    Metode Ijtihad Komisi Fatwa Majelis Ulama Indonesia

    The Fatwa Commision and the National Sharia Council are two institutions under the central of Indonesian Ulema Council (MUI). Its primary function is to issue fatwa (a binding ruling in religious matters) related with the fnance activities or product and sharia fnance service. The mechanism in making fatwa decision in both institutions under the Indonesian Ulame Council have a similarity in the collective Ijtihād (jama’i) by using the Ijtihād methodology such as bayani, ta’lili (qiyasi, istihsani, ilhaqi) and istihlasi. This method is used specially for contemporery matters or the matters are not discussed yet in detail among the mazhab ulame (school of thought concerning muslim law).Keyword : Ijtihād, Fatw

    Moslem scholars are the prophets’ heir. There have been the Islam treasuries which they have bequeathed for Islam generations. That it cannot be denied happens difference of their ijtihād in doing istinbāṭ the law of a problem, but their differences are based on argumentation, although there is the better opinion than others (rājiḥ). It is related with that, the existence of the Common and special texts in al-Qur’ān and Hadith is one of factors influencing the moslem scholars’ ijtihād in doing istinbāṭ (to decide) the law of a problem.     Al-Risālah is a frst book concerns in ushul fkh. This book is written by Imam al-Syāf’ī rh. and contains explainations on rules of islamic argumentation (istidlāl) from al-Qur’ān. Al-Risālah book has gotten the great credit of moslem schoolars up to nowdays, as it is not only a frst book in ushul fkh but it also contains various knowledges in many felds. Imam Syāf’ī ‘s view on ijtihād and its methodology are explained in this book. Imam Syāf’ī’s methods explained in this book are : Making all cases reference to al-Qur’ān, Ḥad Ḥ īṡ, Ijmā’, and the ṣah Ḥ ābah’s sayings and qiyās, determining a law by considering a substantial argumet, determining a law by considering the illat and reducing the arguments to the visible matters, and the truth is reverted to Allah.     The assembling of learning method will not work effectively andefciently as a companion media in learning without a sufcientmethod knowledge. A method of traditional Arabic Learning isan arabic learning method that focused on “language as thescientifc tradition” so that learning an arabic means learning anarabic in details, either grammatically/sintactically (Qawā’id alNaḥwu), morpheme/accidence (Qaw ḥ ā’id al-Ṣarf) or literature ḥ(ādāb). The main aspects in learning arabic are : listening,speaking, reading and writing. The four aspects are mutualrelated, for example, a listening skill contributes to adevelopment of speaking skill, both skills are strengthened byreading skill, while writing skill contributes to a reading skill inthe text or document form.
