The criminal justice for war crimes committed in Gaza strip: The international legal framework, prospects, and challenges
From the end of the year 2008 to 2014, Israel committed three wars in the Gaza Strip. These wars are known as Operation Cast Lead in 2008, Operation Pillar of Cloud in 2012, and Operation Protective Edge in 2014. Israeli forces have used many internationally prohibited weapons against Gaza during the wars. These wars caused destructive impacts on vital facilities in Gaza, including schools, universities, mosques, hospitals, and the United Nations Relief centers. The killings of thousands of innocent civilians by Israeli forces were visible evidence of a serious violation of international humanitarian law which conferred protection upon civilians during armed conflicts. On 1 April 2015, Palestine acceded to the Rome Statute of the International Criminal Court in order to prosecute Israeli war criminals. Thus, the primary objective of this research is to critically analyse the existing international legal frameworks, with special reference to the Rome Statute, the Geneva Conventions, and other relevant international conventions on war crime for prosecuting war criminals in Gaza Strip between the years 2008 to 2014. This study adopts doctrinal legal research by using a qualitative approach, employing historical, analytical, explanatory, and descriptive modes while analysing primary and secondary data. In this research, 15 respondents from various stakeholders were involved in a semi-structured interview. The findings thereof indicate that the existing legal frameworks prosecuting war criminals contained legal loopholes which enabled the Israeli war criminals to gain impunity. This study also found three major challenges that hinder the prosecution of Israeli war criminals. The primary challenge is for the International Criminal Court to exercise its jurisdiction. The next challenge is relating to the principle of complementarity and international cooperation. The final challenge is regarding the issue of universal jurisdiction. Thus, this study suggests that special amendments be made to Articles 8, 15, 17, 18, 53, 86, and 77 of the Rome Statute which requires urgent attention at the international level to prosecute Israeli war criminals. Further, the Palestinian government should also take a step further by domesticating the provisions of the international treaties namely the Forth Geneva Convention and its Additional Protocols, as well as the Rome Statute, into its national legislation. This study also recommends that a Special Task Force Unit be established in Palestine to handle war crimes, which is also responsible to gather all the relevant data, and evidence to prosecute Israeli war criminals as well as to be a spokesperson at the international level
Examining factors influencing attitude and adoption of chatbots among consumers
Chatbot implementation for assisting customers as a virtual agent can be seen as a tool for helping an organisation serve better customer service. Malaysia is among the countries forging ahead with the Fourth Industrial Revolution. One of the core technologies mentioned is adopting artificial intelligence tools such as chatbots. In the last few years, there has been a growing interest in AI-based chatbot adoption in various business transactions. However, in the context of Malaysia, research on chatbot adoption is still new and is a less explored and examined topic in the information systems domain. Furthermore, most of the studies were not guided by information systems (IS) theories. Therefore, this study aims to identify factors that influence
chatbot adoption by adapting the Technology Acceptance Model (TAM) as the IS theory reference. An online survey method was applied using the purposive sampling technique. Within a month, data were collected from 135 postgraduate students of Universiti Utara Malaysia, however only 121 questionnaires were useable for subsequent analysis since there were 14 respondents who were not chatbot users. Correlational and regressional analyses were used to validate the research model and assess the presented research hypotheses. This research reveals that chatbot adoption is influenced by attitudes towards chatbots. Meanwhile, attitudes towards chatbots are influenced by their perceived usefulness and ease of use. This study offers theoretical and practical contributions for academics and professionals. The limitations of the study have been addressed, and some valuable suggestions for future research work are offered
Pentadbiran dasar pekerja asing: Analisis instrumen dasar dan kolaboratif pentadbiran terhadap prestasi dasar
As a country that accepts an influx of foreign workers, Malaysia has formulated various policies to manage and control the presence of foreign workers into this country. Although various policies have been implemented to address various issues and problems related to foreign workers, the reality is that the effectiveness of these policies is often disputed. The foreign worker policy is considered as weak and inefficient, primarily due to the ineffective policy instruments used by the government in managing foreign workers. Continued reliance on weak instruments in policy implementation will impact policy performance. Therefore, this study was conducted with the objective is to examine the allegations regarding the inability of the policy instrument, by evaluating three forms of policy instruments in managing foreign workers, namely legislative, economic and communicative. This study seeks to answer three main questions. First, to what extent do legislative, economic and communicative instruments affect the performance of foreign worker management policies? Second, does collaborative governance mediates the relationship between policy instruments and the performance of foreign worker management policies? Third, how can the performance of foreign worker management policies be improved more effectively based on a collaborative governance approach? This study adopts a mixed method approach. Quantitative data analysis involved a total of 223 respondents, while 8 participants were involved in the qualitative data analysis. The results of the quantitative study indicate that legislative, economic, and communicative instruments, through the mediation of collaborative policy making and implementation, have a small predictive affect on the performance of foreign worker policies with a small predictive level of 39.7%. From the mediator’s perspective, the analysis reveals that only collaborative policy-making significantly mediates the relationship between economic and communicative instruments and policy performance. In contrast, collaborative policy implementation does not mediate the relationship between the three instruments with policy performance. The qualitative findings also shed light on factors that contribute towards the ineffectiveness of policy instruments, such as unclear policy goals, weak monitoring and enforcement, the absence of a suitable foreign worker supply mechanism for the construction industry, and weak online systems. Based on these findings, this study suggests that each category of policy instruments should be strengthened. In addition, there is also a need to strengthened the whole collaborative governance practices in order to improve the performance of foreign worker management policies
The structural model of consumer intention and behaviour towards functional foods in Pakistan
Functional foods provide nutrients, prevent nutrition-related diseases and enhance physical and mental well-being. However, people in Pakistan face many nutritionrelated diseases. This study investigates the impact of procurement goals, (i.e., health, mood, convenience, sensory appeal, natural content, weight control, familiarity, price, and ethical concerns), approval goals, consumer attitudes, consumer subjective norms, consumer perceived behavioral control, consumer intentions and consumer behaviour towards functional foods. In addition, this study also investigates the moderating role of nutritional information between consumer intentions and behavior towards functional foods. A quantitative approach was used for the study, where data was collected through a questionnaire from 384 respondents in Pakistan through convenience sampling. Partial least squares-structural equation modeling (PLS-SEM) revealed a significant impact of procurement goals (i.e., health, familiarity, and price) on consumer attitude and between approval goals on consumer subjective norms. Moreover, consumer attitude and consumer subjective norms significantly influence consumer intention. Subsequently, consumer intention affects consumer behaviorntowards functional foods. However, insignificant relationships were found between procurement goals (i.e., mood, convenience, sensory appeal, natural content, weight control, ethical concerns) and consumer attitudes and between consumer-perceived behavioral control and consumer intention. In addition, nutritional information does not moderate the relationship between consumer intention and consumer behaviour toward functional foods. In terms of theoretical implications, this study applied the theory of reasoned goal pursuit (TRGP) with the addition of nutritional information derived from the heuristic system model in a single framework to assess consumer intentions and consumer behavior towards functional foods, as well as the moderating role of nutritional information in the Pakistan context. Marketing managers should emphasize the importance of procurement and approval goals as well as aspects of attitude, subjective norms, and perceived behavioral control in formulating effective strategies for the meaningful consumption of functional foods to address nutritional deficiencies and cure diseases
The influence of transformational leadership and accountability on organizational sustainability in United Arab Emirates: The moderating role of knowledge sharing
Despite extensive research on enhancing sustainability performance of the public sector organizations in the country, there are still significant unanswered questions, and the sector has yet to fully realize its potential. Furthermore, the role of knowledge sharing as a moderator has not been previously examined. Therefore, this study aims to investigate the impact of transformational leadership and accountability on the sustainability of public sector organizations in the UAE. This research examines the moderating effect of knowledge sharing on the relationship between transformational leadership, accountability, and the sustainability of public sector organizations. The research framework integrates Social Exchange Theory (SET) and Resource-Based Theory (RBV). Data was collected from 531 employees working in public sector organizations in the UAE, specifically from four ministries. After screening the received questionnaires, 276 were deemed suitable for analysis. A stratified sampling technique was employed to ensure a representative sample. Quantitative analysis using Partial Least Squares structural equation modeling revealed a significant positive relationship between transformational leadership and economic and environmental sustainability. However, no support was found for the relationship between transformational leadership and social sustainability. Additionally, the results demonstrated a significant positive relationship between accountability and economic, environmental, and social sustainability. Moreover, knowledge sharing was found to moderate the relationship between transformational leadership and environmental sustainability, as well as accountability and economic, environmental, and social sustainability. However, the study did not find support for the relationship between transformational leadership and both economic and social sustainability. This study contributes to existing knowledge by providing a context-bound approach that refines and integrates social exchange theory and resource-based theory in the context of public sector organizations in the UAE. The findings have important theoretical, methodological, and practical implications, shedding light on the ways in which transformational leadership, accountability, and knowledge sharing can influence the sustainability of the country’s public sector organizations
Direct hybrid block methods for solving second and third-order ordinary differential equations in the presence of two higher derivatives
Some of the real-life problems that can be expressed as initial value or boundary value problems of higher-order ordinary differential equations (ODEs) may not have exact solutions. This situation necessitates the development of numerical methods for approximating the solution. One of the methods that is gaining popularity for solving higher-order ODEs is the hybrid block method (HBM). The method not only solves higher-order ODEs directly, but it also overcomes the zero-stability barrier that occurs in block methods. Furthermore, this method is capable of approximating the solutions at many points simultaneously. Literature reviews revealed that several of multi-step hybrid block methods (HBMs) have been derived based on generalised off -step point(s) without the presence of higher derivatives. In order to increase the accuracy, attempts have been made to include higher derivatives in the derivation of HBMs. However, they are limited to one-step HBMs and only consider one higher derivative in developing the methods. Hence, this study introduces new direct one and two-step HBMs based on generalised off-step point(s) in the presence of two higher derivatives for solving higher-order ODEs that have not been considered before
New family of Group Chain Acceptance Sampling Plans (GChSP) using Minimum Angle Method (MAM) for non-symmetrical data
Acceptance sampling is a statistical quality control technique used in industries to decide whether or not to accept a lot based on the inspection result of its sample. For high-quality products with a long failure time, testing time is often terminated earlier, and this is termed a truncated life test. The risks of rejecting good lots (producer's risk) and accepting bad lots (consumer's risk) occur since the entire lot’s acceptance decision depends on its sample results
