The Post-Brexit Need for a Data Adequacy Decision to Engage in Mutual Assistance in Criminal Matters with the EU
Full text linkThere is a need for the UK and EU to continue mutual assistance in criminal matters. As a Member State, Mutual assistance in criminal matters between was primarily governed by an EU convention. This convention builds on existing Council of Europe (CoE) conventions on mutual criminal assistance. The EU convention states that mutual assistance shall be afforded in proceedings brought by member states’ authorities, or in connection with proceedings where a person may be liable in the requesting member state. Title II provides a framework for specific forms of assistance including restitution, hearings via videoconference and covert investigations. Member states are free to conclude further bilateral arrangements. A key element of this mutual assistance is harmonised EU data protection laws. With the UK now outside the EU’s data protection architecture, this may pose a significant hurdle for future cooperation. This article critically analyses the need for a data adequacy decision from the EU for the UK to engage in mutual assistance in criminal matters post-Brexit. To reach a conclusion, the article is set out over three substantive areas considering: mutual assistance and data protection law as it applies to EU member states; the law underpinning adequacy decisions; and future legal developments post-Brexit. Specific examples of data transfers and the effect of the Trade and Cooperation Agreement (TCA) are compared and contrasted to adequacy decisions. While provisions of the TCA and EU Law Enforcement Directive (LED) provide some assurances, the article recommends that a data adequacy decision made under the LED is pursued
Meaning just ain’t in any individual head, an inter-subjective approach to meaning.
Full text linkPutnam’s Twin Earth thought experiment creates a division between externalist and internalist approaches to meaning regarding whether we believe that internal duplicates can differ in meaning when they utter the same word or not. I argue that Putnam’s externalist approach is wrong because he treats individuals as the subjects of the thought experiment when the appropriate subject for such thought experiments should be communities of individuals, thus acknowledging the social dimension of meaning. I reconstruct Putnam’s argument and show that it depends crucially on whether Oscar1 and Oscar2 mean the same thing when they say water. By means of analogy to another thought experiment, Archimedes’ Gold, I show that indeed they mean the same thing, relative to the context provided in the thought experiment. In the process of doing so I highlight what we lose if we take an invariantist approach to meaning.
I also provide an example against internalism and in favour of inter- subjectivism about meaning, arguing that the external elements to meaning are not in the world, but are properties of communities of speakers and their contexts. This is done through showing a proposition whose truth value does not seem to depend neither solely on internal characteristics nor the state of the external world, but rather on the characteristics of the relevant community of speakers. In this way I highlight what is wrong with the usual interpretations of what Putnam’s Twin Earth experiment shows
China’s role in the Syrian conflict: a cautious quasi-mediator
Full text linkThis paper examines China’s mediation diplomacy in the Syrian conflict through the theoretical framework of quasi-mediation proposed by Degang Sun and Yahia Zoubir and relies on both Chinese and English primary and secondary sources. It is argued that China has conducted a limited intercession strategy in its quasi-mediation diplomacy due to its few national interests concerned by the conflict, limited leverage over the disputing parties, the low level of international consensus over the solution of the conflict, and the high intractability of the crisis settlement

Full text linkAlthough there is a growing field exploring Autistic people, faith and churches, negative attitudes remain towards Autistic people within some faith spaces. Our paper aims to unpick the theological and sociological issues behind negative attitudes, beliefs and practices. We will then tentatively suggest how this projects a neuronormative and able-bodied image of God, and hinders the flourishing of all church members, notably Autistic people. We will then reflect on the current research landscape and knowledge-to-practice pipeline in churches. Finally, we will provide some recommendations for future directions, and practical recommendations for research and practice
Autism Theology: Discussions from an emerging field
Full text linkThis multi-authored book review explores the current state of the field of Autism Theology through a discussion of four recent publications. A concluding section reflects on several key themes in the individual reviews, drawing particular attention to: Autism Theology\u27s focus on the ideas and practices which enable autistic people’s thriving; the importance of the inclusion of different voices in the conversation (including those who are non- or minimally speaking); and the richness which autistic people’s presence and contributions bring to theology and to the Church as a whole.
