Ending Law Enforcement\u27s Accountability Crisis: The Case Against Qualified Immunity

    Get PDF
People have been marching in the streets to speak up against police brutality, and many people care about reducing police misconduct, but not everyone knows about qualified immunity. In some cases, courts can excuse officers’ unconstitutional actions to prevent officers from being held accountable in civil proceedings. Almost all police misconduct is excused and incentivized by one legal doctrine: qualified immunity. 42 U.S. Code § 1983 states that the doctrine “protects a government official from lawsuits alleging that the official violated a plaintiff\u27s rights, only allowing suits where officials violated a ‘clearly established’ statutory orconstitutional right.” In this essay, I am going to use an eclectic mode of argument to suggest that qualified immunity is illegitimate. The multiple methods of my eclectic argument are an originalist constitutional interpretation and an examination of the incentive structures implicated by this doctrine

Jessie reminisces about different memories and opportunities Linfield presented, sharing everything from playing softball and soccer to singing Adele for her senior performance. Later on, Jessie talks about her journey to Nashville and entering the music scene. She shares how a radio competition led her to sing and be friends with Gretchen Wilson. Our Moral Relationship to Nature

    Get PDF
In this paper I will explore the question of whether or not humans, as natural beings, are morally responsible for their actions in relation to nature. After all most natural beings, i.e. deer, wolves, whales, or even plants, regardless of their level of intelegence, are held responsible for their effect on the environment. When a rabbit population explodes and an ecosystem is sent into turmoil, we do not morally find fault with the rabbits. With this in mind I ask: why is it so different when humans send an ecosystem into distress? What is our moral relationship to nature? To answer this question we will examine first, in section two, the major ethical starting points of the ‘relational field, ’ a stance delveloped by Norwegian philosopher Arne Naess that, in important ways, stems from Bhuddism. In section three, this will be contrasted with prevalent views espoused in the West, specifically Chritianity, neoliberalism, and longtermism. Capitalism and its troublesome environmental and existential impact is examined next in section four. Then, section five offers a critique of these explores the social, ecological, and ethical consequences of where such stances lead us. Finally, section six, briefly explores some practical options before summing key ideas in the conclusion

Theoretical Framework for the Study of Genetic Diseases Caused by Dominant Alleles

    Get PDF
We propose a theoretical basis for analyzing several features of genetic diseases caused by dominant alleles, including: disease prevalence, genotype penetrance, and the relationship between causal genotype frequency and disease frequency. In addition, we provide a theoretical framework for accurate diagnosis and clinical approaches for disease study, including two examples in which inaccurate and incomplete diagnoses affect the estimates of disease prevalence: First, the disease iceberg effect shows that disease prevalence is often underestimated due to errors introduced by inaccurate diagnosis; second, because lifetime risk of disease is cumulative, and therefore an increasing function of age, measurements of prevalence are inaccurate if people of all ages are not included. Finally, we discuss the aggregation of genetic diseases. We identify theoretical and computational deficiencies associated with using the sibling recurrence-risk ratio as a measure of familial aggregation. We develop an alternative concept of aggregation and propose an associated measure that does not experience the deficiencies. Throughout, we provide clinicians and researchers practical implications of our theoretical framework
