Islamic Ethics of Disability: A Sunnah-Based Model for Social Integration

    No full text
This research aims to investigate the foundational principles governing Prophet Muhammad’s interactions with people with disabilities, ultimately formulating a normative model for Islamic-based social integration. The study addresses the unfortunate reality that people with disabilities continue to face persistent marginalization and stigma within contemporary Muslim societies, despite the strong ethical teachings of Islam. This paper offers a crucial new perspective by shifting the focus of Islamic disability studies from traditional theological and juridical approaches toward a sociological analysis rooted in the Prophet’s actual social practices. The methodology employed is qualitative library research, utilizing primary data from the Hadith, Sīrah (Prophetic biography), and classical Islamic texts, complemented by secondary data from contemporary scholarly literature. The analysis is conducted using a descriptive-analytical approach, synergistically applying Émile Durkheim’s theory of social solidarity, Pierre Bourdieu’s concepts of habitus and social capital, and John Rawls’ theory of justice. The findings demonstrate that the Prophet’s interactions were not merely acts of moral compassion but rather reflected a systematic effort to build social participation and responsibility among people with disabilities. This was achieved through the deliberate provision of symbolic capital (honor and recognition), the elimination of stigma, and the active provision of equal social access. The novelty of this research is the formulation of a Sunnah-based social inclusion model that integrates Islamic values with modern sociological theory, thereby explicitly enriching the discourse on modern social integration and global disability studies, while also serving as an inspiration for policies and empowerment strategies for persons with disabilities in contemporary society

Reconciling Tradition and Sharia: An Evaluation of the Bejamu Saman Tradition in Aceh, Indonesia

    No full text
This article analyzes the tension between the Bejamu Saman tradition in Gayo Lues and Islamic legal norms due to the influx of modern cultural influences. The core problem lies in the practice of Najuk and the shift in artistic content that tends to emphasize sensual aspects, which harms the religious substance of tradition. The novelty of this study lies in the approach of the Sociology of Islamic Law combined with an evaluation based on Maqāṣid al-Sharī'ah to formulate a form of harmonization between local wisdom and the limitations of sharia. Using a qualitative method with a normative-juridical approach, data were collected through in-depth interviews with religious leaders, traditional leaders, and community artists in Gayo Lues Regency. The research findings indicate that Bejamu Saman is maintained as a living law because of its essential role in maintaining social solidarity and silaturahmi (ḥifẓ al-Nafs). However, the evaluation of Maqāṣid al-Syarī'ah identified a clear mafsadah in the practice of Najuk and explicit poetry that directly threatens honor (ḥifẓ al-Nasl) and ignores the principle of Sadd al-Dharī'ah. As a strategic solution, this study recommends a Cultural Reform policy to the Customary Council and the Regional Government to develop technical guidelines for preserving traditions. These recommendations include legalizing the no-touch Najuk procedure through a special forum, returning artistic content to its original form through figurative and da'wah-filled treh/sonek poetry, adjusting Bines dance movements to be less excessive, and strengthening control of performance spaces through the Keketar authority. These steps are crucial to ensure the existence of Gayo Lues culture remains in harmony with the basic values of Islamic law without losing its original essence

The Influence of Learning Environment in Developing Students' Self-Regulated Learning Abilities in Higher Education

    No full text
Self-regulated learning has been believed by several studies as one of the determinants of successful learning characterized by good academic performance. In fact, many learners are not able to regulate themselves optimally to stay motivated and consistent in learning. Therefore, this study aims to explore the influence of seven dimensions of learning environment on students' self-regulated learning. A cross-sectional research design was used in this study. Data were obtained from 419 4th semester students using a questionnaire packaged in the form of googleform. Data analysis in this study used Structural Equation Modeling Partial Least Squares (SEM-PLS). The findings in this study are involvement, investigation, task orientation, cooperation and equity have little effect on students' self-regulated learning. Meanwhile, lecture support and student cohesiveness proved to have no influence. Therefore, a learning environment that is able to create involvement, investigation, task orientation, cooperation and equity in the classroom learning process plays an important role in developing students' self-regulated learning ability.  These findings certainly provide a strong empirical basis for educational institutions to design appropriate interventions, develop relevant curricula, and create a conducive academic atmosphere to equip students with essential skills as adaptive lifelong learners who are ready to face global challenges

Strategies for Enhancing Students' Mathematical Reasoning and Disposition Ability in a Freedom Curriculum

    No full text
It is crucial to have suitable learning models in the Freedom curriculum, allowing students sufficient time to delve into concepts and improve skills, particularly in mathematical reasoning and disposition. CORE learning (Connecting, Organizing, Reflecting, and Extending) is a different approach to enhancing upper school students' mathematical reasoning and disposition abilities. This quantitative study employs descriptive and two-way multivariate analysis to examine the impact of learning models and gender on students' mathematical reasoning and disposition abilities. The study focuses on grade IX students at a public senior high school in Surakarta, Indonesia. The control group is class Phase E-8, which follows a direct learning approach and is known as the Non-CORE class. In the meantime, the Phase E-10 class is an experimental class implementing the CORE learning model. The study findings show variances in mathematical thinking and attitude among high school students in CORE versus non-CORE classes. Additionally, there is no reliance on enforcing CORE learning on male and female students, suggesting that CORE learning can be suggested for enhancing mathematical reasoning skills and disposition ability of all students irrespective of gender. CORE learning has been proven to be an effective strategy for improving students' mathematical reasoning and disposition through education oriented towards a constructivist approach centered on students, where students actively construct their knowledge through a series of processes that connect, organize, reflect, and extend concepts. This study contributes to the discourse on constructivist pedagogy by providing strong evidence that the CORE learning model improves mathematical reasoning and attitudes among upper secondary students. Those taught with CORE outperform peers in traditional settings in both cognitive and attitudinal measures. The lack of gender-based differences indicates CORE supports equitable learning. Aligned with Indonesia’s Freedom Curriculum, the model promotes active, student-centered learning and shows promise as a scalable, inclusive approach to improving math proficiency and engagement.

The Deviation of Criminal Law Principles in Embezzlement of Joint Property Committed by Husband or Wife

    No full text
This study aims to determine the deviation of criminal law principles in the embezzlement of joint assets committed by a husband or wife in marriage. Therefore, criminalization is an ideal policy formulation to overcome this deviation. This study uses normative legal research with a legislative approach that examines the Criminal Code, especially the crime of family embezzlement. In addition, a conceptual approach is also used to determine the deviation of criminal law principles so that efforts are obtained to overcome deviations from criminal law principles. This study concludes that there is a deviation of criminal law principles in the crime of embezzlement of joint assets committed by a husband or wife during marriage. This deviation is based on the inconsistency between the formulation of the crime which states that it cannot be prosecuted with the principle of criminal responsibility which regulates the reasons for eliminating the crime, namely the reason for forgiveness and the reason for justification. Furthermore, moral norms cannot prevent the prosecution of a criminal act, as long as there is a complaint from the victim as the concept of the complaint crime. Therefore, as a repressive effort in providing legal protection for victims, a formulation policy is needed by criminalizing embezzlement of joint assets committed by a husband or wife during marriage by eliminating the phrase " "it is impossible to hold criminal charges"
