury brands to Generation Z consumers lies in the connection, originality, and self-esteem they feel in their everyday lives

    It\u27s a bitter sweet symphony: Licensing complexities and copyright law in the music industry.

    Historically, there has consistently been tension in the music industry between the ideas of ownership and accessibility. This past semester, I researched the history of copyright law and how it has evolved in regard to the licensing of musical works. I have conducted a content analysis of The U.S. Copyright Act in the last century to gain insight into its evolution and advancements. After I gathered an adequate understanding of intellectual property law within the realm of the music industry, I focused my case study research on one milestone example of copyright law’s relationship to issues of licensing and ownership rights within the music industry. I analyzed The Verve v. The Rolling Stones dispute surrounding the popular song, “Bitter Sweet Symphony,” and how this case study highlighted copyright infringement complications involved when ownership is called into question after sampling. The case also exemplifies the hypocrisy of certain musicians walking the fine line between musical inspiration and copyright infringement. This case research then led me to inquire more about the repercussions of high-profile cases and the difference between being inspired by musical style and directly copying it. My research process and content analysis have cemented my hypothesis that the music industry has been significantly impacted by the complexities of licensing. If different concepts of U.S. copyright law interpretations had been applied, the outcome of the aforementioned case study infringement would have differed or would not have occurred in the first place

    Avoiding the Summer Slide: Tier One and Two Supports Targeting Early Readers

    For more than 100 years, the “summer slide,” or the learning losses by students following a long summer break have been well documented. On average, a typical student loses a little more than one month’s worth of skill across each academic area (e.g., language arts and mathematics) throughout the summer months. Research has also demonstrated that the “summer slide” has a particularly harmful impact on reading achievement of students from low-socioeconomic status (SES) backgrounds. The purpose of the present study was to investigate the effectiveness of a tiered system of support for oral reading fluency in early elementary school aged students a summer day camp program to mitigate some of the academic loss that typically occurs. All students attending the summer day camp completed a survey-level assessment (SLA) process using AIMSweb materials to determine their instructional level with reading. Following the assessment, students were placed in tiered groups where they received intervention up to three times a week for 30 minutes and were progressed monitored weekly. Results were mixed across participants; however, nine of the 11 participants made gains by the end of the summer, and four of 11 participants performed above the predicted summer slide for the grade level they had completed in the spring. Limitations and future directions for research are also discussed for furthering supports in this area

    Menstruation in a Post-Dobbs World

    In this Essay, we re-examine our 2022 book, Menstruation Matters: Challenging the Law\u27s Silence on Periods, through multiple related lenses, including the human rights, sustainability, and workplace issues emphasized by our three reviewers; the COVID-19 pandemic; and the Supreme Court\u27s decision in Dobbs v. Jackson Women\u27s Health Organization. All of these perspectives converge on the inherent dignity and autonomy interests in being able to manage one\u27s own body. Menstruation and related conditions like breastfeeding, pregnancy, and menopause should not be sources of shame or stigma. Nor should they be vectors of formal control by the government or de facto exclusion from school, work, or any aspect of public life. Yet the Supreme Court\u27s overturning of Roe v. Wade means that reproduction-associated bodily processes likely will be the focus of legal battles for years to come. As we continue to emphasize the many ways that menstruation matters in life and law, we strive for a legal future that recognizes the full humanity of all people and safeguards our equal rights

    Early childhood is a period that is marked by rapid changes in development. Exposure to enriched experiences such as positive family interactions, participation in early childhood education, and community engagement can foster healthy development and prevent many behavioral and mental health difficulties. Conversely, young children’s development can be negatively influenced by a variety of risk-factors that have unfortunate long-term outcomes. Given the pervasive impact of behavioral development on young children’s overall developmental outcomes, research examining strategies to enhance young children’s positive behavioral outcomes is needed. The purpose of this paper is to introduce Part 1 of a two part special issue in Perspectives on Early Childhood Psychology and Education that pertains to enhancing young children’s behavioral outcomes.
