REKONSTRUKSI HUKUM BERKAITAN PERKAWINAN BEDA AGAMA PASCA PUTUSAN MAHKAMAH KONSTITUSI NOMOR 68/PUU-XII/2014
Abstrak Tujuan Penelitian ini ialah untuk menjelaskan dan menjabarkan secara jelas bahwa Perkawinan secara hukum perdata merupakan suatu bentuk perikatan (verbentenis) antara seorang pria dan seorang wanita untuk membentuk keluarga, bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Dalam realisasinya, dari sisi hukum, perkawinan tidak saja berada di ranah hukum perdata, namun melibatkan sisi hukum administrasi karena dicatatkan oleh negara. Hal ini agak kompleks saat di satu sisi, UU Nomor 1 Tahun 1974 tentang Perkawinan mensyaratkan keabsahan perkawinan disandarkan pada hukum masinh-masing agama dan kepercayaannya. Di sisi lain, terdapat model perkawinan beda agama yang tidak dinilai tidak memiliki keabsahan dalam perspektif UU Nomor 1 Tahun 1974. Tulisan ini akan menggali kompleksitas dan dimensi serta perspektif dari perkawinan beda agama. Kata Kunci : Perkawinan, Beda Agama. Abstract The purpose of this research is to explain and explain clearly that civil law marriage is a form of union (verbentenis) between a man and a woman to form a happy and eternal family based on the belief in the Almighty God. In reality, from a legal perspective, marriage is not only in the realm of civil law, but also involves administrative law because it is registered by the state. This is somewhat complex when on the one hand, Law Number 1 of 1974 concerning Marriage requires that the validity of a marriage be based on the laws of each religion and belief. On the other hand, there are models of interfaith marriages which are not considered to have validity from the perspective of Law Number 1 of 1974. The Influence of Quality of Work Life and Presence of Career Calling on Intrinsic Work Motivation among Teachers in Private Secondary School X and Y
This study aims to explore the influence of Quality of Work Life and Presence of Career Calling on teachers' intrinsic work motivation in private secondary schools X and Y. Quality of Work Life refers to working conditions that include aspects of work-life balance, social support, recognition of contributions, and a supportive work environment, while Presence of Career Calling reflects the extent to which teachers perceive their work as a calling that has deep purpose and meaning. This research is expected to provide valuable insights for school management in developing strategies to increase teachers' intrinsic motivation, so as to contribute to improving the quality of education in both schools. This study aims to determine the effect of Quality of Work Life and Career Vocation on teachers' intrinsic work motivation in two private secondary schools. Using quantitative methods and total population study techniques, this study obtained the participation of 87 teachers as research samples. Data collection was conducted through an online survey using a validated questionnaire. The results of this study showed a significant effect of Presence of Career Calling on intrinsic work motivation, while Quality of Work Life did not have a significant effect on intrinsic work motivation. This finding is consistent with previous research regarding calling variables increasing intrinsic motivation but differs in the case of Quality of Work Life which shows no effect
Phenomenological-Communicative Review of OnlyFans Normalization on Twitter Media
This thesis aims to analyze and explore the communication phenomena related to the normalization of OnlyFans on Twitter. The dynamics of pornography on social media are a concerning issue. The emergence of several platforms has led to an escalation of pornography content accessible to the public. Moreover, pornography has become more intimate and personal with the advent of OnlyFans as a new type of transactional pornography on social media. The urgency of this research is to examine the OnlyFans normalization phenomenon using a communication perspective. This study employs a qualitative method with a field study approach. The research paradigm is critical with a media analysis context. The primary data source in this study are millions of Twitter user tweets indicating OnlyFans escalation, while the secondary data used are expert opinions, regulations, scientific articles, and books supporting the research. Data collection techniques include observation, interviews, documentation, and Focus Group Discussions (FGD). The collected data will then be analyzed using Miles and Huberman's techniques, which include data collection, data reduction, and conclusion drawing. Data validity testing is performed using triangulation techniques. The research findings show that the escalation of OnlyFans on Twitter has seen significant growth. In Indonesia, Twitter is used only for promotion by OnlyFans creators. Cumulatively, the sentiment that emerges tends to be neutral towards the presence of OnlyFans. However, this sentiment is not absolute as it brings concerns, such as: 1) Digital transformation of desires, 2) Shadow industry, 3) Risk of exploitation, 4) Pandora's box of desires, and 5) Social values. The dynamics of OnlyFans in Indonesia have spurred active discussions, sentiments, perceptions, promotions, ethics, and social norms. The communication phenomena arising from OnlyFans in this study include: 1) Democratization of pornography, 2) Destigmatization of sexuality, 3) Personalization of pornography, 4) Influence of social media, and 5) Debates and regulations. These phenomena can be mitigated through collective intelligence-based digital campaign
The Analysis Of Service Quality Increasing Outpatient Satisfaction At Al Islam Hospital Bandung
The aim of the research was to determine the quality of service on outpatient satisfaction at Al Islam Hospital Bandung. where this research uses quantitative research methods. where this research was conducted in the Clinical Pathology Laboratory unit by distributing 45 questionnaires to 45 outpatient respondents. The results of the research show that the spearmen's rank correlation calculation is 0.92, indicating that the service quality variable has a very strong relationship with patient satisfaction. Calculation of the determinant coefficient obtained a result of 84.6%, indicating that the service quality variable has an influence on patient satisfaction of 84.6%. The conclusion obtained from the results of this research is that the quality of laboratory services has a very strong influence on outpatient satisfactio
The Influence Of Attitude, Behavior And Organizational Culture On Employee Performance At Bpjs Ketenagakerjaan Muaraenim Branch
This research was conducted aiming to determine the effect of attitudes, behavior and organizational culture on employee performance at the Muaraenim branch of Employment BPJS. The population in this study were all 157 employees of the Muarenim branch of the Employment BPJS. The results of multiple linear analysis show that attitudes, behavior and organizational culture have a positive and significant effect on employee performance at the Muaraenim branch of the Employment BPJS. Attitude, it is necessary to evaluate the facilities needed by employees, such as adding or upgrading computers/laptops as well as facilities and infrastructure that are tailored to the needs of employees. Behavior, there are several relationships between fellow employees and employees with superiors that are not well established. Organizational culture, with frequent changes in leadership, requires employees to get used to the established work rhythm
Political Communication Of West Java PDP PDIP In Winning The 2024 Presidential Election: Post-Jokowi Effects
In the last centuries, the development of democracy cannot be separated from the role of political communication. In West Java, political communication of DPD (Regional Representative Council) PDIP (Partai Demokrasi Indonesia Perjuangan) in winning the 2024 election requires structured and strategic planning in the contemporary political context. Effective politics can mobilize support, shape public opinion, and influence election outcomes. In the 2024 election, PDIP got a drastic drop in votes, namely being in fifth place with the badly loss of Ganjar-Mahfud in this province. This study aims to analyze the political communication of the West Java DPD PDIP in winning the 2024 election with the post-Jokowi-Effect. This qualitative study used a descriptive analysis. The results of the study showed that the political communication of the West Java DPD PDIP in winning the 2024 election was optimal in terms of communication elements such as the communicator, message content, media used, target audience, and final effect. The decline in PDIP votes in this province and the bad loss of Ganjar-Mahfud were caused by other factors, not by the political communication, namely the strong Jokowi-Effect in the use of "Jokowi Elements", the elite power factor of former PDIP and the performance of regional heads from PDIP. The phenomenon observed in the field is the low level of Pluralism and Multiculturalism in schools. The research aims to examine the study of pluralism and multiculturalism. This research adopts a qualitative approach with a descriptive method, specifically a literature review study. The data collection technique used is a literature review. The analysis technique employed is triangulation. The data sources consist of articles related to the study of pluralism and multiculturalism. The research concludes that pluralism and multiculturalism education can be achieved through curriculum development, instructional materials, and social media control, thereby fostering students' awareness and understanding to uphold the values of justice, democracy, humanity, and pluralism in social interactions amidst the diverse national realit
The Influence Of Service Quality on Patient Satisfaction, Perception, Trust and Behavioral Intention at Santo Damian Hospital
This research explores the relationship between service quality, patient satisfaction, patient perception, and patient trust at Santo Damian Lembata Hospital, East Nusa Tenggara, and their impact on patient behavioral intentions. The study focuses on evaluating how service quality affects patient satisfaction, perception, and trust, and how these variables influence patient behavior. The research was conducted among outpatients at the hospital, using a sample of 115 individuals selected through accidental sampling based on 18 indicators. Service quality is the independent variable, while behavioral intention is the dependent variable. Data collection involved questionnaires, interviews, and secondary sources, and the analysis was performed using descriptive and inferential statistics, including Partial Least Square (PLS). The findings indicate that high service quality at Santo Damian Hospital positively affects patient satisfaction, perceptions, trust, and behavioral intentions. Furthermore, the study confirms that patient satisfaction, perception, and trust serve as mediators between service quality and patient behavioral intentions. This emphasizes the significance of these factors in shaping patient behavior within the hospital setting. The research underscores the crucial role of maintaining high service quality to enhance overall patient experiences and encourage positive behavioral outcomes
The Influence Of Age And Gender: Unveiling Key Moderators In Insurtech Adoption And Use Behavior
This study aims to analyze the factors influencing the adoption and use of insurtech applications in Indonesia using the Unified Theory of Acceptance and Use of Technology (UTAUT) framework. The key factors examined include Performance Expectancy, Effort Expectancy, Social Influence, and Facilitating Conditions, along with additional variables such as Trust, Convenience, and Regulatory Expectancy. A quantitative method was employed, with data collected through a survey and analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM). The findings indicate that Performance Expectancy, Effort Expectancy, Social Influence, and Trust significantly influence users' behavioral intention to adopt insurtech applications, while Convenience significantly impacts use behavior but not intention. In contrast, Regulatory Expectancy shows no significant influence on either intention or use behavior. Additionally, age moderates the relationships between certain variables, such as Social Influence, Convenience, and Facilitating Conditions, with both intention and use behavior, whereas gender only moderates the relationship between Social Influence and behavioral intention. In conclusion, application performance, ease of use, and trust are critical factors driving insurtech adoption, while convenience is key to sustaining usage
